PARTICIPATION IN THE BACK TO HOGWARTS GIVEAWAY (THE “SWEEPSTAKES”) CONSTITUTES YOUR ACCEPTANCE OF THESE OFFICIAL RULES (“RULES”). BY PARTICIPATING, YOU REPRESENT AND WARRANT THAT YOU MEET THE ELIGIBILITY REQUIREMENTS STATED IN THESE RULES AND ACKNOWLEDGE THAT THE FAILURE TO MEET ALL ELIGIBILITY REQUIREMENTS WILL RESULT IN DISQUALIFICATION FROM THE SWEEPSTAKES.
SWEEPSTAKES BEGINS AT 12:00:01 AM EASTERN TIME (ET) ON SEPTEMBER 1, 2025, AND ENDS AT 11:59:59 PM ET ON SEPTEMBER 14, 2025 (THE “SWEEPSTAKES ENTRY PERIOD”).
WHO MAY ENTER: The Sweepstakes is open to legal residents of the fifty (50) United States (and the District of Columbia) age 18 or older at time of entry (collectively referred to hereafter as “Entrant” or “Entrants”). Employees (or individuals who have been employed within the last twelve (12) months) of Sponsor (defined below) or Universal (defined below) and their respective parent companies, subsidiaries, affiliates, franchisees, distributors, advertising, public relations and promotion agencies or any company or individual involved with the development or execution of the Sweepstakes (collectively, the “Sweepstakes Entities”), and their immediate family members and/or those living in the same household of each, whether related or not, are not eligible to enter or win. Sweepstakes governed by U.S. law. Sweepstakes is subject to all applicable federal, state and local laws and regulations. Void where prohibited by law.
HOW TO ENTER FOR A CHANCE TO WIN: To enter, the Entrant must scan the in-store QR code during the Sweepstakes Entry Period and follow all onscreen instructions to complete and submit the Sweepstake entry form. Entrants can also visit www.krispykreme.com/promos/harry-potter/giveaway during the Sweepstakes Entry Period and follow all onscreen instructions to enter the Sweepstakes by competing and submitting the Sweepstakes entry form. ENTRY LIMIT: THERE IS A LIMIT OF ONE (1) ENTRY PER ENTRANT.
Any attempt by an Entrant to obtain more entries by using multiple/different email accounts, identities, or any other methods will void that Entrant’s entries, and that Entrant will be disqualified. Use of scripts, macros, or any other automated system to participate or subvert the process is prohibited and will result in disqualification. In the event of an identity dispute, entry will be considered made by the registered holder or owner of the email address account used for entry. A potential winner may be required to show proof of being the authorized holder of the email account. Mechanically reproduced entries will be disqualified along with all entries associated with the disqualified entry or entries. Sponsor is not responsible for lost, late, garbled, damaged, illegible, incomplete, inaccurate, misdirected, or mutilated due entries. All entries submitted become property of the Sponsor and will not be acknowledged.
WINNER SELECTION & ODDS: The potential winner will be randomly selected from all eligible entries received during the Sweepstakes Entry Period. A random drawing will be conducted on or about September 15, 2025, by the Sponsor, whose decisions are final and binding. Odds of winning are determined by the number of eligible entries received during the Sweepstakes Entry Period.
PRIZE: There will be one (1) Prize (“Prize”) awarded. The prize winner (“Winner”) will receive a trip for Winner and up to three (3) Guests (“Guests”) to the Winner’s choice of either (a) Universal Orlando Resort in Orlando, Florida; or (b) Universal Studios Hollywood in Hollywood, California.
a. If the Universal Orlando Resort destination is chosen (“the UO Prize”), Prize will include round trip economy class air transportation for each Winner and Guest from a major commercial airport near Winner’s home (as determined by Universal Orlando in its sole discretion) to Orlando, Florida*; four (4) nights’ standard hotel accommodation (one room, quadruple occupancy, room and tax only) at Universal Terra Luna Resort or at another Universal Orlando Resort hotel (as determined by Universal Orlando in its sole discretion); non-exclusive ground transportation to and from airport and hotel in Orlando, Florida*; and Universal Orlando 3-Park 3-Day Park-to-Park PLUS 1-Day Universal Epic Universe Tickets for admission to Universal Studios Florida and Universal Islands of Adventure theme parks, Universal Volcano Bay water theme park, plus one (1) day admission to Universal Epic Universe, for Winner and Guests. The Approximate Retail Value (“ARV”) of the Trip is Four Thousand Nine Hundred Eighty-Seven and 88/100 Dollars ($4,987.88).
b. If the Universal Studios Hollywood destination is chosen (“the USH Prize”) Prize will include round trip economy class air transportation from a major commercial airport near Winner’s home (as determined by Universal Studios Hollywood in their sole discretion) to Los Angeles, CA**; two (2) nights’ standard hotel accommodation (one room, quadruple occupancy, room and tax only) at Sheraton Universal Hotel (or at another nearby hotel as determined by Universal Studios Hollywood in their sole discretion); non-exclusive ground transportation to and from airport and hotel in Los Angeles, CA**; two (2) days general admission tickets to Universal Studios Hollywood for Winner and up to three (3) Guests. The ARV of the Universal Studios Hollywood Prize is Four Thousand Four Hundred Ten and 00/100 Dollars ($4,410.00)
Trip must be completed by September 14, 2026, or Prize will be forfeited. Travel dates and arrangements are subject to air travel, holiday, blackout dates, and other prize and travel restrictions. Travel dates are subject to Universal and Sponsor approval. Reservations are subject to availability. Trip must be booked at least sixty (60) days prior to intended departure date. If Winner elects to partake in any or all portions of his/her Prize with fewer than the allotted number of Guests or no Guest, the Prize will be awarded to Winner and each participating Guest and any remainder of the Prize will be forfeited and shall not be subject to further or alternative compensation. All elements of the Prize must be redeemed at the same time, and no changes will be permitted after confirmation of any redemption. If Winner is between the ages of eighteen (18) and twenty-one (21), he/she must be accompanied by an adult of at least twenty-one (21) years of age in order to check into the on-site hotel. Unless child or ward of Winner or one of the allotted Guests, each Guest must be eighteen (18) years of age or older as of the date of departure and must travel on the same itinerary and at the same time as the Winner. A parent or legal guardian must accompany a traveling minor. ARV of Prize may vary depending upon the points of departure, ground transportation, and/or airline fare fluctuations; any difference between stated ARV and final ARV of Prize will not be awarded. Prize consists only of the elements expressly set forth above; no other elements or expenses (including, without limitation, insurance, meals, unspecified ground transportation, phone calls, baggage, gratuities, incidentals, souvenirs, gasoline, etc.) are included in the Prize and all such expenses are the sole responsibility of Winner. Winner is responsible for any air travel taxes and/or expenses, including applicable departure taxes or fees, inspection charges, baggage fees, and security charges. Winner and Guests are responsible for obtaining, at their own expense, any necessary travel documentation (i.e. valid photo identification, visas, passports, etc.) prior to travel. Once issued, tickets are nontransferable and may not be reissued once travel has commenced. Open tickets may not be issued and stopovers are not permitted. Travel arrangements must be made through Universal.
* For a Winner who is a Florida resident, air transportation may be substituted with another method of transportation by Universal Orlando in its sole discretion.
** For a Winner who is a California resident, air transportation may be substituted with another method of transportation by Universal Studios Hollywood in its sole discretion.
In connection with any visit to Universal Orlando Resort and/or Universal Studios Hollywood, please be advised that Universal’s policies, CDC guidelines, and the recommendations of health officials must be followed. In addition, Winner and Guests should be aware of and comply with government guidelines regarding travel restrictions and mandatory quarantines before visiting any Universal destination. Please note that any public location where people are present provides an inherent risk of exposure to COVID-19, and Universal cannot guarantee that any person will not be exposed during a visit.
All parts of the prize selected are subject to availability and blackout dates, and subject to change without written notice or warning. Should an act of God, hurricane, war, fire, riot, earthquake, act of public enemies, actions of governmental authorities, epidemics, pandemics and the spread of infectious diseases, and any related governmental or judicial actions taken in connection with, or as a response to, any such event, or any other event beyond the reasonable control of a party, whether or not existing, known, foreseen or foreseeable at the time this promotion occurs, render the redemption or fulfilment of some or all of the prize delayed, hindered, adversely affected, impracticable, or impossible, Universal in its sole and absolute discretion, reserves the right to evaluate and make modifications to the redemption and fulfilment processes and timelines for any prize or portion of the prize that Universal is responsible for, which may include but is not limited to providing additional time for redemption and/ or fulfilment. Should the prize become unavailable, experiences and items of a similar nature and value may be offered.
The prize may not be transferred or resold. Sponsor is not responsible for any flight or transportation delay/cancellation, and not liable for any expenses incurred because of any delay/cancellation.
No substitution of prize offered, no transfer of prize to a third party is permitted and prize may not be redeemed for cash value, except by Sponsor, who reserves the right in its sole discretion to substitute prize for a prize of comparable or greater value. Taxes are the responsibility of Winner. An IRS form 1099 will be filed in the name of Winner.
WINNER NOTIFICATION & VERIFICATION: POTENTIAL WINNER IS SUBJECT TO VERIFICATION BY SPONSOR. AN ENTRANT IS NOT A WINNER UNTIL HE/SHE HAVE BEEN VERIFIED AND NOTIFIED THAT THE VERIFICATION IS COMPLETE.
The potential winner will be notified by email within three (3) business days after the random drawing date and may be required to complete and return a) an Affidavit of Eligibility/Liability/Publicity Release, and b) an IRS W-9 Form (collectively referred to as “Prize Documents”) to the Sponsor within three (3) business days after the date of notification. At the sole discretion of the Sponsor, disqualification, forfeiture and the selection of an alternate winner may result for any of the following non-exclusive reasons: [1] a potential winner’s failure to respond to email notification within three (3) business days after the email notification is sent; [2] the return of an email notification or message as undeliverable; [3] the receipt of any other notice from Sponsor or an undeliverable prize; [4] the potential winner’s failure to provide Sponsor with satisfactory proof of age, identity and residency; [5] potential winner’s failure to submit the required Prize Documents within three (3) business days after notification; [6] potential winner’s failure to claim prize within three (3) business days after he or she is confirmed as the winner; or [7] any other non-compliance with these Rules. In the event of prize forfeiture, the Sponsor may, in its sole discretion, award or not award the forfeited prize to an alternate winner. Sponsor shall have no liability if notification is lost, intercepted, or not received for any reason. Sponsor is not responsible for any change in winner’s email account or other contact information after entering the Sweepstakes. A background check may be conducted on the Winner and their Guests, and failure to cooperate with the background check may result in forfeiture of the prize at Sponsor’s sole discretion. At Sponsor’s sole discretion, Winner and/or Guests may be disqualified if charged with or convicted of a felony or misdemeanor, or if the results of the background check reveals that such person’s conduct has been inconsistent with generally accepted norms and/or might diminish the public reputation of the Sponsor or if Winner or Guests are not eligible based on the eligibility requirements set forth above. Except where prohibited by law, entry and acceptance of prize constitute permission for Sponsor and its agents and licensees to use Winner’s name, prize won, hometown, likeness, video tape, photographs, and statements for purposes of advertising, promotion and publicity (including online posting) in any and all media now or hereafter known throughout the world in perpetuity, without additional compensation, notification or permission.
CONSENT AND RELEASE: To the fullest extent possible by law, Entrants and any coordinating entities, on behalf of themselves and on behalf of their respective heirs, executors, administrators, legal representatives, successors and assigns (“Releasing Parties”), hereby release, defend and hold harmless the Sweepstakes Entities and their associated companies and directors, subsidiaries, affiliated or successor companies and their respective owners, members, shareholders, officers, directors, partners, equity holders, agents, representatives, employees and all others associated with the development and execution of this Sweepstakes (collectively, “Releasees”) from and against any and all claims, actions, causes of action, suits, liabilities, debts, dues, sums of money, accounts, reckonings, bonds, bills, specialties, covenants, contracts, controversies, agreements, promises, variances, trespasses, lost profits, indirect or direct damages, consequential damages, incidental damages, punitive or exemplary damages, judgments, extent, executions, claims and demands whatsoever, in law, admiralty or equity, whether known or unknown, foreseen or unforeseen, against Releasees which any one or more of the Releasing Parties ever had, now have, or hereafter can, shall or may have, which in any way arise out of or result from Entrant’s participation in the Sweepstakes or acceptance of prize (if determined the winner).
By entering this Sweepstakes, you as an Entrant, agree, represent and warrant that: [1] you will be bound by the Rules and the Sponsor’s decisions, which shall be final in all respects; [2] in the event viruses, bugs, unauthorized human intervention, or regulations of any governmental or supra-national authority, war, national emergency, accident, fire, riot, strikes, lock-outs, industrial disputes, acts of terrorism or other matters beyond the Sponsor’s reasonable control, corrupt, prevent or impair the administration, security, fairness of the Sweepstakes or the Sweepstakes cannot be conducted as originally planned, except where prohibited by law, Sponsor has the right, in its sole discretion, to modify the Rules or to cancel, terminate or suspend the Sweepstakes; and in such event, to select Winner by such method as Sponsor, in its sole discretion, shall consider equitable; [3] the Releasees are not responsible for typographical or other errors in the offer or administration of the Sweepstakes, including but not limited to: errors in the advertising, Rules, selection or announcement of Winner; [4] the Releasees are not responsible for any inability of Winner to accept prize (or any portion thereof) for any reason; [5] the Sponsor has the right, in its sole discretion, to disqualify any individual it suspects of any of the following: (a) tampering or attempting to tamper with the entry process or the operation of the Sweepstakes; (b) violating the Rules and/or the Sponsor’s Privacy Policy; or (c) violating any other terms, conditions of use and/or general rules or guidelines of the Sweepstakes; and [6] any attempt by any individual to deliberately undermine the legitimate operation of the Sweepstakes is a violation of these Rules, as well as criminal and civil laws; and should Sponsor believe or become aware that such an attempt has been, is being, or will be made, it has the right to seek remedies and damages from any responsible individuals to the fullest extent permitted by law, including, without limitation, criminal prosecution.
By participating in this Sweepstakes, each Entrant expressively waives and relinquishes all rights and benefits afforded by California Civil Code 1542 and does so understanding and acknowledging the significance of this waiver. Section 1542 states as follows: “A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS THAT THE CREDITOR OR RELEASING PARTY DID NOT KNOW OR SUSPECT TO EXIST IN HIS OR HER FAVOR AT THE TIME OF EXECUTING THE RELEASE AND THAT, IF KNOWN, BY HIM OR HER, WOULD HAVE MATERIALLY AFFECTED HIS OR HER SETTLEMENT WITH THE DEBTOR OR THE RELEASED PARTIES.”
ARBITRATION: This Sweepstakes shall be governed by and interpreted under the laws of the State of North Carolina, U.S.A. (except with respect to disputes arising out of or relating to any person’s use of, or participation in, the UO Prize itself or USH Prize itself, which shall be governed by the terms in the “Prize Provider” section herein), without regard to its conflicts of laws provisions. Each Entrant hereby agrees that any and all disputes, claims, causes of action, or controversies (“Claims”) arising out of or in connection with this Sweepstakes or prize shall be resolved, upon the election by Entrant or Sponsor, by arbitration pursuant to this provision and the code of procedures of either the National Arbitration Forum (“NAF”) or the American Arbitration Association (“AAA”), as selected by Entrant. IF ARBITRATION IS CHOSEN BY ANY PARTY WITH RESPECT TO A CLAIM, NEITHER PARTY WILL HAVE THE RIGHT TO LITIGATE THAT CLAIM IN COURT OR HAVE A JURY TRIAL ON THAT CLAIM. FURTHER, NEITHER SPONSOR NOR ANY ENTRANT WILL HAVE THE RIGHT TO PARTICIPATE IN A REPRESENTATIVE CAPACITY ON BEHALF OF THE GENERAL PUBLIC OR OTHER PERSONS SIMILARLY SITUATED, OR AS A MEMBER OF ANY CLASS OF CLAIMANTS PERTAINING TO ANY CLAIM SUBJECT TO ARBITRATION. EXCEPT AS SET FORTH BELOW, THE ARBITRATOR’S DECISION WILL BE FINAL AND BINDING. NOTE THAT OTHER RIGHTS THAT AN ENTRANT WOULD HAVE IF ENTRANT WENT TO COURT ALSO MAY NOT BE AVAILABLE IN ARBITRATION. ANY CLAIMS, JUDGMENTS AND/OR AWARDS SHALL BE LIMITED TO ACTUAL OUT-OF-POCKET COSTS ASSOCIATED WITH ENTERING THIS SWEEPSTAKES. EACH ENTRANT HEREBY WAIVES ANY RIGHTS OR CLAIMS TO ATTORNEY’S FEES, INDIRECT, SPECIAL, PUNITIVE, INCIDENTAL OR CONSEQUENTIAL DAMAGES OF ENTRANT, WHETHER FORESEEABLE OR NOT AND WHETHER BASED ON NEGLIGENCE OR OTHERWISE. The arbitrator’s authority to resolve Claims is limited to Claims between Sponsor and any Entrant alone, and the arbitrator’s authority to make awards is limited to awards to Sponsor and Entrant alone. Furthermore, claims brought by either party against the other may not be joined or consolidated in arbitration with Claims brought by or against any third party, unless agreed to in writing by all parties. No arbitration award or decision will have any preclusive effect as to issues or claims in any dispute with anyone who is not a named party to the arbitration. Notwithstanding any other provision in these Rules and without waiving either party’s right to appeal such a decision, should any portion of this provision be deemed invalid or unenforceable, then the entire provision (other than this sentence) shall not apply.
PRIVACY: Potential winners’ information may be provided to promotional partners for prize fulfillment purposes. Any personally identifiable information collected from a participant in this Sweepstakes will be subject to Sponsor’s privacy policy which is available at https://www.krispykreme.com/legal/privacy-policy.

PRIZE PROVIDERS: Universal City Development Partners, Ltd. d/b/a Universal Orlando Resort (“Universal Orlando”) and Universal City Studios, LLC d/b/a Universal Studios Hollywood (“Universal Studios Hollywood”) (collectively referred to herein as “Universal”) are prize providers only in this promotion; are not sponsors of this promotion; and are not responsible for the administration of the promotion, the collection of the entries or the conduct of the draws. All disputes arising out of or relating to any person’s use of, or participation in, the UO Prize itself shall be resolved by applying the laws of Florida, without regard to conflict of laws provisions therein, and shall be solely and exclusively brought in state or federal courts within Orange County, Florida; and all disputes arising out of or relating to any person’s use of, or participation in, the USH Prize itself shall be resolved by applying the laws of California, without regard to conflict of laws provision therein, and shall be solely and exclusively brought in state or federal courts within California. Such claims shall be resolved individually, without resort to any form of class action, and all such claims shall be limited to actual out-of-pocket costs incurred, but in no event to include attorneys’ fees.
SEVERABILITY: The invalidity or unenforceability of any provision of these Rules shall not affect the validity or enforceability of any other provision. In the event any provision is determined to be invalid or otherwise unenforceable or illegal, these Rules shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or illegal provision were not contained herein.
