i got a legal notice from an angry competitor because i published truthful commentary on them. there's a particular business practice i really frown upon and find deceptive and I discussed it in detail. they sent me a muti page notice. my reply made it obvious, in no uncertain terms, that i'd rather spend $750,000 fighting them in court than remove a single thing I said that is true, and I have access to the legal resources necessary to make a proper case as well as recover all fees using appropriate anti SLAPP laws. i wish more people did this. Now I actually have the money for it & I get the 'oh must be easy for you with money now', but I've been telling the people who do this to shove it for OVER SEVENTEEN YEARS!!! This legal notice was from when my bank account had $260 in it. I could barely buy a monthly metrocard much less pay a lawyer. I replaced my site page they were complaining about with a screenshot of this letter & a photo of me mocking them, because they deserved it. I'm fine. Bullies win because people fold the moment they get a cease and desist. If you are doing the right thing for the right reason, you are in the position of advantage, not the person suing you. Never roll over. If you wish to stop pursuing something of your own volition, that is acceptable - but NEVER let other people intimidate you.

Bad companies deserve to be called out. Good on you for standing strong when you didn’t have the funds to fight. Sometimes just the will to fight leads to victory.

Many years ago a company I worked for got a C&D from a disgruntled former customer we had partnered with over some BS that was their fault (not worth even going into here). After receiving service the other side's attorney called my boss up and rather aggressively and belligerently claimed that settling now would save us lots of headache and money to which my boss said said "Ok. I look forward to discovery." The attorney got quiet and my boss said "good bye" and hung up. We never heard from them again.

The legal system in the US needs an overhaul so nobody can threaten anyone with false claims. I wrote this many times before but in germany you can't do this because the loser of a case pays the costs of the winner if you demand it. You can't threaten anybody here if they know they are right. And if you don't have the money and your income is too low you can apply for legal aid so the state lends you the money until the case is cleared. If you win the enemy has to pay it back automatically and the lawyer requests it so the judge puts it onto the "bill" for the process.

Generally speaking... A Cease And Desist letter has about zero legal authority. It is a wish.... made in a nasty tone of voice. If they have a real legal point.. and they rarely do... go ahead and deal with it. But, mostly, if they had a real case, they'd skip the Cease And Desist letter and file suit. Or so it seem to me.. with seven decades wide experience.
