利用規約

本規約は、ユーザーと株式会社エイシスが運営するDLsite（以下DLsiteという）との間の、DLsiteが提供するインターネットサービス「DLsite」の利用に係わる一切の関係に適用します。

本規約はDLsiteが提供する全てのサービス、全てのサービス利用者に対し適用されるものとします。DLsiteのオンライン又はDLsiteが提供する手段を通じ随時ユーザーに対して発表される諸規定は、本規約の一部を校正し、ユーザーはこれを承諾します。また、DLsiteは、ユーザーの了承を得ることなくこの規約を変更することがあり、ユーザーはこれを承諾します。この変更はDLsiteのオンラインまたはDLsiteが提供する手段を通じて随時ユーザーに発表します。

DLsiteの指定する手続きにもとづき、本規約を承諾のうえ、DLsiteにDLsiteの利用を申し込み、DLsiteが承認をした個人をユーザーとします。ユーザーが未成年である場合、DLsiteを利用する際には法定代理人の同意を得るものとします。未成年者が利用の申し込みを行った場合、当社は法定代理人の同意があったものとみなします。また、DLsiteの内、成人向けのサービスについては、18歳以上のユーザーに限り利用することができるものとします。

DLsiteは利用申し込みを行った者が、以下の項目に該当する場合はユーザー登録の承認をしない場合があります。または承認後であっても該当者に承諾を得ること無く承認の取消を行う場合があります。

1. 過去にユーザー規約違反などにより、DLsiteのユーザー資格の取消が行われていることが判明した場合
2. 利用申込内容に虚偽、誤記または記入もれがあったことが判明した場合
3. 申込者の指定した金融機関などにより利用差止が判明した場合
4. DLsiteの利用料金の支払いを怠っていることが判明した場合
5. 申込者が未成年者で、法定代理人の同意を得ていないことが判明した場合
6. 利用申し込みが同一の者により重複して行われていることが判明した場合
7. その他、DLsiteが適切でないと判断した場合

ユーザーは、ユーザー番号として、DLsiteより付与された番号(以下IDという)およびパスワードを第三者に譲渡もしくは利用させたり、売買、名義変更、質入などすることはできません。ユーザーは、本規約にもとづき付与されたIDおよびパスワードの管理、使用について責任を持つものとし、DLsiteに損害を与えることのないものとします。ユーザーは、当該IDおよびパスワードでのDLsiteの利用に関する責任を負うものとし、自己の責任によりその利用に係わる一切の債務を支払うものとします。

株式会社エイシスが提供するDLsite以外のサービス（以下「当該別サービス」という）の利用を希望するユーザーは、DLsiteのIDおよびパスワードを使用して当該別サービスを利用できるものとします。また、ユーザーが、当該別サービスにおいて、DLsiteのIDおよびパスワードを使用する場合は、DLsiteでのユーザー登録の際に届け出た内容が、当該別サービスにおいても共同利用されることに同意するものとします。
DLsiteのIDおよびパスワードで利用可能なサービスについてはDLsiteが任意に設定および変更できるものとし、ユーザーはこれに同意するものとします。

ユーザーは、住所、電話番号その他DLsiteへの届け出内容に変更があった場合には、速やかに所定の変更の届け出をDLsiteに行うものとします。なお、婚姻による姓の変更など、DLsiteが承認した場合を除き、登録された氏名の変更を行うことはできません。

ユーザーは、DLsiteを利用するために必要な通信機器、その他すべての機器を、自己の負担において、準備するものとします。また、自己の費用で使用する機器を電気通信サービスを利用してDLsiteに接続するものとします。その際、必要な手続きはユーザーが自己の責任と費用で行うものとします。

DLsiteは、ユーザーへの事前の通知なくして、DLsiteの諸条件、運用規則またはDLsiteの内容を変更することがあり、ユーザーは、これを承諾します。この変更には、価格の変更およびDLsiteの内容の部分的な改廃を含みますが、これらに限定されません。また、DLsiteは最低3ヶ月の予告期間をもって、DLsiteを停止することができます。この変更、停止などについては、DLsiteのオンラインまたはDLsiteが提供する手段を通じ、発表するものとします。

DLsiteは次に該当する場合には、ユーザーに事前に連絡することなく、一時的にDLsiteを中断する場合があります。

1. DLsiteのシステムの保守を定期的に、または緊急に行う場合
2. 地震、洪水等の天災、または暴動、停電などにより技術的にDLsiteの提供ができなくなった場合
3. その他、運用上、DLsiteがDLsiteの一時的な中断を必要と判断した場合

DLsiteの内容は、DLsiteがその時点で提供可能なものとします。DLsiteは提供する情報、ユーザーが登録する文章およびソフトウェアなどについて、その完全性、正確性、適用性、有用性などいかなる保証も行いません。

DLsiteは、いかなる理由によってDLsiteの提供の遅延または中断などが発生しても、その結果ユーザーまたは他の第三者の被害について一切の責任を負わないものとします。

DLsiteはDLsiteの利用により発生したユーザーの損害に対し、いかなる責任をも負わないものとし、一切の損害賠償をする義務はないものとします。ユーザーがDLsiteの利用によって第三者に対して損害を与えた場合、ユーザーは自己の責任と費用をもって解決し、DLsiteに損害を与えることのないものとします。ユーザーが本規約に反した行為、または不正もしくは違法な行為によってDLsiteに損害を与えた場合、DLsiteは当該ユーザーに対して当該ユーザーとの協議の下に相応の損害賠償の請求を行うことができるものとします。

ユーザーは、DLsiteが承認した場合（当該情報に関して権利を持つ第三者がいる場合には、DLsiteを通じ当該第三者の承認を取得することを含む、本条において以下同じ）を除き、DLsiteを通じて入手したいかなる情報も複製、販売、出版その他いかなる方法においてもユーザーの個人としての私的利用以外の使用をすることができません。ユーザーは、DLsiteが承認した場合を除き、第三者をしてDLsiteを通じて入手した情報を複製、販売、出版または使用させたり、または公開したりすることはできません。

DLsiteは自己の判断にもとづき、各ユーザーにDLsiteの提供範囲の制限を設定または変更することがあります。また、DLsiteは同様に、各ユーザーにDLsiteの利用限度額を設定または変更することができるものとします。

なお、DLsiteはクリエイターからの作品によって成り立っていますので、クリエイターがDLsiteから退会することによりDLsiteへ作品提供がされなくなった場合、ユーザーは当該作品の購入あるいはダウンロード（再ダウンロード含む）、およびオンラインでの閲覧が出来なくなることがあることを予め了承するものとします。

DLsiteの利用料金は商品ごとに決済ページで表示され、算定方法およびその支払い方法なども決済ページに表示されます。なお、個別に支払い方法などが規定されている場合には、その条件に従うものとします。DLsiteから付与されたポイントは１ポイント１円換算し、決済ページにてポイント利用が可能な状態にある場合はこれを差し引いて決済できます。ユーザーは、利用料金などに係わる消費税およびその他、賦課される税を負担するものとします。

ポイントは、以下に示す手続きにおいて付与されるものとします。

1. ポイント購入により付与されるポイント。
2. 作品購入後、作品の評価を行う事で付与されるポイント。
3. 作品に対してレビューを投稿する事で付与されるポイント。
4. アフィリエイトサービスの報酬として付与されるポイント。
5. キャンペーン等により付与されるポイント。
6. その他、DLsiteが必要に応じて付与するポイント。

ポイントは、次の各号の一つにでも該当する場合、権利が失効するものとします。

1. ユーザー登録を破棄した場合（資格の取消を含む）。
2. 最後のポイント利用（取得、使用どちらでも）から1年以上経過した場合。

DLsiteの利用料金などの支払いに関しては、各ユーザーにDLsiteが承認した一つによるものとします。ユーザーはDLsiteが提供する支払い方法を選択し、DLsiteが承認した支払い方法により先払いあるいは後払いが決定されます。金融機関などで別途利用条件、支払い条件、利用限度額の設定などの規定がある場合には、それらに従うものとします。ユーザーと金融機関などの間で紛争が発生した場合は、当該当事者双方で解決するものとし、DLsiteは一切の責任はないものとします。

DLsiteの利用料金などの請求書の発行は後払いにのみ適用され、毎月1日から末日までの料金明細を含めて翌月10日までに各ユーザーに配送するものとし、ユーザーは同27日までに所定の機関より支払うものとします。ただし、機関の営業日により支払期限が変動する場合があります。

DLsiteを利用する際、ユーザーは以下に定める行為（それらを誘発する行為や準備行為も含む）を行ってはならないものとします。

1. ユーザー番号またはパスワードを不正に使用する行為
2. DLsiteを利用する際にユーザーが所在する国または地域の法律、法令等に違反する行為
3. 他のユーザーに物理的損害または著しい精神的苦痛を与える行為
4. 他のユーザーまたは第三者を誹謗中傷する行為や、迷惑行為に該当する行為
5. DLsiteまたは第三者の所有権、著作権を含む一切の知的財産権、肖像権、パブリシティー権等の正当な権利を侵害する行為
6. DLsiteの運営を妨害する行為またはDLsiteの信用を失墜、毀損させる行為
7. DLsiteのシステムに支障を与える行為またはDLsiteの不具合等を意図的に利用する行為
8. DLsiteのサービスに関連して、反社会的勢力に直接・間接に利益を提供する行為
9. その他DLsiteが不適当と判断した行為

ユーザーが、次の各号の一つにでも該当する場合は、DLsiteは当該ユーザーのユーザー資格をユーザーに何ら事前に通知及び催告することなく、一時停止または取り消すことができます。この場合DLsiteは既に支払った利用料金の払い戻しなどは、一切行いません。また、当該の措置によりユーザーに損害が生じても、DLsiteは一切損害を賠償しません。

1. ユーザー登録時に虚偽の申告をした場合
2. 入力されている情報の改ざんを行った場合
3. ユーザー番号またはパスワードを不正に使用した場合
4. DLsiteの運営を妨害した場合
5. DLsiteの利用料金など支払い債務の履行を遅滞し、または支払いを拒否した場合
6. 他のユーザーに、損害あるいは著しい精神的苦痛を与えた場合
7. ユーザー登録後、6ヶ月以上が経過しても付与されたIDおよびパスワードを一度も使用しなかった場合
8. 利用申し込みが同一の者により重複して行われていることが判明した場合（重複利用申し込み分についてユーザー資格を取消し、１ユーザー資格に限りユーザー承認をします）
9. 本規約のいずれかに違反した場合
10. その他DLsiteがユーザーとして不適当と判断した場合

ユーザーが登録を破棄する場合は、DLsiteが定める所定の書式にてDLsiteに届け出るものとし、DLsiteに対する債務の全額をただちに支払うものとします。DLsiteは、DLsiteに既に支払した利用料金の払い戻しなどは一切行わないものとします。また、ユーザー破棄する場合でもDLsiteの使用権などの払い戻しは一切行わず、免責されます。

ユーザーとDLsiteとの間で、訴訟の必要が生じた場合、DLsiteの本社所在地を管轄する裁判所をユーザーとDLsiteの専属的合意管轄裁判所とします。

This User Agreement has been prepared in Japanese and translated into English. The Japanese version represents the official User Agreement. The English version has been prepared for reference use. In the event of any conflicts or contradictions between the versions in these two languages, the Japanese version shall take precedence.

This User Agreement applies to all relations between the users and DLsite as operated by EISYS, Inc., (hereinafter "The Company") related to the use of the DLsite Internet service provided by DLsite.

This User Agreement applies to all services provided by DLsite and to all users of such services. Users hereby acknowledge that the provisions announced from time to time to users through means provided by DLsite constitute partial revisions of this User Agreement. In addition, users hereby acknowledge that DLsite may amend this Agreement without the users' consent. Such amendments will be announced to users online through DLsite Account Service or through other means provided by DLsite.

Users shall be those individuals who, after consenting to this User Agreement, have applied to DLsite for use of the service through the procedures specified by DLsite and have been approved by DLsite. A user who is a minor must obtain the consent of the relevant legal representative to use DLsite. The Company shall deem that a minor who has applied to use DLsite has obtained the consent of the relevant legal agent. Adult services on DLsite may be used only by users aged 18 or older.

DLsite may not authorize an applicant for use to sign up as a user if the person meets any of the descriptions below. In addition, user authorization may be canceled after it has been granted without the consent of the user.

1. When it has become clear that eligibility as a DLsite user was canceled in the past due to a violation of a user agreement or for other reasons.
2. When it has become clear that the application for use contained false information, errors, or omissions.
3. When it has become clear that the applicant's specified financial institution or a similar party has suspended its service.
4. When it has become clear that the person has neglected to pay the usage charges for a service provided by DLsite.
5. When the applicant is a minor and it has become clear that the consent of the legal guardian has not been obtained.
6. When it has become clear that a single individual has submitted multiple applications.
7. In other cases in which DLsite has determined that user authorization would be inappropriate.

A user may not engage in acts such as the transfer of the number assigned to the said user by DLsite as the user number (hereinafter "ID") and password to any third party or permit their use by, sale to, change of account name to, or pledging to any third party. The user shall be responsible for the management and use of the assigned ID and password based on this User Agreement, and shall not cause any harm to DLsite. The user shall be responsible for the use of DLsite using the ID and password and shall be responsible for paying any and all liabilities related to such use.

A user who desires to use a service provided by EISYS, Inc. other than DLsite (hereinafter "other applicable service") may use the ID and password for DLsite to use said other applicable service. In addition, the user hereby consents to the fact that when using the ID and password for DLsite for another applicable service, the information that the user provided when signing up as a user of DLsite shall be used jointly by the other applicable service.

The user hereby consents to the right of DLsite Account Service to, at its discretion, specify or change the services that may be used with a DLsite Account Service ID and password.

When a user's address, telephone number, or other information of which DLsite has been notified has changed, the user shall promptly submit a change notice to DLsite. The registered name cannot be changed for such reasons as a change of family name upon marriage, unless authorized by DLsite.

The user shall, at his or her own cost, prepare the telecommunications devices and all other devices needed to use DLsite. In addition, the user shall connect the devices to DLsite using a telecommunications service at his or her own expense. The user shall be responsible for completing the necessary procedures for doing so, at his or her own expense.

The user hereby acknowledges that DLsite may amend the terms of use, user agreement, or content of DLsite without notifying the user in advance. In addition, DLsite may be suspended with at least three months' prior notice. Such amendment or suspension shall be announced online through DLsite or through other means provided by DLsite.

DLsite may be interrupted temporarily without notifying users in advance in the following cases.

1. For periodic or emergency maintenance of DLsite system.
2. When it is technically impossible to provide DLsite for such reasons as an earthquake, flood, or other natural disaster, civil unrest, or power failure.
3. In other cases in which DLsite has determined that there is a need to interrupt DLsite temporarily for business reasons.

The content of DLsite at any point in time consists of the content that DLsite is able to provide at that time. DLsite provides no guarantee regarding the completeness, accuracy, applicability, or usefulness of information provided, text or software registered by users, or other content.

DLsite shall not bear any liability for any damage suffered by a user or a third party due to such causes as the delay or interruption of DLsite for any reason.

DLsite shall not bear any liability for any damage suffered by a user as a result of using DLsite or be obligated to pay any compensation for damages. If a user has caused harm to any third party as a result of using DLsite, the user shall be responsible for resolving such harm at his or her own expense and shall not cause any harm to DLsite as a result. If a user has caused any harm to DLsite through an act in violation of this User Agreement or any other improper or unlawful act, then DLsite may demand suitable compensation for damages from said user through negotiations with the user.

The user may not, without DLsite's permission (hereinafter in this article, this includes the granting of permission to any third party which has rights to the relevant information, obtained via DLsite), use any information obtained through DLsite for any purpose other than personal use as an individual user through any means, including duplication, sale, or publication. The user may not, without DLsite's permission, permit any third party to duplicate, sell, publish, use, or release to the public any information obtained through DLsite.

DLsite may, at its discretion, specify or modify restrictions on the scope of provision of DLsite to each user. Similarly, DLsite may specify or modify the DLsite usage limit amounts for each user.

In addition, the user hereby acknowledges that, in light of the fact that DLsite is based on works from creators, when a creator has ceased to supply works to DLsite because of withdrawal from DLsite, the user will no longer be able to purchase or download (including re-downloading) such works nor view them online.

DLsite usage charges are displayed on the payment page for each product. The calculation methods, payment methods, and other relevant information are also shown on the payment page. If an individual payment method is specified, such provisions shall be complied with. Points awarded by DLsite may be deducted from the price at a value of one yen per point, if the payment page indicates that points may be used. Users shall pay the consumption tax and other taxes on the usage charges and other charges.

Points are awarded in the following manners:

1. Awarded through points purchase
2. Awarded for rating a work after purchase
3. Awarded for reviewing a work
4. Awarded for affiliate services
5. Awarded as part of promotions
6. Awarded for other reasons as deemed necessary by DLsite

Points will be considered invalid if a user meets any of the descriptions enumerated below:

1. When user registration is canceled (including cancellation due to disqualification).
2. Over 1 year has passed since points were last used or earned.

Payment of DLsite usage charges shall be conducted with one payment method as approved by DLsite for each user. The user shall choose a payment method offered by DLsite and either pay in advance or after the fact as determined through payment methods authorized by DLsite. If a financial institution has established separate conditions of use, payment conditions, and usage limits, then those conditions shall apply. Any disputes between a user and a financial institution shall be resolved by those two parties, and DLsite shall not bear any liability for such disputes.

Invoices issued by DLsite for usage charges shall be eligible for payment after the fact only. Invoices will be sent to users by the 10th day of the month with the details of charges incurred during the period from the first through the last day of the previous month. The user shall pay the invoice by the 27th day of the month through the designated financial institution. The payment due date may vary due to financial institution holidays.

Users must not engage in any of the following acts (including inducement of or preparation for such acts) in using DLsite

1. Improper use of a user number or password.
2. Acts in violation of laws and regulations of the country or region in which the user is located when using DLsite.
3. Acts that cause physical damage or clinically significant psychological distress to other users.
4. Acts of malicious slander of other users or third parties or acts that qualify as nuisances.
5. Acts infringing on any intellectual property rights, including ownership and copyright, rights of likeness, publicity rights, or other rights of DLsite or any third party.
6. Acts impeding the operation of DLsite or acts causing loss or acts detrimental to trust in DLsite.
7. Acts causing harm to DLsite system or intentionally taking advantage of bugs in DLsite.
8. Acts of provision of benefits which relate to DLsite, directly or indirectly, to antisocial forces.
9. Other acts judged by DLsite to be inappropriate.

If a user meets any of the descriptions enumerated below, then DLsite may, without any prior notice or warning to the user, temporarily suspend or cancel eligibility as a user. In such a case, DLsite shall not refund any usage charges already paid. In addition, DLsite shall not pay compensation for any damages suffered by a user as a result of such measures.

1. When the user has provided false information when signing up as a user.
2. When the user has improperly altered information entered.
3. When the user has used the user number or password improperly.
4. When the user has impeded the operation of DLsite.
5. When the user is late in the payment of payment obligations, such as DLsite usage charges, or has refused to make payment.
6. When the user has caused harm or marked psychological distress to another user.
7. When the user has not used the assigned ID and password for a period of six months or longer after signing up as a user
8. When it has been determined that the same person has submitted multiple applications for use. (In such a case, user eligibility under duplicate applications will be canceled, and only one user eligibility will be authorized.)
9. When the user has violated any of the provisions of this User Agreement.
10. In other cases which DLsite has judged to be inappropriate for a user.

A user who intends to cancel the user registration shall notify DLsite thereof at least one month in advance of the date of the intended cancellation by using the form specified by DLsite and promptly pay to DLsite the entire amount of any obligations the user bears to it. DLsite shall not refund any usage charges already paid. In addition, in the case of user cancellation, no return of usage rights for the DLsite Account shall be made, and such rights shall be waived.

The court with jurisdiction over the location of DLsite's head office shall be the exclusive court of first instance as agreed to by the user and DLsite for any litigation necessary between the user and DLsite.

本协议适用于用户与EISYS, Inc.运营的DLsite（以下称为DLsite）之间关于使用DLsite提供的互联网服务「DLsite」的所有关系。

本协议适用于DLsite提供的所有服务与所有服务用户。用户同意通过DLsite的在线或DLsite提供的方式随时向用户发布的各项规定将对部分本协议进行修改。此外，DLsite可以未经用户的同意而更改此协议，且用户同意此举。此变更将随时通过DLsite的在线或DLsite提供的方式向用户发布。

根据DLsite指定的手续同意本协议后，向DLsite申请使用DLsite，DLsite将取得同意的个人视为用户。如果用户未成年，则在使用DLsite时必须获得法定代理人的同意。如果未成年者提出使用申请时，本公司将视为法定代理人已同意。此外，DLsite里面向成年人的服务仅供18岁以上的用户使用。

申请使用DLsite者在符合以下项目时不能通过其用户注册。或者即使在过审后也有可能在未取得该用户同意的情况下取消批准。

1. 当发现过去由于违反用户协议等而被取消过DLsite的用户资格时
2. 当发现申请内容有虚伪、错误或漏记时
3. 当发现由申请者指定的金融机构账号被中止使用时
4. 当发现未支付DLsite的使用金额时
5. 当发现申请人为未成年者且未取得法定代理人的同意时
6. 当发现同一个人重复申请时
7. 其他由DLsite判断不托妥当时

用户不得将DLsite授予的号码(以下称为ID)与密码转让给第三方或让第三方使用，或出售、变更名义、质押等。用户应对依据本协议而被提供的ID与密码的管理、使用负责，不得做出损伤DLsite的事宜。用户将会承担该ID以及密码关于在DLsite上进行使用的相关责任，且需自行承担与其使用相关的所有债务。

欲使用EISYS, Inc.提供的DLsite以外的服务（以下称为「其他服务」）的用户可使用DLsite的ID以及密码去使用其他服务。此外，用户在其他服务中，使用DLsite的ID以及密码时，也需同意在DLsite的用户注册时提出的内容在另外服务中也可共同使用的条件。
DLsite可任意设定与变更利用DLsite的ID与密码可使用的服务，且用户需同意此举。

当向DLsite发出的地址、电话码及其他内容有更改时，用户必须尽快向DLsite提出变更该内容的通知。此外，除非DLsite同意，否则不得变更已注册的姓名，例如由于结婚而更改姓氏等。

用户应自费准备使用DLsite所必要的通信机器及其他所有机器。此外，需自费使用机器的电信通信服务连接到DLsite。在此情况下，用户应自我负责并自费执行必要的手续。

DLsite可不事先通知用户，直接变更DLsite的各项条件、运用规则或DLsite内容，用户需同意此举。此变更包括但不限于价格的变更与DLsite部分内容的修改。此外，DLsite可在至少3个月的预告期间后停止DLsite。关于此变更与停止等，将通过DLsite的在线服务或DLsite提供的其他方法进行发布。

在以下情况下，DLsite可能会不事先通知用户而暂时中断DLsite。

1. DLsite的定期或紧急系统维修时
2. 地震、洪水等天灾或暴动、停电等造成无法进行DLsite技术的提供时
3. 其他在运用上，DLsite判断有必要进行暂时性中断时

DLsite的内容为DLsite在当时可进行提供之内容。DLsite不保证所提供的信息、用户注册的文章与软件的完全性、正确性、适用性、有用性等。

DLsite对于由于任何原因造成DLsite的提供延迟或中断等，其结果造成用户或其他第三方发生损害时将不承担任何责任。

DLsite对于因使用DLsite造成的用户损害不承担任何责任，也没有义务赔偿任何损害。如果用户通过使用DLsite对第三方造成损害时，则用户将自我负责并自费解决该问题，并且不给DLsite造成损害。如果用户违反本协议或以非法或违法的行为给DLsite带来损害时，DLsite可与该用户协商，请求相应的损害赔偿。

除了DLsite同意的情况（有拥该信息相关权利的第三方存在时，包括通过DLsite取得该第三方的同意，此后在本条中同样适用）之外，用户只能把通过复制、销售、出版及其他任何方法所取得的DLsite的所有信息的供自己的私人使用，不得用于其他目的。除非DLsite同意，否则用户不得让第三方复制、销售、出版或使用通过DLsite获取的信息，或向第三方公布该信息。

DLsite可以根据自社的判断，为每位用户设定或更改DLsite的提供范围限制。此外，DLsite同样能够为每位用户设定或更改DLsite的使用限度金额。

关于DLsite的使用费等的支付，用户只能使用DLsite同意的一种方式。用户选择DLsite提供的付款方式，再根据DLsite同意的付款方式决定事先支付或事后支付。如有金融机构等另外的使用条件、付款条件、利用限度额的设定等规定时，则按照其各项规定。如果用户与金融机构等之间发生纷争时，应由该当事者双方解决，DLsite将不承担任何责任。

DLsite使用费等的请款单发行仅适用于事后支付，并应于次月10日前邮寄给各用户，其中包含每月1日至月底的费用明细，用户应于同月27日前从规定的机构支付。但付款期限会根据机构的营业日而有所变动。

使用DLsite时，用户不得进行以下行为（包含诱发与准备行为）。

1. 未经授权擅自使用用户编号或密码的行为
2. 使用DLsite时违反用户所在国家或地区的法律、法令等行为
3. 对其他用户造成实物性的损害或明显的精神性痛苦的行为
4. 诽谤中伤其他用户或第三方的行为行为或令人困扰的行为
5. 任何侵犯包含DLsite或第三方的所有权、版权、肖像权、隐私权等一切正当权利的行为
6. 妨害DLsite运营的行为或使DLsite失去信用或破坏DLsite信用的行为
7. 干扰DLsite系统的行为或故意利用DLsite缺陷等行为
8. 与DLsite的服务有关的直接或间接向黑社会性质犯罪组织提供利益的行为
9. 其他DLsite判断为不适当的行为

如果用户符合以下各项之一时，DLsite将毋须事先通知该用户，即可暂时停止或取消用户资格。在此情况下，DLsite将不退还已支付的任何费用。此外，DLsite将不会赔偿该等措施造成用户发生的任何损害。

1. 用户注册时使用了虚假内容时
2. 篡改输入的信息时
3. 未经授权使用用户编号或密码时
4. 妨害DLsite的运营时
5. 延迟履行付款义务，例如DLsite的使用费，或拒绝付款时
6. 对其他用户造成损害或严重的精神性痛苦时
7. 用户注册后经过6个月以上仍未曾使用付与的ID与密码时
8. 发现同一个人重复申请使用时（撤销重复申请使用部分的用户资格，仅批准１位用户拥有用户资格）
9. 违反本协议的任一项时
10. 其他DLsite判断不符合用户条件时

用户注销注册时，应该以DLsite规定的制式格式向DLsite提出申请，并立即向DLsite偿还全部债务。DLsite将不退还已支付给DLsite的使用费等。此外，即使注销用户，我们也不会退还DLsite的使用权等，并免除其责任。

用户与DLsite之间发生必要的诉讼时，管辖DLsite总公司所在地的法院将作为用户与DLsite的专属合意管辖法院。

本協議適用於使用者與EISYS, Inc.營運的DLsite（以下稱為DLsite）之間關於使用DLsite提供的網路服務「DLsite」的所有關係。

本協議適用於DLsite提供的所有服務與所有服務使用者。透過DLsite的線上或DLsite提供的方式隨時向使用者發佈的各項規定將對部分本協議進行修正，使用者並同意此舉。此外，DLsite可能未經使用者的同意而更改此協議，且使用者同意此舉。此變更將不定時透過DLsite的線上或DLsite提供的方式向使用者發佈。

根據DLsite指定的手續同意本協議後，向DLsite申請使用DLsite，DLsite將取得同意的個人作為使用者。如果使用者未成年，則在使用DLsite時必須獲得法定代理人的同意。如果未成年者提出使用申請時，本公司將視為法定代理人已同意。此外，DLsite裡適合成年人的服務僅供18歲以上的使用者使用。

有時申請使用DLsite者在符合以下項目時不能同意其使用者登錄。或者即使在同意後也有可能未取得該使用者的同意而逕行取消。

1. 當發現過去由於違反使用者協議等而被取消DLsite的使用者資格時
2. 當發現使用申請內容有虛偽、錯誤或漏記時
3. 當發現由申請者指定的金融機構等中止使用時
4. 當發現未支付DLsite的使用費時
5. 當發現申請人為未成年者且未取得法定代理人的同意時
6. 當發現同一個人重複使用申請時
7. 其他由DLsite判斷不適當時

作為使用者編號，使用者不得將DLsite提供的編號(以下稱為ID)與密碼轉讓給第三方或讓第三方使用，或出售、變更名義、質押等。使用者對本協議提供的ID與密碼的管理、使用負責，且不得損害DLsite。使用者應負責利用該ID以及密碼使用DLsite的相關責任，需負自我責任支付使用的相關所有債務。

欲使用EISYS, Inc.提供的DLsite以外的服務（以下稱為「另外服務」）的使用者使用DLsite的ID以及密碼，即可使用另外服務。此外，使用者在另外服務中，使用DLsite的ID以與密碼時，同意在DLsite中使用者登錄時提出的內容在另外服務中也可共同使用。
DLsite可任意設定與變更利用DLsite的ID與密碼可使用的服務，且使用者同意此舉。

當向DLsite發出的住址、電話碼及其他內容有異動時，使用者必須盡快向DLsite提出變更該內容的通知。此外，除非DLsite同意，否則不得變更已登錄的姓名，例如由於結婚而更改姓氏等。

使用者應自費準備使用DLsite所必要的通訊機器及其他所有機器。此外，自費使用的機器應使用電信通訊服務連接到DLsite。在此情況下，使用者應自我負責並自費執行必要的手續。

DLsite可不事先通知使用者，逕行變更DLsite的各項條件、運用規則或DLsite內容，使用者同意此舉。此變更包括但不限於價格的變更與DLsite部分內容的修改。此外，DLsite可在至少3個月的預告期間內停止DLsite。關於此變更與停止等，乃透過DLsite的線上或DLsite提供的方法進行發佈。

在以下情況下，DLsite可能會暫時中斷DLsite而事先未與使用者連絡。

1. DLsite定期或緊急進行系統維修時
2. 地震、洪水等天災或暴動、停電等造成無法進行DLsite技術的提供時
3. 其他在運用上，DLsite判斷有必要進行暫時性中斷時

DLsite的內容為DLsite在該時點可進行提供之內容。DLsite不保證所提供的資訊、使用者登錄的文章與軟體的完全性、正確性、適用性、有用性等。

DLsite對於由於任何原因造成DLsite的提供延遲或中斷等情形，其結果造成使用者或其他第三方發生損害時將不承擔任何責任。

DLsite對於因使用DLsite造成的使用者損害不承擔任何責任，也沒有義務賠償任何損害。如果使用者透過使用DLsite對第三方造成損害時，則使用者將自我負責並自費解決該問題，並且不會對DLsite造成損害。如果使用者違反本協議或以非法或違法的行為損害DLsite時，DLsite可與該使用者協商，請求相應的損害賠償。

除了DLsite同意的情形（有擁有該資訊相關權利的第三方時，包括透過DLsite取得該第三方的同意，此後在本條中同樣適用）之外，即使透過DLsite取得的所有資訊的複製、販賣、出版及其他任何方法，使用者除了個人使用之外，不得用於其他目的。除非DLsite同意，否則使用者不得讓第三方複製、販賣、出版或使用透過DLsite獲取的資訊，或向第三方公佈該資訊。

DLsite可以根據自己的判斷，為每位使用者設定或更改DLsite的提供範圍限制。此外，DLsite同樣能夠為每位使用者設定或更改DLsite的使用限度額。

此外，由於DLsite由創作者的作品組成，如果創作者退出DLsite，無法再提供作品給DLsite時，使用者需事先理解將無法購買或下載該作品（包含再次下載），以及在線上閲覽。

7. 干擾DLsite系統的行為或故意利用DLsite缺陷等行為
8. 與DLsite的服務有關的直接或間接提供反社會性勢力利益的行為
9. 其他DLsite判斷為不適當的行為

如果使用者符合以下各項之一時，DLsite毋須事先通知該使用者的使用者資格與向該使用者進行催告，即可暫時停止或取消使用者資格。在此情況下，DLsite將不退還已支付的任何費用。此外，DLsite將不會賠償該等措施造成使用者發生的任何損害。

1. 使用者登錄時做出虛假聲明時
2. 竄改輸入的資訊時
3. 未經授權使用使用者編號或密碼時
4. 妨害DLsite的營運時
5. 延遲履行付款義務，例如DLsite的使用費等，或拒絕付款時
6. 如果對其他使用者造成損害或嚴重的精神性痛苦時
7. 使用者登錄後經過6個月以上仍未曾使用給予的ID與密碼時

본 규약은 사용자와 주식회사 에이시스가 운영하는 DLsite(이하 DLsite라 한다) 간의 DLsite가 제공하는 인터넷 서비스 "DLsite"의 이용과 관련된 일체의 관계에 적용합니다.

본 규약은 DLsite에서 제공하는 모든 서비스, 모든 서비스 이용자에게 적용됩니다. DLsite의 온라인 또는, DLsite가 제공하는 수단을 통해 수시로 사용자에게 발표되는 제반 규정은 본 규약의 일부를 교정하고 사용자는 이를 승낙합니다. 또한, DLsite는 사용자의 양해 없이 이 규약을 변경할 수 있으며, 사용자는 이를 승낙합니다. 이 변경은 DLsite의 온라인 또는, DLsite가 제공하는 수단을 통해 수시로 사용자에게 발표합니다.

DLsite의 지정 절차에 따라 본 규약을 승낙한 후, DLsite에 DLsite의 이용을 신청하고 DLsite가 승인을 한 개인을 사용자로 합니다. 사용자가 미성년자일 경우 DLsite 이용 시, 법정대리인의 동의를 얻어야 합니다. 미성년자가 이용신청을 한 경우, 당사는 법정대리인의 동의가 있었던 것으로 간주합니다. 또한, DLsite 내 성인용 서비스는 만 19세 이상(성인) 사용자에 한해 이용할 수 있습니다.

DLsite는 이용 신청을 한 사람이 아래 항목에 해당하는 경우 사용자 등록 승인을 하지 않을 수 있습니다. 또는, 승인 후라도 해당자에게 승낙을 얻지 않고 승인을 취소하는 경우가 있습니다.

1. 과거에 사용자 규약의 위반 등으로 DLsite의 사용자 자격 취소가 이루어진 것으로 판명된 경우
2. 이용 신청 내용에 허위, 오기 또는, 기입 누락이 있는 것으로 판명된 경우
3. 신청자가 지정한 금융기관 등에 의해 이용 정지가 판명된 경우
4. DLsite의 이용 요금 납부를 게을리 한 것이 판명된 경우
5. 신청자가 미성년자로서 법정대리인의 동의를 얻지 않았음이 판명된 경우
6. 이용 신청이 동일한 자에 의해 중복된 것이 판명된 경우
7. 그 외, DLsite가 적절하지 않다고 판단한 경우

사용자는 사용자 번호로서 DLsite에서 부여된 번호(이하 ID라 한다) 및 비밀번호를 제삼자에게 양도 또는, 이용하게 하거나 매매, 명의변경, 저당 잡는 행위 등을 할 수 없습니다. 사용자는 본 규약에 근거하여 부여된 ID 및 비밀번호의 관리, 사용에 대한 책임을 지며, DLsite에 손해를 끼치지 않습니다. 사용자는 해당 ID 및 비밀번호로 DLsite 이용에 관한 책임을 지며, 본인 책임으로 해당 이용과 관련된 모든 채무를 지불해야 합니다.

주식회사 에이시스가 제공하는 DLsite 이외의 서비스(이하 "해당 별도 서비스"라 한다)의 이용을 희망하는 사용자는 DLsite의 ID 및 비밀번호를 사용하여 해당 별도 서비스를 이용할 수 있습니다. 또한, 사용자가 해당 별도 서비스에서 DLsite의 ID 및 비밀번호를 사용하는 경우에는 DLsite로 사용자 등록 시 신고한 내용이 해당 별도 서비스에서도 공동 이용되는 것에 동의합니다.
DLsite의 ID 및 비밀번호로 이용 가능한 서비스는 DLsite가 임의로 설정 및 변경할 수 있으며 사용자는 이에 동의합니다.

사용자는 주소, 전화번호 그 외 DLsite 로의 신고 내용이 변경된 경우에는, 신속하게 소정의 변경 신고를 DLsite 에 실시하는 것으로 합니다. 아울러 혼인으로 인한 성의 변경 등, DLsite가 승인한 경우를 제외하고, 등록된 성명을 변경할 수 없습니다.

사용자는 DLsite를 이용하기 위해 필요한 통신기기, 기타 모든 기기를 본인 부담으로 준비합니다. 또한, 본인의 비용으로 사용하는 기기를 전기 통신 서비스를 이용해 DLsite에 접속합니다. 그때, 필요한 수속은 사용자가 본인의 책임과 비용으로 합니다.

DLsite는 사용자에 대한 사전 통지 없이 DLsite의 여러 조건, 운용 규칙 또는, DLsite의 내용을 변경할 경우가 있으며, 사용자는 이를 승낙합니다. 이 변경에는 가격 변경 및 DLsite 내용의 부분적인 개정 및 폐지를 포함하지만, 이것에 한정하지 않습니다. 또한, DLsite는 최소 3개월의 예고기간을 가지고 DLsite를 정지할 수 있습니다. 이 변경, 정지 등에 대해서는 DLsite의 온라인 또는, DLsite에서 제공하는 수단을 통해 발표합니다.

DLsite의 시스템 보수를 정기적 또는, 긴급하게 실시하는 경우

1. DLsite의 시스템 보수를 정기적으로, 혹은 긴급으로 행하는 경우
2. 지진, 홍수 등의 천재 또는, 폭동, 정전 등 기술적으로 DLsite를 제공할 수 없게 된 경우
3. 그 외, 운용상 DLsite가 DLsite의 일시적 중단을 필요하다고 판단한 경우

DLsite의 내용은 DLsite가 그 시점에서 제공 가능한 것으로 합니다. DLsite는 제공하는 정보, 사용자가 등록하는 문장 및 소프트웨어 등에 대해 그 완전성, 정확성, 적용성, 유용성 등 어떠한 보증도 하지 않습니다.

DLsite는 어떠한 이유로 DLsite 제공의 지연 또는, 중단 등이 발생하더라도 그 결과 사용자 또는, 다른 제삼자의 피해에 대해 일체의 책임을 지지 않습니다.

DLsite는 DLsite의 이용으로 인해 발생한 사용자의 손해에 대하여 어떠한 책임도 지지 않으며, 일체의 손해배상을 할 의무는 없습니다. 사용자가 DLsite의 이용에 의해 제삼자에게 손해를 입힌 경우 사용자는 본인의 책임과 비용으로 해결하며 DLsite에 손해를 끼치지 않습니다. 사용자가 본 규약에 위배된 행위 또는, 부정 또는, 위법한 행위로 인해 DLsite에 손해를 끼친 경우, DLsite는 해당 사용자에게 해당 사용자와 협의하여 그에 상응하는 손해배상을 청구할 수 있습니다.

사용자는 DLsite가 승인한 경우(해당 정보에 관해 권리를 가진 제삼자가 있는 경우에는 DLsite를 통하여 해당 제삼자의 승인을 취득하는 것을 포함, 본 조에서 이하 동일)를 제외하고, DLsite를 통해 입수한 어떠한 정보도 복제, 판매, 출판 기타 어떠한 방법으로도 사용자의 개인으로서의 사적 이용 이외에 사용을 할 수 없습니다. 사용자는 DLsite가 승인한 경우를 제외하고 제삼자로 하여금 DLsite를 통해 입수한 정보를 복제, 판매, 출판 또는, 사용하게 하거나 공개할 수 없습니다.

DLsite는 본인의 판단에 따라 각 사용자에게 DLsite 제공 범위의 제한을 설정 또는, 변경할 수 있습니다. 또한, DLsite는 마찬가지로 각 사용자에게 DLsite의 이용한도액을 설정 또는, 변경할 수 있습니다.

또한, DLsite는 크리에이터의 작품으로 이루어지므로 크리에이터가 DLsite에서 탈퇴함으로써 DLsite로 작품 제공이 되지 않을 경우 사용자는 해당 작품의 구입 혹은 다운로드(재다운로드 포함) 및 온라인 열람이 불가능할 수 있음을 미리 양해한 것으로 간주합니다.

DLsite의 이용요금은 상품별로 결제 페이지로 표시되며, 산정 방법 및 결제 방법 등도 결제 페이지에 표시됩니다. 그리고 개별적으로 지불 방법 등이 규정되어 있는 경우에는, 그 조건에 따릅니다. DLsite에서 부여된 포인트는 1포인트 1엔으로 환산하며, 결제 페이지에서 포인트 이용이 가능한 상태일 경우 이를 빼고 결제할 수 있습니다. 사용자는 이용요금 등에 관련된 소비세 및 기타 부과되는 세금을 부담합니다.

DLsite에서 부여된 포인트는 1포인트 1엔으로 환산하며, 결제 페이지에서 포인트 이용이 가능한 상태일 경우 이를 빼고 결제하실 수 있습니다. 사용자는 이용요금 등에 관련된 소비세 및 기타 부과되는 세금을 부담합니다.

포인트는 아래의 수단으로 부여되는 것으로 정의합니다.

1. 포인트 구입에 의해 부여되는 포인트.
2. 작품 구입 후, 작품의 평가을 하여 부여되는 포인트.
3. 작품에 대하여 리뷰를 투고하여 부여되는 포인트.
4. 제휴 협력 서비스의 보수로서 부여되는 포인트.
5. 캠페인 등에 의해 부여되는 포인트.
6. 그 외, DLsite가 필요에 의해 부여하는 포인트.

포인트는 다음 각 호의 하나에 해당하는 경우 권리가 실효되는 것으로 합니다.

1. 사용자 등록을 파기한 경우(자격의 취소를 포함).
2. 마지막 포인트 이용(취득, 사용 모두)으로부터 1년 이상 경과한 경우.

DLsite의 이용요금 등의 지불에 관해서는 각 사용자에게 DLsite가 승인한 한가지에 의합니다. 사용자는 DLsite에서 제공하는 지불 방법을 선택하고, DLsite가 승인한 지불 방법으로 선불 또는, 후불이 결정됩니다. 금융기관 등에서 별도 이용 조건, 지불 조건, 이용 한도액의 설정 등의 규정이 있는 경우에는, 그들에 따르는 것으로 합니다. 사용자와 금융기관 등 사이에 분쟁이 발생한 경우에는 해당 당사자 쌍방이 해결하며 DLsite는 일절 책임지지 않습니다.

DLsite 이용요금 등의 청구서 발행은 후불에만 적용되며, 매월 1일부터 말일까지의 요금명세를 포함하여 익월 10일까지 각 사용자에게 배송하며, 사용자는 동월 27일까지 소정의 기관에서 지불합니다. 다만, 기관의 영업일에 따라 지불 기한이 변동될 수 있습니다.

DLsite를 이용할 때, 사용자는 다음과 같은 행위(이들을 유발하는 행위나 준비행위도 포함)를 해서는 안됩니다.

1. 사용자 번호 또는, 비밀번호를 부정하게 사용하는 행위
2. DLsite를 이용할 때, 사용자가 소재하는 국가 또는, 지역의 법률, 법령 등에 위반되는 행위
3. 다른 사용자에게 물리적 손해 또는, 현저한 정신적 고통을 주는 행위
4. 다른 사용자 또는, 제삼자를 비방 중상하는 행위나 민폐행위에 해당하는 행위
5. DLsite 또는, 제삼자의 소유권, 저작권을 포함한 모든 지적재산권, 초상권, 퍼블리시티권 등의 정당한 권리를 침해하는 행위.
6. DLsite의 운영을 방해하는 행위 또는, DLsite의 신용을 실추, 훼손시키는 행위
7. DLsite의 시스템에 지장을 주는 행위 또는, DLsite의 트러블 등을 의도적으로 이용하는 행위
8. DLsite의 서비스와 관련하여 반사회적 세력에 직간접으로 이익을 제공하는 행위
9. 그 외, DLsite가 부적당하다고 판단한 행위

사용자가 다음 각호의 한가지라도 해당하는 경우, DLsite는 해당 사용자의 사용자 자격을 사용자에게 아무런 사전 통지 및 최고 없이 일시 정지 또는, 취소할 수 있습니다. 이 경우 DLsite는 이미 지불한 이용요금의 환불 등은 일절 하지 않습니다. 또한, 해당 조치로 인해 사용자에게 손해가 발생하더라도 DLsite는 일절 손해를 배상하지 않습니다.

1. 사용자 등록 시 허위신고를 한 경우
2. 입력된 정보를 조작한 경우
3. 사용자 번호 또는, 비밀번호를 부정하게 사용한 경우
4. DLsite의 운영을 방해한 경우
5. DLsite 이용요금 등 지급채무의 이행을 지체하거나 지불을 거부한 경우
6. 다른 사용자에게 손해 또는, 현저한 정신적 고통을 준 경우
7. 사용자 등록 후 6개월 이상이 경과하여도 부여된ID및 비밀번호를 한 번도 사용하지 않은 경우
8. 이용 신청이 동일한 자에 의해 중복된 것이 판명된 경우(중복 이용 신청분에 대해 사용자 자격을 취소하고, 1사용자 자격에 한하여 사용자 승인을 합니다)
9. 본 규약의 어느 하나를 위반한 경우
10. 그 외, DLsite가 사용자로서 부적당하다고 판단한 경우

사용자가 등록을 파기할 경우는 DLsite가 정하는 소정의 서식으로 DLsite에 신고하며 DLsite에 대한 채무 전액을 즉시 지급합니다. DLsite는 DLsite에 이미 지불한 이용요금의 환불 등은 일절 하지 않습니다. 또한, 사용자 파기 시에도 DLsite 사용권 등의 환불은 일절 하지 않고 면책됩니다.

사용자와 DLsite 간에 소송이 필요할 경우, DLsite의 본사 소재지를 관할하는 법원을 사용자와 DLsite의 전속적 합의 관할 법원으로 합니다.
