Is Bluesky 'obeying in advance'?

The Jesse Singal controversy took an interesting turn this weekend. Two articles one in Advocate (advocate.com/business/bluesky-) and another in TechCrunch (techcrunch.com/2024/12/13/blue) suggest the refusal to ban the anti-trans podcaster may be due to fear of regulatory action.

"...this decision could put the social media company at risk with the FCC since Brendan Carr, Trump’s pick... plans to go after tech companies he thinks are censoring right-wing voices." 👀

Advocate.com · Controversy brews on Bluesky over anti-trans journalistBy Ariel Messman-Rucker

What is very instructive is to contrast this case with another social media thing that happened this weekend. On Saturday the Russian gov sent @stux an abuse request that one of the accounts on mstdn.social be removed.

Stux immediately published the notice (mstdn.social/@stux/11365246164) making very very clear his intent to defy it. When his hosting company backed him up, he published that (mstdn.social/@stux/11366257336). And now he is trolling the Russians (mstdn.social/@stux/11366384855).

A profile in courage!

We have received an abuse report from 398- fz@rkn.gov.ru for your IP address 49.13.236.103.
Mastodon 🐘stux⚡ (@stux@mstdn.social)Attached: 2 images Holy shit. The Russian gov send in an abuse request for the @Bellingcat to be removed from mstdn.social :amaze: I am not gonna comply, and have replied to Hetzner No way I'm gonna let the evils of the gremlin dictate stuff on anything I host UPDATE: Hetzner ignores their requests and we're in the clear: https://mstdn.social/@stux/113662573364116275

You might say; yes but mstdn.social is based in the Netherlands with servers in Europe, while is a US company with its servers in the the US. It's not the same thing. And, the answer is that you are exactly right.

On the day after the election @Gargron posted (mastodon.social/@Gargron/11343): "I think it's going to be more important than ever that and the are not centrally operated out of the US unlike almost every other social media platform out there."

Case in point.

MastodonEugen Rochko (@Gargron@mastodon.social)I think it's going to be more important than ever that #Mastodon and the #fediverse are not centrally operated out of the US unlike almost every other social media platform out there.

@mastodonmigration I know the plan is to effectively 'decentralise' at some point but at the moment where are their servers!? How would a 'ban' work!? Can the US block access? How would that work, legislate for ISPs to not allow access!?

@rainercade

Presumably the FCC could slap fines on them, and/or haul them into court. The US Government has all sorts of powers of enforcement.

@mastodonmigration They would have to do it at the ISP level I guess!? I suppose Mastodon would be fairly 'safe' due to the high number of servers! Bluesky will find itself in the cross hairs no matter what as Musk will be after them! So they should give them the two fingers and setup the 'safe' community they promised!?

@rainercade

That is precisely the issue. This seems to be shaping up as a test of the courage of their convictions.

Of course, it is not a simple matter. Defense of lawsuits and or regulatory action could be very expensive. They do not have deep pockets. Such a prospect would be terrifying, which is indeed the point.

@mastodonmigration interesting problem this, I’ve seen people saying let’s just block the trolls but that isn’t easy en masse .. it’s a problem ‘any’ successful network will face…

@mastodonmigration I do think money will be the issue.. Just as the orange clown now will go after news media and anyone who he does not like..it will be very costly to fight back..and I’m starting to think many judges are siding with the billionaire gang..😡😒

@kcsorenby

Yes. Think this is spot on. Every CEO dreads a process server at the door. Legal expenses could quickly suck up all their VC money.

@kcsorenby
It'll be entertaining at least to see Elon, who was furious about Brazil blocking X and the EU threatening to do so, apply his "free speech" to Bluesky. 🙄
@mastodonmigration

@rainercade

There's been a lengthy discussion among knowledgeable folks on either side of the Bluesky/AT Protocol vs. Mastodon/ActivityPub divide.

The Mastodon/Fediverse side seems persuasive that a distributed Bsky is likely not doable. The resources required to set just 1 more full stack of existing Bluesky functionality/code can be prohibitive.

This toot is pretty far down in the most recent thread, but it's the one I bookmarked for reference:

@mastodonmigration

social.coopChristine Lemmer-Webber (@cwebber@social.coop)What I DO know is that it means that the entire structure of analyzing decentralization in Mark's paper and Bryan's blogpost thus, in practice, surround a term that is weak because it was FUNDAMENTALLY describing a centralized system, so it could criticize it The loss of context here is BRUTAL

@joeinwynnewood @rainercade

The next post in the thread is brutal... "decentralization-washing", followed by the observation that it wasn't intentional. Whew.

@mastodonmigration @joeinwynnewood @rainercade This entire 🧵 is eye-opening and bananas and scary af. SO glad that:

1. I’m here on #Mastodon
2. I reclaimed a bunch of my time and sanity when I nuked my Xitter account
3. I decided not to create a new account on Bluesky
4. I wound up on Mstsn.social … thanks for the reminder @mastodonmigration that I need to donate a some bucks to @stux!

@joeinwynnewood @mastodonmigration thanks for sharing!! very interesting!

@mastodonmigration @Gargron it would also be useful to compare if, say, an admin did have to remove a user because of their legal situation, whether that user could return on another server, and how easily. Presumably they could _do_ it, although they wouldn't have access to the migration tools to redirect their old account

@mastodonmigration @Gargron if only mastodon would be user friendly instead of the hoop jumping shitshow in between login prompts, search prompts and non working 3rd party instance content. :/

@mastodonmigration @stux Stronger against the Russians than Zuckerberg. That’s interesting

@mastodonmigration @stux So happy to have stux as my admin and glad to support his efforts each month. It matters. TY so much, stux!

@WizardBear

You are indeed fortunate to be on such a great instance. But, you don't need to be a member of mstdn.social to value of efforts of independent Mastodon server administrators. Here is @stux Ko-Fi page: ko-fi.com/mstdn, if you want to show some appreciation.

Support @stux On Ko-fi. Ko-fi lets you support the people and causes you love with small donations

@mastodonmigration @WizardBear @stux I just dropped a few euros in the support of @stux a principled and committed Administrator.

@mastodonmigration @stux I support stux via PayPal. I greatly appreciate his work.

@mastodonmigration @stux I wonder what would Hetzner do when they receive a request from a right wing Western government? Or from any Western government asking to ban a pro-Palestine activist?

@mastodonmigration The owner will be a greedy asshole just like the rest of them.

@mastodonmigration That Advocate link goes to a 404 error, can you relink it?

@mastodonmigration calling a bigotted hatespeaker an "anti-trans activist" is a bold move...

  • that's thin ice, m8...

@kkarhan

Hmmm... see your point. 'Activist' can have a positive connotation, and that is certainly not the intention. What's a better word than 'activist'?

Edited to 'podcaster' for now to align with the article.

Thanks for the comment.

@mastodonmigration It's almost like BS isn't actually decentralized and immune to these threats they claim to be... 🤔

@mastodonmigration It would have been "aspirational" if the design admitted a path to becoming that. Instead it was just fraudulent.

@dalias

Not gonna argue. Never really made much sense.

Now whether some of them believed their own PR? Can't really say.

@joeinwynnewood @mastodonmigration @Devilstower In a fair and just universe, someone would spike his ketamine, and he falls into a drug induced coma;
(Happy seasonal ending:) where he has his own Dickensian experience, comes back, renounces the right wing, unionizes his companies before turning them into employee owned businesses, gives each of his 300 children a million dollars to apologize, and disperses his money amongst the poor of the world, with special attention to the people his people used to get rich in the emerald mines. He retires, poor but fulfilled to some island paradise.

(Alternate ending) the end. 🤷🏻‍♀️

@MissConstrue @mastodonmigration @Devilstower

May I suggest one edit to the end of the fantasy story?

Uses his $billions to elect a federal government that restores Eisenhower era marginal tax rates on the wealthy and corporations, overturns Citizens United, restores the Voting Rights Act & Roe, and makes DC a state.

@mastodonmigration Very important to protect freedom of stochastic terrorism being as how it's written into the Constitution or the Amendments somewhere and everything.

@mastodonmigration so I thought the point of a “decentralized” network was so you can host your own instance that no one can silence and give everyone a voice that can’t be censored. If you don’t like what is said, block them. It sounds like #bluesky users want people punished by silencing them instead. If Bluesky bans this user than they are no better than a #twitter hypocrisy
