5. 境媛に対する人権侵害の実態
--- The True State of the Infringement on Human Rights of SAKAI, Hime ---
まず初めに、境媛（境）は芸能人や芸人などではないことを宣言します。吉本興業（吉本）は境のことを自分のところの新人だと言っていますが、それは嘘です。境は単なる一般市民なのです。境は芸能人や芸人になることを初めから望んでいません。今でも境は芸能人や芸人になることを拒否しています。それにも関わらず、吉本は境に近づき、つきまとっているのです。
First of all, I announce that SAKAI, Hime (SAKAI) is not an entertainer, though Yoshimoto Kogyo Co., Ltd. (Yoshimoto) tells its customers she is its new face. It is a lie. SAKAI is just a common citizen. SAKAI does not want to become an entertainer from the beginning. Even now, SAKAI rejects to become so. Nevertheless, Yoshimoto approached SAKAI and shadows tenaciously.
次に、この犯罪がなぜ明るみに出ないのかをお話ししたいと思います。
Secondly, I tell you the reason why this dirty affair does not come to light.
一番大きな理由は、犯罪を行っている吉本の「外部委託犯罪組織」がこの手の犯罪のプロ集団であるだけに、証拠を取られない方法を熟知している常習犯であるため、状況証拠が認められない日本では告発できるだけの証拠が取れないからです。
The biggest reason is that Yoshimoto’s “outside commissioned criminal organization” which carries out crimes is a professional group of this kind of crimes. They are habitual criminals and know well the ways how to be unable to be found evidences. In Japan, so that circumstantial evidences are not regarded as evidences, no one gets valid evidences to bring a charge.
また、日本では刑事告発の対象となるのは個人に限られ、法人にはそれができないのです。
In addition, only individuals can be brought a charge in Japan, and legal entities cannot.
さらに、日本では芸能人についての情報はほとんどが芸能プロダクションから提供されるため、取材拒否を恐れてメディアがその不法行為を追求できないという事情もあります。吉本は、テレビ局に対するヘッド・ハンティングを行ってメディアを支配してもいますし、自由民主党（自民党）も金を持っている吉本の見方なのです。
Moreover, since information about entertainers is mostly given by theatrical agencies in Japan, Japanese media cannot look closely into their wrongful conduct in fear of refusals to interview. Yoshimoto controls media by means of headhunting from television stations, Liberal Democratic Party (LDP) also supports Yoshimoto because it has a lot of money.
吉本は犯罪企業ですから、自身の犯罪を公表しようとする人がいれば、裏で手を回して様々な圧力をかけてきます。吉本の手口の特徴は「間接的であること」です。
Yoshimoto puts all kinds of pressure by backdoor means in case anyone makes public about its crimes, because it is a criminal company.
それでは、事件のことをお話しします。
Then, I tell about the affair.
境に対する人権侵害が始まったのは1999年5月です（計画は4月から）。
It was May 1999 that the infringement on human rights of SAKAI began (planned from April 1999).
事件は、「世界初の隠し撮りから作られた映画の製作」、および、その主人公が書いた手紙やメールの無断二次利用によるパロディの創作です。そして、ことわりもなく主人公に仕立て上げられたのが境です。これは憲法違反であり犯罪ですが、吉本にはもともと所属芸人を「所属」とは名ばかりに契約なしに使用している企業体質があるため、境にも「犯罪の事後承諾」をさせるつもりで強引に行っているのです。
The purpose of Yoshimoto is producing of the first film by sneaking shots in the world and producing a comedy making use of mail written by the heroine without permission. It is SAKAI that Yoshimoto chose as the heroine without any notice. Its activities are violations of the Constitution and crimes, but it has the nature of hiring entertainers without any contract including a verbal promise originally, though the entertainers belong to it officially, so it has enforced the activities schemed to get retroactive approval of the crimes from SAKAI, too.
吉本は、メディアや協力者たちには「犯罪収益」が得られれば税収が上がって年金の心配がなくなるという屁理屈を言ってこの「犯罪」に協力させています。
Yoshimoto tells media and collaborators that its activities save Japan’s pension plan owing to profits from crimes.
また、この犯罪が明るみに出ると世界における日本のイメージが悪化すると言って黙らせていることもあるようです。そして、相変わらず吉本はこの「犯罪」を続けています。
It also says that Japan’s international image goes down in case its criminal facts come to light, and makes them hold back the facts. It continues to commit crimes as before.
なぜ境がこの「犯罪」のターゲットにされたかといえば、境が過去に境界性人格障害（境界例）を患って、これをほぼ自力で克服したという稀な経験と能力を有しているからです。境界例であったと見なされている人には、ヘルマン・ヘッセ、太宰治、尾崎豊などがいて、境界例はその精神活動に基づく創作活動において、ときに世間から注目を集めることがあるのです。境もこれまでに何千通という手紙やメールを書いており、その精神の変遷が注目されています。犯罪者たちは、過去に境がニフティサーブの会議室に書き込みをしていたのを読んで、境に目をつけたのです。
The reason why SAKAI was made the target of these crimes is that SAKAI has rare experience and faculties; she had been suffering from borderline personality disorder (borderline case), and overcame the disorder almost single-handedly. There are many creators who are regarded as borderline cases, for example, Hermann Hesse, Osamu Dazai (the late Japanese novelist), and Yutaka Ozaki (the late Japanese pop singer). Borderline cases sometimes attract attention of the public owing to their creative activities based on their mental activities. SAKAI also wrote thousands of mail until now, and the transitions of mind hold the spotlight. Yoshimoto directed its attention to SAKAI because of her past writings in electronic meeting rooms of NIFTY SERVE (Japanese dealer of communication by personal computers).
この犯罪には多くの一般人が巻き込まれています。けれど、多くは脅迫されています。また、相手がこの手の犯罪のプロ集団であることにより、告発できるだけの証拠を取るのが難しいのが現状です。大手メディア各社はこの犯罪事実を把握していますが、犯罪企業とそれから利益を得ている政治家によって報道の自由が奪われています。そのため、この事件に関わる被害者は現在も増え続けており、犯罪組織は「犯罪収益」を得るために、事実を知らないファンに売り込んで、勢力を増大させています。ただし、この犯罪の継続には多額の調査費用や買収費用がかかるため、全体としてみれば赤字（したがって、現在のところ財源にはなっていない）で、現在は著作権意識等の低い中国に売り込んで収益の拡大を計っている模様です。
A large number of common citizens are involved in the crimes. But many are threatened. Moreover, it is too difficult to get valid evidences to bring a charge because criminals are professionals of this kind of crimes. Major media catch the criminal facts, but they are deprived of freedom of reports by pressure from the criminal company and statesmen who make profits by the company. Therefore, victims of the crimes increase even now, and criminal agents increase power owing to sell artificial stories taken from SAKAI’s real life to people who are ignorant of the criminal facts to earn money. However, since a lot of money is required to investigate SAKAI and buy collaborators, the project is in the red so far; it is not a source of revenue in Japan. Yoshimoto is now planning to sell the stories and so on to China, whose people have low copyright consciousness, to earn more money.
吉本は、もともと自分たちの利益を減らすことになるような、金儲けに利用している人たちと「契約」を結ぶということがないため、 “既成事実”を作れば、あとは被害者に事後承諾させて、客には被害者が「自分から希望して」やったことにすればいいと考えており、そのとおりになるまで被害者に嫌がらせを続け、また「時効」も強く意識して犯罪を行っているのですが、現在、さらに深刻になっているのは、境が犯罪の事後承諾を徹底的に拒否しているため、それでは企業活動が成り立たなくなる吉本は、境を痛めつけて「見せしめ」にすることによって、他の犯罪の事後承諾を得やすくしているということです。吉本とはこういう法律を完全に無視して利益を追求している強引で汚い「犯罪企業」なのです。
Since Yoshimoto makes use of people to earn money without any contract originally because of extra expenses, it makes “accomplished facts” and forces retroactive approval on victims. Yoshimoto intends to tell customers that victim’s performance is own request, and for the purpose, Yoshimoto continues playing nasty tricks on victims until victims obey it. Yoshimoto is also conscious of prescription and commit crimes. It is more serious that Yoshimoto makes SAKAI an example by giving torment to SAKAI to get retroactive approval easily from other victims, because SAKAI refuses thoroughly its demands and Yoshimoto’s business cannot be continued if it gives up getting SAKAI’s retroactive approval. Yoshimoto is such forcible and dirty criminal company which defies the laws completely and pursues own profit.
境は吉本の邪悪で卑劣で執拗な嫌がらせのために何度自殺しようと思ったかわかりません。境は三度、延べ14ヵ月もの間、この犯罪のストレスのために入院してさえいます。境は10年以上も自由を奪われているのです。そして、この吉本の残酷さこそが境が吉本に抵抗している最大の理由なのです。
SAKAI thought of suicide many times owing to Yoshimoto’s malicious, mean, and persistent harassment. SAKAI even entered a hospital three times, total 14 months, from stress of the crimes. And its brutality is the biggest reason why SAKAI resists Yoshimoto.
もちろん、境は警察に相談しています。けれど、犯罪を証明する証拠が弱いため、無駄でした。例えば、境はICレコーダーで住居侵入の証拠を取っていますが、音では犯罪者が誰であるかがわかりません。
Of course, SAKAI consulted the police, but in vain. Because SAKAI has only weak evidences which prove the crimes. For example, SAKAI has an evidence of breaking into her residence that was taken by an IC recorder, but sounds do not show the criminal who he is.
吉本の目的の一つは境をAV女優としてデビューさせることですが、境は境界例をほぼ自力で克服した者として、現在この障害の壮絶な苦しみの中にいる人たちに、克服してもAV女優にしかなれないなどという絶望を与えるわけにはいかないと切実に考えています。
One of the Yoshimoto’s purposes is making SAKAI make her debut as an erotic actress, but SAKAI thinks earnestly that she does not give despair that woman borderline cases can become only erotic actresses in case they overcome the disorder to borderline cases who are in fierce agony now as a woman who overcame the disorder almost single-handedly.
吉本は境がAV女優デビューしないくらいなら、むしろ境に自殺してほしいと思っています。自民党議員はその吉本の活動を支援しているのです。自民党議員にとっては、国民一人の命よりも自分の利益の方が大事なのです。日本は現在このような利己的な人間によって支配されているのです。
Yoshimoto would rather want SAKAI to kill herself than not to make her debut as an erotic actress. The majority of LDP members support the activities of Yoshimoto. Own profit is more valuable than life of one Japanese woman for the majority of LDP members. Japan is now ruled by such selfish people.
