The 52-year-old resident of Nagoya has become the first person arrested in Japan for illegally uploading video game gameplay videos to YouTube. The charges stem from a trio of gameplay videos of "Steins;Gate: My Darling's Embrace," an entry in the franchise which was initially released in 2013 and most recently ported to the Nintendo Switch, Sony's PlayStation 4, and Windows in 2019. The videos, which were monetized and collecting ad revenue, contained the game's ending.

I mean publishers could theoretically be as harsh as hollywood and only allow a few snippets with commentary or something like that. At the end of the day it's copyrighted material.

But gaming always operated in a grey-zone as most publishers accept that gaming videos work as a kind of advertisement for their game.

So yeah it's shitty but legally probably 100% in their right.

I'm all for fair use (which from what I understand isn't really a thing in Japan) but if it's a visual novel playthough with no commentary then that's practically market substitute (as pointed out in the article) so I don't think even the most open minded company would be cool with it.

Not sure how much the guy uploaded though. They just mentioned a trio of gameplay videos that contained the game's ending.

VNs aren't that simple. There are a ton of gameplay elements which affect a playthrough in VNs so by only uploading a single version of a playthrough even isn't uploading everything what a VN has to offer.

They were serious when they said don’t upload footage after a certain point. Remember all those silly ALTUS warnings we get when a new SMT drops? I guess this is the kinda action they meant?

Also the dude uploaded stuff outside gaming it seems. A group already got clapped for this for “explaining the plot of movies” basically. But also they play the movie or major scenes fast forwarded while talking about it so… kinda see where the issue is.

Still… this is silly. This is however what a lot of legal expert have been saying, technically these companies can start going after these videos, but would they be willing to take the public perception hit?

They had no qualms about trying to make an example out of that guy and permanently take 30% of his money for the rest of his life so as far as I'm concerned they are just as bad Kadokawa here.

It's very interesting that more often than not every time you hear about these outlandish cases regarding video games and civilians it always seems to be Japanese companies specially Nintendo.

I can't recall in recent memory any outlandish behavior like this from Sony or Microsoft.

I don't know the legal details, but there are literally ads on TV about how the above is illegal, ending with one of the characters saying "you'll get caught".

KADOKAWA owns the rights to the Steins;Gate anime not game.
He also illegally uploaded anime and fast movies.

From the article it seems he uploaded just clips of it to talk about those:

So similar to western anime reviewers or people summarizing those anime or single episodes.

Guys, he's arrested, waiting for trial, not sentenced to jail time. Going to prison for this is crazy, but brought to court over this? I can understand.

The vast majority of traditional VNs really are that simple. The steins gate games have no gameplay beyond text advancing and a handful (by which I mean, something like 10 in a twenty hour game) of dialogue selection boxes whatsoever. Most VN games don't have the gameplay of a Danganronpa or Professor Layton, or even the logic of a ace attorney game. They're digital story books, essentially.

Steins gate really isn't simple lol. Depending on the actions you take like going to some other place or doing some action, it can change endings and paths in that gameplay.

In Japan you're absolutely screwed, in the rest of the world you're most likely screwed if someone pursues you like this depending on what exactly the videos are but there's no legal precedent so it's technically unknown.

There's no chance of this happening in the USA. Japanese copyright laws are absolutely archaic compared to other countries. There's no legal concept of fair-use or transformative work/parody or any of the defenses American streamers might use (though they do have some leniency for education, but even that is much more strict than most countries). There are constant TV spots reminding people about how things we do every day can easily lead to us getting arrested if the copyright holder chooses to press the issue. The entirety of the Japanese-based Twitch/gaming YouTube community would cease to exist if they strictly applied the law. This guy just flew too close to the sun.

Fair use (probably) isn't going to help in US either, VNs are much closer to movies/comics than typical games.
No transformative use, use is commercial and whole work is copied and it replaces original product as your video contains all content game has.
Similar to uploading whole comic book.

Similarly cutting some scenes out of movie or tv episode is (probably) not fair use, when intend is to replace original product and monetize it for yourself instead of original author.
