This is another example of how naive the West has been when dealing with China over the years. Confidentiality agreements, non-disclosure agreements, etc, don’t mean anything if the counterparty is never serious about abiding by them especially when the person moves to China which is actively encouraging people to help it obtain trade secrets by hook or by crook. Legal actions can at best help you seek damages and injunctions after damage is done — that is, when it’s too late. And it’s one thing to win a lawsuit; it’s a totally different thing whether you are actually indemnified or whether the injunction is respected and complied with. And the financial compensation you get — if you can get it at all — is definitely far outweighed by the competitive advantage you lose to China which can now leap forward and significantly close the technology gap…
