Amazon Defeats Suit Over Guaranteed Delivery After Package Delay

A consumer alleging Amazon.com Services LLC violated its duty to deliver his tea order within the time window specified on the checkout page failed to show a breach of contract, a federal judge said.

Tonny Storey paid extra for the fastest delivery option for his tea, but the delayed package hadn’t qualified for “Guaranteed Delivery” based on Amazon’s terms, Judge Kymberly K. Evanson of the US District Court for the Western District of Washington said June 7 in dismissing the proposed class action.
