7.1 Modifications to Terms and Prices DeluxHost may revise these Terms and/or its prices from time to time. Any changes will be communicated to customers via the client area and/or email and will not affect any period already paid.
Unless otherwise required by applicable law, price changes apply only from the next renewal date or from new orders placed after the effective date of the change. If you do not agree with the changes, you may cancel the renewal before the renewal date.
Black Friday and other promotional offers are limited offers and may be discontinued at any time for new orders.
For existing promotional services, any price adjustment (if required due to justified technical/operational reasons, cost increases, or to preserve service quality and continuity) will apply only at renewal and will be communicated in advance. Customers who do not accept the change may cancel before renewal.
8.1. All VPS/VDS/Game servers/Dedicated servers must be paid in advance. Failure to pay your server’s monthly fees may result in suspension and, ultimately, cancellation of your server within 48 hours.
8.2. If you decide to cancel a subscription with us, please also remember to cancel your PayPal subscription, as it may not be automatically canceled in some cases. deluxhost.net can refund any overpayments if the subscription cancellation script fails to work.
8.3. In the event of a payment dispute or chargeback, all services under the customer’s account may be suspended immediately and without prior notice until the dispute is resolved.
8.4. No personal credit or debit card details are stored directly by deluxhost.net.
8.5. A monthly order (Service Renewal) is considered as 30 days and deluxhost.net provides a 12-hour cooling-off period; if the service is not adequate for you, we can refund you (excluding dedicated servers which we cannot refund). After the 12-hour cooling-off period, refunds may be denied.
8.6. For new orders (excluding dedicated servers), we offer a 12-hour cooling-off period (refund window) during which you are entitled to a full refund. After this 12-hour window, refunds may be denied.
8.7. All dedicated servers are treated as business-to-business transactions and are non-refundable due to their resale nature. This means that refunds cannot be granted.
8.8. The invoice will be issued 7 days before the actual due date to avoid delays in payments for automatic renewals; you have until the due date to complete the payment. If payment is not received by the due date, the related service will be automatically suspended on the same day. If payment is still not made within 2 days after the suspension, the service and all related data will be permanently deleted. A late payment fee of up to 10% may be applied to services that remain in suspension status during this period.
8.9. At our discretion, we reserve the right to refuse the renewal of services.
8.9.1 Requesting a free trial of the service waives the right to a refund within 12 hours after payment if you choose to use the service after the trial expires.
8.9.2. Eligible services, even within the 12-hour refund window, will be deemed ineligible for refunds if used for illegal or harmful activities.
8.10 Refund Fees In the case of refunds, any bank fees, PayPal fees, or other transaction-related charges will be the responsibility of the customer. Deluxhost.net will not cover any fees incurred from payment transactions, and the refund amount will be reduced by these fees, if applicable.
8.10.1 Refund Processing Time
Approved refunds will be processed within 7 business days from the date of confirmation. The actual time for funds to appear in the customer’s account may vary depending on the payment provider or banking institution.
8.11. Disputes and Chargebacks Filing a PayPal dispute or chargeback instead of using our support system is considered a violation of our Terms of Service and may result in permanent account termination. In the event of account termination under this clause, all active services associated with the account, including VPS instances and any data stored on them, will be automatically suspended and permanently removed.
8.12. VPS Ownership Transfer Fee any request to transfer ownership of a VPS, VDS, or similar service to another person or customer account is considered an optional administrative service. A fixed administrative fee of €5.00 will be applied for each ownership transfer request. The transfer will only be processed after payment of the applicable fee.
8.13 Right of Withdrawal (EU Consumers)
In accordance with Directive 2011/83/EU and applicable Italian consumer law, customers acting as consumers may have a statutory right of withdrawal within 14 days from the conclusion of the contract.
However, by purchasing DeluxHost services and expressly requesting immediate activation of the service, the customer acknowledges and agrees that:
a) the service performance begins immediately after payment;
b) the customer expressly waives the right of withdrawal once the service has been activated;
c) no refund shall be due once the service provisioning has started.
By accepting these Terms of Service and completing the purchase, the customer confirms this express request and waiver.
8.14. Price Changes (Renewals) and Promotional Offers
8.14.1. All services are billed in advance for the selected billing period. The price paid at the time of purchase remains valid until the end of that paid period.
8.14.2. DeluxHost may change prices for renewals and new orders. Such changes will be notified in advance through the client area and/or by email.
8.14.3. If a service has auto-renewal enabled, the customer remains responsible for ensuring the renewal is cancelled in time if they do not wish to renew at the updated price.
9.1 The use of proxies and virtual private networks (VPNs) is permitted exclusively for legitimate and lawful purposes. However, it is strictly prohibited to use these tools for illegal activities, such as unauthorized access to computer systems, violation of others’ privacy, or concealing malicious activities.
9.2 The use of our services for cryptocurrency mining is strictly prohibited. Using server resources for mining operations may compromise the stability and performance of the system, and as such, is considered a violation of our terms.
9.3 It is strictly prohibited to use our services for any illegal activity, including but not limited to:
Any activity that violates local, national, or international laws is strictly prohibited and will result in immediate action on the service, including suspension or termination of the contract.
9.4. Excessive Resource Usage (CPU and Disk I/O). Excessive resource usage is strictly prohibited on our VPS servers. For the purposes of this policy, “excessive usage” includes, but is not limited to:
Sustained or continuous utilization of 90% or more of the allocated CPU cores for extended periods of time, or
High or continuous Disk I/O operations (such as constant read/write activity, intensive file processing, or similar behavior) that negatively impact the performance, stability, or reliability of the shared hosting environment.
We reserve the right to monitor resource usage and take appropriate actions, including, but not limited to, temporary throttling, suspension, or termination of the service, if we determine that your usage exceeds acceptable operational levels.
Customers must ensure that their use of CPU, Disk I/O, and other system resources remains within the limits and intended purpose of the selected plan. Repeated or severe violations of this policy may result in service suspension or contract termination without prior notice.
9.5 We reserve the right to monitor, intervene, and take preventive actions to ensure that the service is used in accordance with our terms of service. Any activity that could damage the integrity of our system or violate the law will be treated with the utmost seriousness.
9.6 Security Testing and Network Scanning: The use of any network or security-testing tools (including but not limited to port scanners, stress testers, or penetration tools) is prohibited unless expressly authorized in writing by DeluxHost. Unauthorized testing activities may result in immediate suspension or termination of the service.
10.1. Although services may be advertised as “unlimited” or “unmetered,” they are subject to physical hardware and network limitations, as well as our fair use policy; extreme usage deemed abusive may result in a request to remove certain features or, in extreme cases, service termination.
10.2. Fair use is at the discretion of the DeluxHost administrative team, and you agree to accept any decision made by them. We will only enforce the fair use policy in situations we deem extreme.
10.3. We reserve the right to refuse service in the event of abuse of the free trial or initial refund window.
These terms and conditions are governed by and construed in accordance with the laws of Italy. Any disputes arising from these Terms shall fall under the exclusive jurisdiction of the Court of Rome (Italy).
We do not tolerate or accept behavior we deem threatening or abusive toward our staff or other customers; we reserve the right to terminate services in such cases at our discretion.
All services, including but not limited to dedicated servers, are set to expire on the date indicated in the client area. Automatic suspension of the service occurs at 00:00 (server local time) on the day following the expiration date, unless renewal has been completed and confirmed before that time.
It is the client’s responsibility to ensure payment is made on or before the stated due date. Payments made after 00:00 on the day following expiration do not guarantee immediate service restoration and may be subject to reactivation delays or additional fees, as outlined in this agreement.
We strongly recommend renewing services at least 24 hours before the expiration time to avoid service interruptions due to potential payment processing delays.
Customers are solely responsible for maintaining up-to-date backups of their data. DeluxHost does not guarantee the recovery of data lost due to suspension, deletion, or system failure. Backup services, if provided, are offered on a best-effort basis and should not be considered a substitute for the customer’s own backup strategy.
You agree to indemnify, defend, and hold harmless DeluxHost, its employees, and affiliates from and against any and all claims, liabilities, damages, losses, or expenses (including legal fees) arising out of your use of our services, violation of these Terms, or infringement of any third-party rights.
DeluxHost shall not be liable for any delay or failure to perform obligations caused by events beyond its reasonable control, including but not limited to natural disasters, network outages, power failures, or government actions.
