I was doing a review of the Wayfarer!,
I'm telling you because I've found the following to be Wayspots, even though they are not accessible by foot.
And I have found that the one corresponding to K12 is also Wayspots.

The fountain in the middle of "Lake Holler(Holler See)" is the Wayspot.
As you can see, it is not accessible by foot.
Furthermore, there is no pin on the fountain and the Wayspot is set at a point on the shore.

In the immediate vicinity is the Bürgerinitiative Spielkreis Herbststraße kindergarten.
The park is slightly to the north along a narrow road between the two kindergartens, surrounded by houses in a U-shape.
However, the Wayspot is located where the Map shows the "kindergarten".
Don't you think that's a bit inconsiderate?

The Wayspot is a statue of a water bird in a pond, but as you can see from the Google Map, it is not accessible by foot.
And the location is pinned to the shore, 20 metres away.

I have to comment on a few things here:
First of all a general thing: you found here 2 daycares with an "e.V." behind it - be very careful, if you encounter something like that. "e.V." stands for "eingetragener Verein", what translates to "official club". So although there might be a kindergarten/school marker, that doesnt mean, that it is a daycare. Its also possible, that it is an open clubhouse with leisure facilities for children, maybe with social workers. So such e.V.'s could be projects, that are way around worthy to have a proxy wayspot ;)
But in fact you were accidentally right in both cases, where you encountered such e.V.'s, but nethertheless we need to talk about both in detail:
(7) The website you've posted is a page, that lists daycares. The entry of this one has no useful information there. The real website of this project is http://www.hort-und-spiel.de/
There you can read, that this e.V. started as a project, that had the aim to create playgrounds for children, then created that kind of clubhouse, and finally they added also an official daycare within their clubhouse, but with very few slots, only for 16 children. So they have an official K12-daycare, but it's very small, only a small part of the building is the daycare. So it would be very hard nitpicking here, if this is alread enough to remove that wayspot. Further the house has to be public accessible because of all the other aspects of that club, that still uses this house. Since the wayspot is a memorial plaque it has no direct connection to that daycare. So finally this should be a case, where I would recommend Niantic to judge according to in dubio pro reo as long as they don't have further information from the original submission, that might help here.
(2) You are here also right, that this "e.V." is an official K12-daycare. But plot twist: their website has the adress Herbststraße 102-104. That means, that the daycare occupies parts of these three houses:
So the google marker is simply placed between the three houses ....
The way between them is public accessible according to different maps. The sign of the wayspots picture mentions also the responsible authority: you can find the word "Jugendhilfe" (literally: youth aid) and the adress of their local headquarter in the bottom left corner. So that sign hints, that it's an official and public accessible playground there in the inner courtyard.
Nethertheless the sign is in fact a bit strange, but it fits that situation here very well: Think about parents with their childs, that see a daycare to their left, a daycare to their right, and between them a playground behind a fence gate. So they might be confused about, whether they are allowed to access that playground, or not. So that sign simply says: "Yes, you are allowed to" xD
Miscelleaneous other comments:
(6) In the portals picture you can spot playground equipment, in the background a fence and behind that fence again structures, that look like playground equipment. According to the map the building there is also divided:
There is the church in the north western end, then a part, that is for community activities of that church, and then the part, that is the church-owned K12-daycare. This kind of buildings for the churches community often have playground equipment in their surrounding area, so it is not unusual, that there might be also playground equipment outside the daycare right next to it.
Since streetview isn't a thin in Germany this is, how you would have to think about it. Last but not least:
Please be in general a bit careful, if you encounter wayspots, that might be on school ground, but somehow away from the main school building. Most German schools have a fence, but they arent as secured as for example American schools. Most schools are owned by public instances - the owner can be the town/parish, the county or the federal state. That means, that for example the gyms aren't exclusive for the school and they might have double uses.
My hometown (together with the incorporated villages 3500 inhabitants) has a primary school. Next to the school is the schoolyard with tartan track and so on, and then there is the gym. From satellite view it looks like schoolground, but it isnt. The gyms main entrance is at the other side; the school uses only the back door. So this gym is used by the school until 2 pm, and after that it is used by the local sport clubs, because it is the only gym of the town, and the town is the owner. And since it is in general the biggest hallroom of the town, it is often for weekend exhibitions (for example for poultry breeders or pedigree cats), as polling place, place for election campaign speeches, or as place for the town council, if they have a lot of invited guests (or Corona caused spacing rules).
So please be careful and don't let your fingers be to fast at the school-rejection-button in cases like this one ;)
