You CAN use Planning in Principle for Self and Custom Build. Our PiP appeal for 4 self and custom dwellings has been upheld. A number of inspector's have not attached weight to the provision of Self and Custom Build housing in PiP applications under the frankly obviously mistaken belief that the provision of Self and Custom Build housing could not be secured at the Technical Details Consent Stage. Stratford on Avon District Council were about to approve our application for 4 self and custom build dwellings. On the eve of writing up the delegated approval, they received two appeal decisions (from the same inspector) who argued that PiPs cannot secure self and custom build. The appellants in both cases did not put in evidence on the point (why would they). So this was a bit of a test case for the LPA. A huge thanks to Leanne Buckley-Thomson for her 'compelling legal advice' and a big thanks to the inspector for repeating the obvious, but seemingly overlooked point that Parliament, in the 2015 Self and Custom Build Act, says PiPs can be used for Self and Custom Build (see Section 2A(5) of the act which defines 'development permission' as both planning permission or permission in principle). I am shouting about this on Linkedin as this decision should be of great help to SME's out there struggling with the information required for a planing application even for small scheme. For the planning geeks out there - "I'm your Man" is not relevant - you cannot build anything with a PiP. I must not forget the Lone Star Land team that help deliver this positive result Andy Wilkins Richard Burke Jack Casey and Callum Fisk (who is off travelling around the world so he won't care). Another successful project delivered by CBRE Business Transitions MAC... Industry: TMT Sector Location: Warrington Project Overview: CBRE BTMAC Team was approached to assist with the closure of a data centre at the Warrington site. Our team, BTMAC, was requested to provide support for this project. The client coordinated the power down process, and we were responsible for removing all IT equipment, including the contents of the Comms cabinets. To ensure secure disposal, we separated all data-bearing kits by type and moved them to a designated secure location on site. The disposal of these assets was carefully documented with a detailed audit trail. In addition to the IT equipment, we also decommissioned all furniture on site, including the Comms room cabinets, kitchen items, and trolleys cages. As part of our commitment to sustainability, we conducted a survey and sent some items for recycling, according to the customer's preferences.. Overall, our team successfully managed the decommissioning process, providing secure disposal and recycling services with a comprehensive audit trail. Our Goal: Our goal is to prevent office furniture, fixtures and electrical equipment from ending up in landfill, for our clients across the UK and EMEA. By keeping these items and materials in use we are promoting sustainability in the corporate world, and contributing to global challenges such as climate change, biodiversity loss, waste and pollution. “Our approach to Clearance projects will always have the Circular Economy at its core” The carbon saving achieved by reusing items in this project comes to 0.6 tonnes of CO2e. Don’t start work on site unless you’ve done this. So you want to work under your own terms and conditions. The problem is, your client wants you to work under their terms and conditions. This needs to be resolved before you start work. What happens when a client asks you to price a tender? They may provide details about the contract they want to use. But, there’s a good chance they don’t say anything. So you price the work based on the information you have. You send over your quote. And you attach your standard terms and conditions. The client is happy with your price. They send over the order and they attach their own terms and conditions. They want you to start straight away. So you mobilise and start work on site. But then you realise you don’t like their terms. You don’t like the payment terms, the level of retention. But it might be too late. In this example, the client has had the last shot. This means that the works have started. And there’s a good chance that you are working to the last terms and conditions issued. This is always something you need to resolve before starting work. At the very least, you should write to your client, letting them know you don’t agree with their terms and conditions. But it’s far easier to agree everything before you start work.

Providence Building Services Limited v Hexagon Housing Association Limited [2024] EWCA Civ 962 Very interesting recent decision by the Court of Appeal to overturn the previous TCC decision regarding termination using clause 8.9 of a JCT D&B 2016 contract. Employers need to be wary of paying contractors late, as effectively this ruling means the employer is on thin ice if they pay an interim certificate late even though they may remedy by paying within the agreed rectification period. Should they not pay on time again, the contractor can terminate at that point. This happened on a project where I was acting as CA. Ironically, the Employer paid late on many occasions over various payment cycles. However, as the relationship between client/contractor was initially very positive, the contractor elected not to serve any notice of specified default. It was only when the relationship soured and the contractor wanted out that they served notice on a further late payment. As the contractor knew it was likely the Employer would pay late again on the next payment cycle, this gave them their exit and they terminated the contract for a repeat of a specified default. The moral of the story here for any employer is do not give a contractor any bullets to load into their gun. It gives them the option to pull the trigger if the opportunity arises. Pay on time to avoid the risk of a contractor terminating should a payment be late again.

Hi all hope you are enjoying that time of day again . Count down to some much needed time of . Snap I could do with a holiday but unfortunately I can’t have everything I want so for now I’ll make do with some much needed family time and self awareness time . Not gonna lie had a few rough days living life on life’s terms , days where I’d of pressed the Fuck it button and got pissed . Today I’m able to face it , not easy but by using my programme to the best of my ability I never have to use again . Todays reading is Up or Down Precisely how I’ve been feeling . I need to chip away at recovery even it I’m having a shitter of a day , even when the world is a my feet and everything is rosy . I have a number of photos on my phone which I keep as a small reminder of where I had been and where I never want to go again . So today I say God grant me the serenity to accept the things I cannot change , The courage to change the thing that I can And the wisdom to know the difference. August 16 Up or down This is our road to spiritual growth. We change every day.... This growth is not the result of wishing but of action and prayer. Basic Text, p. 37 = Our spiritual condition is never static; if its not growing, its decaying. If we stand still, our spiritual progress will lose its upward momentum. Gradually, our growth will slow, then halt, then reverse itself. Our tolerance will wear thin; our willingness to serve others will wane; our minds will narrow and close. Before long, well be right back where we started: in conflict with everyone and everything around us, unable to bear even ourselves. Our only option is to actively participate in our program of spiritual growth. We pray, seeking knowledge greater than our own from a Power greater than ourselves. We open our minds and keep them open, becoming teachable and taking advantage of what others have to share with us. We demonstrate our willingness to try new ideas and new ways of doing things, experiencing life in a whole new way. Our spiritual progress picks up speed and momentum, driven by the Higher Power we are coming to understand better each day. Up or downits one or the other, with very little in between, where spiritual growth is concerned. Recovery is not fueled by wishing and dreaming, weve discovered, but by prayer and action. = Just for today: The only constant in my spiritual condition is change. I cannot rely on yesterdays program. Today, I seek new spiritual growth through prayer and action.
