NOTICE PROCESS FOR REPORTING OF NONCONSENSUAL INTIMATE VISUAL DEPICTIONS
The TAKE IT DOWN Act (Pub. L. 119–12) is a federal law which requires platforms like Rumble to establish a process for people who have had identifiable intimate images shared online without their consent to request that those images be taken down. Some states also require platforms like Rumble to take down identifiable intimate images and other forms of content.
Rumble's Responsibilities Under the TAKE IT DOWN
If Rumble receives a report that meets the requirements of the TAKE IT DOWN Act, we will remove the reported content within 48 hours. We will also make a good faith effort to remove any copies of validly reported content within 48 hours. People pictured in nonconsensual intimate imagery can authorize someone to act on their behalf to make a valid report.
Please note that the requirements of the TAKE IT DOWN Act only apply when:
- (I) The content includes an intimate depiction of an identifiable individual;
- (II) The content was published without the consent of the identifiable individual; and
- (III) The person requesting the takedown is the identifiable individual or their authorized representative.
Intimate depictions include “digital forgeries” or deepfakes if they are indistinguishable from an authentic visual depiction of the identifiable individual.
The TAKE IT DOWN Act also requires Rumble to publish this notice, and to establish a process by which identifiable individuals can notify us if nonconsensual intimate imagery that depicts them is posted to our platform, and request that we take it down.
How to Submit a Notification and Request for Removal
To submit a TAKE IT DOWN Act takedown request, you must provide specific information as required by law.
To submit a request for takedown, please submit your request by email to moderation@rumble.com, with a copy to legal@rumble.com. The request must be by the individual depicted or someone they have authorized, and must include the following information:
- (A) A physical or electronic signature of the identifiable individual (or an authorized person acting on behalf of such individual);
- (B) An identification of, and information reasonably sufficient for Rumble to locate the intimate visual depiction of the identifiable individual, such as a link to the content or video URL and timestamp for where the intimate visual depiction appears;
- (C) A brief statement that the identifiable individual has a good faith belief the intimate visual depiction they are reporting is not consensual, including any relevant information for Rumble to determine the intimate visual depiction was published without the consent of the identifiable individual; and
- (D) Information sufficient to enable Rumble to contact the identifiable individual (or an authorized person acting on behalf of such individual).
Please note that if your request does not meet the requirements of the TAKE IT DOWN Act, including if the content is not intimate imagery as defined by the TAKE IT DOWN Act or if you are not the individual depicted in the content or someone they have authorized, we may not act on your request. If your state has requirements that differ from the TAKE IT DOWN Act, or allows for other kinds of reports, please submit a request by email to moderation@rumble.com, with a copy to legal@rumble.com.
