At the HHS announcement yesterday announcing proposed rules to ban GAC, they said trans people are "at the root of the evils we face" and are "a hatred for nature as God designed it and for life as it was meant to be lived.” Just in case you thought it was about concerns for proper healthcare.

One reason the NYT has burned its credibility with trans people is that they still cite the discredited Cass report in reporting on trans healthcare. Never the German, Utah, or other systematic reviews supporting care. They also never provide the political context behind restrictions in care.

They never mention that key figures driving these bans are all connected to a global far right and reactionary movement to roll back gender rights. SEGM is the respectable face of this movement they use to undermine access to care. SEGM members have driven the bans on GAC in Europe and the US.

This is what NYT and particularly Azeen Ghorayshi do. They lie by omission by highlighting particular things that support bans and care while omitting crucial context and contradicting evidence. When challenged, they'll resort to Mott and Bailey tactics and say, well it's true!

I speed read the rule and this is extremely weak and subject to legal challenge. It's ultra vires, coercive to states under the spending clause, violates the APA, and villages states 10th amendment rights to regulate medicine among other legal deficiencies. This will be enjoined in court.

The issue is that the admin will certainly appeal all the way to scotus on the shadow docket and scotus will certainly stay the injunction and allow the rule to go into effect. It's a matter of time before that happens and clinics need to get creative to circumvent the rules.
