If memory serves, the standard for criminal manslaughter is usually "depraved indifference to human life" resulting in someone's death.

Before he really started to try to start a civil war, Trump still viewed America as 2 sides in a war, where he would be happy to see the other side hurt. Most Americans draw a line with political disagreement far before that. Trump doesn’t care if people on the other side die.

You may be overthinking it: no evidence that Trump cares about GOP supporters dying either. He seems to actively encourage them getting exposed to the pandemic. Actually, there is evidence Trump cares about Russians dying: that may be the only ‘side’ that Trump is on.

The idea that a policy decision was based in whole or in part on the belief that it would be mostly residents of "blue" states who'd die is the most explosive revelation since the pandemic began. If that can be nailed down it is damning beyond anything else that has occurred.
