European laws let a killer driver stay in the UK

He was told he would be deported at the end of his four-and-a-half year sentence.

But he challenged the ruling, claiming he was not a danger to society.

Under European law, citizens of EU member states can be kicked out of Britain only if they are a “serious threat”.

The Hungarian crashed into the victim’s motorbike in rain at night in 2010 while overtaking a lorry.

He denied causing death by dangerous driving but a jury found him guilty.

The names of the victim and the driver were not disclosed in the immigration appeal ruling.

The case will add to concerns that European law is hampering attempts to deport foreign criminals.

A Home Office spokesman said: “We firmly believe that foreign nationals who commit crimes in the UK should be deported.

“Last year we removed more than 5,000 foreign criminals – the highest since 2010-11.”
