Essex DA declines to prosecute officer’s former fiance in alleged break-in

Essex District Attorney Paul F. Tucker will not prosecute the estranged fiancé of Kelsey E. Fitzsimmons, a North Andover police officer who was shot in June during a confrontation with fellow officers at her home.

In court documents filed in Essex Superior Court, Fitzsimmons’s attorneys alleged that Justin C. Aylaian broke into her home on July 3 while she was hospitalized.

She was shot in the chest on June 30 by a police officer as he tried to serve her a restraining order that Aylaian had obtained against her.
