Homeowner left 'absolutely fuming' over neighbor repeatedly cutting down their trees: 'This is vandalism'

  • Neighbors are going over a homeowner's fence to trim their trees without permission, causing damage to the garden and creating noise disturbances for nearby residents.

Almost everyone can empathize with the feeling of having a bad neighbor — and one Redditor is asking other users for advice about their particularly awful situation.

The homeowner shared the post on Reddit's r/BadNeighbors forum, explaining that their neighbors were going over their fence to trim their own trees, including a newly planted olive tree.

Besides reaching over the fence and trimming the tree (which the neighbor supposedly said was done to "save" the poster from hiring a gardener), the neighbors also play loud music and cause constant noise and chaos for nearby residents. The Redditor noted that the damage to their garden was significant enough that they would now have to pay a professional to clear it.

Pesky neighbors violating property boundaries can cause headaches for any residents — especially those who rely on trees for shade on hot sunny days. Improperly pruning trees can have significant implications on a plant's health and vitality.

One of the major potential issues seen with improper upkeep is that it can lead to an increased risk of disease in trees. And, depending on the location where the tree is cut, it can also lead to the plant being unable to sufficiently photosynthesize, which could kill it.

In turn, this also means that the tree won't be able to do its part in absorbing carbon pollution and generating the oxygen we need to breathe.

Other Reddit users advised reporting the situation to the proper authorities.

"This is vandalism, call the cops and report them so the next time they think twice or you have a record of them already being a problem," one user wrote.

"Report. Get cameras. Report every time he comes onto your property without permission. Preferably get some footage of you telling him clearly and politely that he needs to leave your private property. If he doesn't, call the cops," another said.

Your yard's property line is a tricky place, especially without a fence or a hedge to define it, and that can make trimming trees along that border especially tricky. You might not know exactly where your land officially ends, and your neighbor's begins.Even if you do know exactly where the line is, taking any drastic action along this sensitive zone can be risky — especially if you want to remain friendly with your neighbors.

If a neighbor's white pine tree has grown to the point that some of its limbs are overhanging your patio, depositing messy pitch all over it, what can you do? Can you trim your neighbor’s tree, because it hangs over your yard? A tree expert helped us navigate this thorny issue.

Can You Trim a Neighbor’s Tree Hanging in Your Yard?

The short answer is yes — as long as you stay on your property. In every state, you legally have the right to trim a neighbor's tree up to your property line. But it's important as long as you don't trespass without permission or cause damage to the tree.

"It is always best practice to communicate your intentions to the owner before performing any work to help maintain good neighborly relations," says Mark Chisholm, a New Jersey Licensed Tree Expert associated with Stihl and with Aspen Tree Expert Co.

Still, while you're within your rights to trim branches that hang over onto your side of the property line, there are reasons why you might not want to. And even if you decide that you want to trim those limbs, there are other caveats to consider.

How to Find Your Property Line

Before you do anything, find out exactly where the boundary between your yard and your neighbor's yard is. To find the official boundary, you can look several places.

  • Locate those survey pins. They are usually metal stakes. If they have become covered in soil over time, you can find them using a metal detector.

  • Consult your property deed.

  • Consult public city records or Google Maps.

What to Consider Before Trimming a Neighbor's Tree

You Might Need Pro Help

Removing the offending limbs might not be a DIY job. Sometimes, the tree in question is so large that the branches needing removal overhang your house.

At such a height (and considering the damage that can occur if something goes wrong), it's best to hire a professional for the job.

Talk to Your Neighbors

Like with all conflicts, communication is key. The beauty of reaching out to your neighbors about their overgrown tree is that, once your neighbors learn of your concern, they might even volunteer to do the job (or pay for the job) themselves, considering that it is their tree.

But don't enter the discussion with this result as your objective. Rather, your objective is to show common courtesy. It simply wouldn't be neighborly to trim the branches of their tree without giving them a heads-up, even if they are on your side of the boundary.

Keep the Tree's Health in Mind

You have the legal right to trim branches overhanging your property line, but legal considerations don't end there. When you trim branches, you are inflicting wounds on a tree. Usually, no harm comes to the tree as a result, but this is not always true. Diseases can enter through the open wound.

If this should result in significant damage to the tree, you could be held liable. Consult with an arborist before taking on this task. If questions still linger after the consultation, consider forgoing the project altogether unless it's necessary.

Trim Only to the Property Line

You can only trim the part of the tree that's encroaching on your yard, and the rest is for your neighbor to deal with.

For example, if 3 feet of a 10-foot branch protrude onto your side, trim only those 3 feet — otherwise, you're not within your legal rights.

Stay in Your Own Yard While Trimming

This is true especially if you aren't able to contact with your neighbors ahead of time. Be sure to make the cut(s) while standing in your own yard. Otherwise, again, you might run into legal issues when it comes to trespassing.

Mind Your Own Yard

What if the situation were reversed? Consider being preemptive: Prune your tree's branches before they become an issue. This is the neighborly approach.

Also, because you have access to where the limbs meet the trunk, you can be sure you're pruning the tree properly: Prune off the whole limb, cutting close to the collar, but avoid slicing into the collar itself.
