Bagley was 20 years old and the victim was 16 years old when the alleged abuse occurred.

A bench trial for a Benton County man accused of sodomizing a minor girl is delayed by one month.

Hunter Bagley, 25, of Warsaw, is charged with first-degree sodomy or attempted sodomy, second-degree sodomy, and first-degree sexual misconduct.  He’d been scheduled for a bench trial to begin Wednesday but he failed to appear.  A new bench trial has been scheduled for October 24.

Bagley was arrested in April after the victim came forward, telling police that Bagley had sexually assaulted her during the summer of 2019.  The victim said she was convinced by coworkers to stay silent, but had recently been encouraged by friends to speak up.

The victim and her cousin had met Bagley on Drake Harbor Trail.  They had planned to go to Bagley’s house to watch television, but the victim’s cousin decided not to go.  The victim says when they left the trail, Bagley drove her to his old apartment in Sedalia, where he allegedly forced her to perform a sex act, then returned her to Warsaw. 

Bagley claims the encounter was consensual.
