ARM is never open because their license forbids licensing out core IP using their ISA. So you could possibly convince Intel to license an E-core to be integrated into your custom chip, but Qualcomm is not allowed to license you a Kryo core to integrate into your custom chip.

x86 patents are to expire soon, I bet many companies will start manufacturing them because basically all software is x86 based.
