Soul just dropped his @forsaken lawsuit against Basil & Hytoko today. And its a doozy!
It's a lawsuit unboxing!!
- 2/ Buckle up. This is going to be a long thread. Soul's lawsuit is technically a counterclaim. When someone sues you, you can answer the lawsuit (typically denying the allegations against you). Or, you can sue back. That's a counterclaim. And that's what Soul did here.3/ Let's dive in. Soul starts by providing some context. He created Forsaken when he was 17. It became wildly successful. He owned all the IP. And he created and owned the Forsaken discord servers. Basil and Hytoko were initially "trusted members of the community."4/ Now the "public crises" around CSAM allegations. Peter alleges that in May 2025, someone made a YouTube video falsely accusing him of something CSAM related. Which resulted in a social media storm and demands that Soul "disassociate" himself from the game.5/ Soul alleges that Basil and Hytoko knew the truth--that these allegations were from a time when Soul was just 13 years old, and Soul himself was "victimized by an older individual." But rather than stand up for Soul, they exploited the situation.6/ Soul alleges that this firestorm caused him severe emotional distress and left him vulnerable to be taken advantage of by Basil and Hytoko.7/ Here's where it starts to get interesting. First, Soul contends that he promised to transfer the ownership of the Forsaken discord to Hytoko, so long as it was just temporary. And Hytoko agreed.8/ But, according to Soul, just minutes after transferring ownership of the Discord server, Hytoko permanently removed Soul and falsely announced that Soul had transferred ownership of the game and the servers to Hytoko.9/ After that announcement, Soul contends that Basil & Hytoko, under the guise of protecting the game and being his friend, began trying to persuade Soul that the transfer should be permanent.10/ Almost immediately, Soul asked for the server back, but Hytoko refused, claiming he couldn't because of Discord's terms of service, and he had already transferred it to Basil.11/ Next, Soul alleges that Basil & Hytoko used their control of the Discord server to block Soul from selling the game to third parties.12/ Soul alleges that Basil admitted to weaponizing the ownership of the Discord server to block the sale. And, Soul claims Basil falsely accused him of stealing money from the game.13/ Soul alleges that, it is in that context, isolated, dependent on Hytoko & Basil, just 18 years old and with no lawyer, that he signed the Transfer Agreement.14/ Soul asked that the agreement to transfer ownership of the game would give him the right to terminate and retain ownership. But that's not how it was actually drafted, according to his allegations.15/ Phew. Finally let's get to the claims. First, Soul alleges that the transfer agreement is void because he didn't get any "consideration." That's lawyer speak for saying that Soul didn't get anything in return for the transfer.16/ Second, Soul asserts the Transfer Agreement should be "rescinded," which is a fancy legal term for undoing the agreement. Why? fraud & duress:17/ And also because the agreement is "unconscionable." That's legal speak for saying the circumstances surrounding its signature and its terms are so unfair and one-sided that it shouldn't be enforced. There are 18 total claims. I'm not going to get into the other 16 claims. Here's a link to the counterclaim if you want to read it yourself.
