サムネイルを変更することが製品を再度オンラインに戻すためのコミットメントであるという情報をMio3ioから受け取っていませんでした。11月の時点ではサムネイルに問題はないとされていました。この日は何が許可されていて何が許可されていないかの明確なガイドラインを受け取りました。これは私の弁護士との交渉によって決められました。
その後、製品をオンラインに戻すための交渉に集中しました。これはその一環です。BOOTHは、Mio3ioからの直接の言葉で問題ないという書面確認が欲しかったためです。なぜかBOOTHは私の弁護士の要請を無視し、Mio3ioの許可が製品をオンラインに戻すために必要であると要求しました。
Mio3ioは2月23日にVN3ライセンスを変更し、我々の製品が彼女のライセンスに違反するようにしました。その理由は不明です。彼女がサムネイルを変更したかったのであれば、事前に私と話し合うべきでした。
約80通のメールの中で、サムネイルを変更することが一度だけ言及され、何のコミットメントもされませんでした。
I want to clarify that Jarnefeldt cannot set the product to public without Mio3io's permission. The page is admin locked. Mio3io gave permission for the product to be allowed back online as stated by BOOTH's statement.
We did not receive information from mio3io regarding changing the thumbnail that was a commitment to making the product come back online. It was assumed in November there was no issue with the thumbnail. We received clear guidelines of what is and what is not allowed on this date. This was negotiated by my lawyer.
We then focused on negotiating on bring the product online. The agreement is part of this. This is because BOOTH wanted written confirmation there is no problem directly from Mio3io written in words. For some reason BOOTH ignored my lawyers request requiring
Mio3io's permission to allow the product online.
Mio3io then changed the VN3 licence on Feburary 23rd to directly make our product against her licence. The reason for this is unknown. If she wanted to change the thumbnail, she should have discussed this with me previously.
In around 80 emails, changing the thumbnail was mentioned once and no commitments were made.
