Post in thread '💀 Horrorcow - Nicholas Robert Rekieta / Rekieta "Law" / Actually Criminal / @NickRekieta'
okay i'm busy right now but just to clarify:
(1) there were two different lawsuits ongoing. the one where hardin intervenes in the criminal case where the bodycam is evidence (CRIMINAL CASE), and a separate foia case against the county for refusing our foia (FOIA CASE).
(2) the very suspicious and blatantly abusive legal decisions that removed the bodycam footage from evidence was in the CRIMINAL CASE,
(3) letters by the county following that to refuse our foia request resulted in the FOIA CASE,
(4) the CRIMINAL CASE was appealed and in the appeals court the appeals judges asked Bromke why this was being appealed when there was a FOIA CASE,
(5) the FOIA CASE was partially* dismissed [without prejudice, we can refile] because the judge said we have an ongoing intervention in the CRIMINAL CASE,
(6) the next step is was [already done] to notify the appeals court in the CRIMINAL CASE [who have not yet ruled in the appeal decision] that their concerns regarding the FOIA CASE are now moot.
(7) There are still multiple options in both cases and there's actually options for more cases.
(8) Rekieta is not actually a party in any of this and him claiming there's attorney's fees for the state's actions is a bit strange. he is likely interpreting a statute that would award us fees.
