話しが通じませんが、外国国章損壊罪では「外国の請求」が必要です。国旗損壊罪の場合は、通常の運用なら対象にならないでしょうが、その線引きは明らかでなく、理屈上はこれだって対象になりえ、政府が意図的に「難癖的国旗損壊疑惑」を論って政敵を批判どころか逮捕までできてしまうという例ですよ。

お子様ランチには普通に各国の旗も使用されています。そして、既に外国国章損壊罪は存在していますが、お子様ランチの外国旗を捨てたりしたからといって処罰された人がいるのでしょうか。
