Handling of Merchant Information in Merchant Business
Based on the Act on the Protection of Personal Information and the Installment Sales Act etc., JCB will collect and handle the information (described in 1 below) of (i) a corporation, individual and organization which applied for admission to execute a merchant agreement with JCB (collectively “Merchant Applicant”), (ii) a corporation, individual and organization which executed a merchant agreement with JCB (collectively “Merchant”) and (iii) their representatives (Merchant Applicant, Merchant, and their representatives are collectively referred to as “Merchant, etc.”, and the information of Merchant, etc. are collectively referred to as “Merchant Information”) as follows. Unless otherwise defined in this policy, all capitalized terms used herein shall have the same meaning as set forth in the Terms and Conditions for JCB Card Merchant and the Terms and Conditions for JCB Card Absent Transaction Merchant (for the purpose of this policy, collectively “Terms and Conditions for Merchant”).
1. Information Collected and Used by JCB

Information notified by Merchant, etc. at the time of application for admission to execute merchant agreements or at the time of changing information, including, without limitation, name, location, postcode and telephone number, e-mail address, bank account number and corporate registration number of Merchant, etc., and name, address, date of birth and telephone number of their representatives
- 2.
Information relating to transactions between Merchant, etc. and JCB, including, without limitation, date of application, date of admission, identification number of Terminals, kinds of goods, sales method and business category
- 3.
Information relating to circumstances on acceptance of Cards by Merchant, including, without limitation, information on Authorization Application
- 4.
Card usage history of Merchant, etc. collected by JCB (this refers to the history of purchasing goods and services and other transactions using Cards as a holder of the Cards by Merchant, etc.)
- 5.
Matters described in confirmation documents, such as operating license, of Merchant, etc.
- 6.
Matters described or registered in documents or information issued by public organization, such as a corporate registration (toki-bo) and a residence certificate (jumin-hyo), collected lawfully and properly by JCB
- 7.
Information stated in telephone directories, residential maps, official gazettes, etc.
- 8.
In case of refusal of admission to become a Merchant or to add a settlement service, the fact of the refusal and its reason
- 9.
The fact that an investigation into the solicitation relating to a contract for a sale involving the intermediation of an individual credit purchase under Article 35-3-5 and 35-3-20 of Installment Sales Act was made, contents of the investigation and matters subject to the investigation
- 10.
The fact that an investigation under item (i)(a) or (iii) of Article 60 of Ordinance for Enforcement of the Installment Sales Act in accordance with the Installment Sales Act was made and matters subject to the investigation
- 11.
The fact that an individual credit purchase intermediary or a comprehensive credit purchase intermediary terminated or canceled a contract regarding intermediation of credit purchases, and related matters
- 12.
Content of complaint raised by a Cardmember to JCB or a Card Company, and information collected by JCB or a Card Company from the Cardmember or other related persons in connection with investigation made on the complaint
- 13.
Information published by a governmental authority, consumer organization, or the press (including information publishing a fact of violation of the Act on the Specified Commercial Transaction), and information collected by a Merchant Credit Information Agency (an organization whose business is to collect merchant information and provide them to participating members) or its participating members
- 14.
Contents of information provided from a detective agency to JCB or a merchant credit information agency, such as bankruptcy information or other information
2. Purpose of Use
- 1.
For review of application for admission to execute a merchant agreement between Merchant, etc. and JCB, transactional judgment (including, without limitation, post-admission administration), performance of obligation to investigate a Merchant and review of continuing transactions with the Merchant after the execution of the merchant agreement, and promotion of settlement services which the Merchant may handle and accept under the merchant agreement with JCB, including, without limitation, Cards, JCB gift cards, JCB PREMO, J-Debit, QUICPay, QUICPay +, iD, electronic money for public transportation, nanaco, Edy, WAON.

For business operated by JCB based on the Terms and Conditions for Merchant or other agreement ancillary to them
- 3.
For business advertisement for JCB, a Card Company and Merchant, etc., including, without limitation, sending advertisements
- 4.
For development of new products, new functions and new services, etc. in JCB’s credit card business and other business (described in the Articles of Incorporation of JCB)
3. Joint Use
JCB, JCB’s partner companies participating in the JCB Card transaction system (including Cooperative Brand Card Company) and Joint Use Companies (including JCB’s affiliates) may jointly use the collected information for the following purpose:

JCB will not provide Merchant information to any third party except in the following cases:

When providing the minimum necessary information to a service provider that has pledged to protect personal information to outsource operations performed under the Terms and Conditions for Merchant
- ・
When providing to a third party with the consent of Merchant, etc.
- ・
When receiving an inquiry based on the applicable laws and regulations from a public institution
- ・
When permitted by the Act on the Protection of Personal Information, the Installment Sales Act, or other related laws and regulations
5. Use and Registration of Participated Merchant Credit Information Agency
- 1.
For the purpose of review of application for admission to execute a merchant agreement, transactional judgment (including, without limitation, post-admission administration), performance of obligation to investigate a Merchant and review of continuing transactions with the Merchant after the execution of the merchant agreement, JCB may make an inquiry against the Merchant Credit Information Agency in which JCB participates as a registered member (“Participated Merchant Credit Information Agency”) and use the information regarding Merchant, etc. if it is registered.

The information relating to Merchant prescribed by the Participated Merchant Credit Agency below may be registered at the Participated Merchant Credit Information Agency (“Registered Merchant Information”), and may be available to registered members thereof for the purpose of review of application for admission to execute a merchant agreement, transactional judgment (including, without limitation, post-admission administration), performance of obligation to investigate a merchant and review of continuing transactions with the merchant after the execution of the merchant agreement.
- 3.
The Registered Merchant Information may be subject to joint use by registered members of the Participated Merchant Credit Information Agency for the purpose of review of application for admission to execute a merchant agreement, post-admission administration to eliminate illegal transactions and protect consumers, and for the purpose of disclosure, correction, and suspension to maintain the accuracy of Registered Merchant Information.

The name of the Participated Merchant Credit Information Agency, administrative officer for joint use, registered information, and scope of joint use shall be as follows:

Purpose of Joint Use | The purpose is to improve the accuracy of review of merchants at the time of execution of merchant agreement or thereafter, eliminate malicious merchants, strengthen security measures of merchants, and thereby to contribute to the sound development of credit transactions and the protection of consumers, by registering information on act lacking of user’s protection or suspecting of lack of user’s protection, information that is difficult to determine whether lacking of protection or suspecting of lack of protection, information on act that interferes or may interfere with the appropriate management of credit card numbers, etc., and by providing and sharing such information with member companies which participate in Merchant Information exchange system (“JDM Members”) under the merchant information exchange system operated as a business of Certified Installment Sales Association as stipulated in the Installment Sales Act. | Merchant Information possessed by the Merchant Credit Information Center will be used only for the purpose that members of Japan Credit Card Association conduct merchant review to eliminate illegal transactions and protect interests of consumers, perform post-execution merchant management, determine whether to continue merchant agreement, and correspond to request of disclosure, correction or suspension to use to maintain correctness of registered information; provided, however, that the above rule shall not apply if any of the followings:

(1) Fact and matter for the necessary investigation for handling complaints pertaining to merchants, etc. in comprehensive credit purchase intermediation transactions or individual credit purchase intermediation transactions (2) Fact and matter of the measures taken to prevent complaints pertaining to merchants, etc. and to deal with them in comprehensive credit purchase intermediation transactions (3) Fact and matter that a contract pertaining to the comprehensive credit purchase intermediation or individual credit purchase intermediation was terminated on the grounds that the business pertaining to the intermediation of comprehensive credit purchases or the intermediation of individual credit purchases lacked protection of the users, etc. (4) Information that is an objective fact regarding an act that unjustly damage JDM Members or user, etc., and that falls under, is suspected to fall under, or cannot be judged to fall under, an act that lacks protection of the users, etc. (5) Information that the users, etc. (including without limitation, a person who does not conclude a contract) offered to JDM Members, including, without limitation, information regarding an act that is judged to lack, or to be suspected to lack, the protection of the users, etc., and information that is difficult to determine whether such act was actually committed (6) Information collected by JDM Center on the fact and content (information that was disclosed as the violation of the Act on Specified Commercial Transactions, etc.), which were published by administrative organizations (7) Fact and matter for investigations necessary for the purpose of finding the causes or taking preventive measures, etc. in cases where an accident, such as a card number leakage, has occurred or is suspected to have occurred by the merchant in comprehensive credit purchase intermediation (8) Detail of illegal use, and fact and matter for investigations necessary for taking preventive measures, in cases where it is found that the prevention of illegal use has been hindered or is likely to be hindered by the merchant due to the status of the occurrence of illegal use of credit card in comprehensive credit purchase intermediation (9) Information on the fact that the merchant does not conform to the standards required by laws and regulations for proper control of card number, etc. in comprehensive credit purchase intermediation (10) Fact and matter that the merchant was instructed to conform the standards required by laws and regulations or to take preventive measures with regard to the above (7) and (8) (11) Fact and matter that the merchant was terminated an agreement regarding the handling of credit card number because the merchant did not obey the instruction or was not expected to conform to the standards required by laws and regulations with respect to the above (2) and (10) (12) Information concerning the act that does not protect the users, etc. and that may interfere with the appropriate management of card numbers, etc. (13) The name, address, telephone number, and date of birth of the said merchants pertaining to any of the preceding items (for a corporation, the corporate number, name, address, telephone number, and name and date of birth of the representative). 6. Disclosure, Correction, Deletion
We strive to manage Merchant Information accurately and up to date. In addition, if a Merchant, etc. requests disclosure of the information registered by JCB, JCB will respond in good faith, and if there is anything incorrect in the registered information, JCB will promptly correct or delete it. For inquiries regarding Merchant Information, including the procedures for request of disclosure, correction or deletion and necessary documents, please contact the Card Assist Desk listed at the bottom of this page.
7. Suspension of Sending Promotional Material and Phone Call relating to Business of JCB, Card Company and Merchant, etc.
If a Merchant, etc. wishes to suspend receiving promotional materials, such as direct mails, or telephone calls, etc., JCB will suspend this. However, please note that materials necessary for business operations, such as “notice of payment”, and various information and pamphlets enclosed in the notice of payment will not be suspended. Requests for the suspension will be accepted at the Card Assist Desk listed at the bottom of this page.
