CAMPFIRE Inc. and its subsidiaries and affiliates ("CAMPFIRE") is a crowdfunding service provided by CAMPFIRE (hereinafter referred to as "the Service"). We hereby set forth the Terms and Conditions for the following. These Terms and Conditions and Bylaws, separately established as an integral part of these terms and conditions, (hereinafter collectively referred to as the "Terms and Conditions") are the contents of the contract in order to use the Service. CAMPFIRE and the user (defined in Article 1.2) must agree that these terms and conditions is the contract to use the Service.

Article 1 (Definition)

The terms used in this "Terms and Conditions" are defined as follows.

  • (1) "Member"
    A person who applies for admission for the use of this service in the method specified by CAMPFIRE and is approved by CAMPFIRE after approving this terms and conditions.
  • (2) "User"
    All users of the Service, including members and guest Users.
  • (3) "Project"
    Project content, products, etc. published on the Service.
  • (4) “Project owner”
    Executor of planning, managing, and operating the project.
  • (5) "Backers"
    Users funding the project.
  • (6) "Guest user"
    Users who use a part of the Service without registering as a member​​.
  • (7) "Funding contract"
    A contract between the backer and the project owner when the project succeeds.
  • (8) "Funding"
    The act of a backer paying a certain amount of money to the project owner upon sympathizing with the project.
  • (9) "Rewards"
    Goods or services provided by the project owner upon funding the project.
  • (10) "Funding period"
    A period of time set by the project owner for each project on the service.
  • (11) "Funding Goal"
    The total amount of funding goal for each project set by the project owner.
  • (12) "External SNS service"
    CAMPFIRE social networking services provided by Facebook and other companies that have functions such as member authentication, disclosure of friend list and the content to the external social network, and are used to implement the Service.

Chapter 1 Member Registration

Article 2 (member application)

Section​ 1In order to become a member of CAMPFIRE, you must read this agreement and CAMPFIRE Privacy Policy, agree to abide by this agreement, and apply for membership registration by providing the prescribed information through the registration form provided by CAMPFIRE. You must provide us with genuine information when filling out the form. The same individual is not allowed to register more than once.

Section 2The membership registration process is completed, upon consent by CAMPFIRE on the application mentioned in the preceding paragraph. The applicant acquires the status as a member from this point. In addition, CAMPFIRE will not accept an application in the following cases.

  • (1)​ ​ If there is a fabrication, misinformation or omission in the information provided to CAMPFIRE at the time of application. (hereinafter referred to as "registration information")
  • (2) If your membership has been suspended in the past, or you are found to have fallen under any of the reasons for suspension​ ​
  • (3) When it is recognized that there is a risk of violation of the agreement set forth in Article 26, paragraph 1.
  • (4) When the reasons specified in Article 27 are recognized.
  • (5)​ Anything CAMPFIRE decides that it is inappropriate to register.

Section 3CAMPFIRE is not obligated to disclose the reason of not accepting the consent of the preceding article to the applicant.

Article 3 (Management of Member ID and Password)

Item 1 Members shall be responsible for the management and storage of member IDs and passwords granted to members by CAMPFIRE. Members must periodically change the password they have set to prevent unauthorized use.​ ​

Section 2​ Members may not allow any third party to use, transfer, mortgage, or dispose the Member's ID and password.

Section 3​ Members shall be responsible for any damage caused by inadequate management of member IDs and passwords, faults upon use, use by third parties, etc., and CAMPFIRE shall not be responsible for any of them.

Section 4If the member's member ID or password is leaked to a third party, or suspected to be being used by a third party, the member shall immediately notify CAMPFIRE, and shall comply with CAMPFIRE's instructions. In this case, CAMPFIRE shall be able to suspend the member ID and password, etc. as an unauthorized account.

Article 4 (Changes in notification items, etc.)

1項会員は、入会申込の際にCAMPFIREに提供した登録情報に変更があった場合は、遅滞なくCAMPFIREに当該変更事項にかかる情報を提供するものとします。

Section 2 Members must respond to any request from CAMPFIRE for disclosure of identification documents or other information regarding membership.​ ​

Article 5 (withdrawal)

Item 1Members can cancel their CAMPFIRE membership through prescribed procedures.

Section 2In the event of the death of a member or any other reason that makes the use of the member's membership impossible, CAMPFIRE will assume that the member has resigned at that time, and will suspend the use of the member ID and password.

Article 6 (Suspension or cancellation of membership)

Item 1 CAMPFIRE shall be able to suspend the membership or cancel the membership registration without any prior notice or warning to the member in case of the following reasons​ ​

  • (1)​ When a member uses or allows the member ID or password or the Service to be used illegally
  • (2)​ Fabrication, misinformation or omissions in all or part of the registration information provided to CAMPFIRE
  • (3)​ Whether on purpose or not, when damage is caused to CAMPFIRE or other users, external social networking service providers and other third parties.
  • (4)​ If you interfere with the operation of the Service in any way
  • (5)​ Failure to meet payment obligations (including fund payments) by the due date
  • (6)​ Seizure, provisional seizure, provisional disposition, compulsory execution, bankruptcy, civil rehabilitation, corporate reorganization, or special liquidation is filed against a member, or if a member files a claim for bankruptcy, civil rehabilitation, corporate reorganization, or special liquidation on its own.
  • (7)​ If the password has been entered incorrectly more than the number of times specified by CAMPFIRE
  • (8) If there is no use of the Service within the period of time specified by CAMPFIRE​ ​
  • (9) If your registered email address or phone number is no longer available and CAMPFIRE is unable to contact you.
  • (10) If a member violates any of the terms of this Agreement​ ​
  • (11)​ When it is found that there is an illegal, inappropriate or any other problems with the account of a financial institution to which the user has registered
  • (12) When it is recognized that there is a risk of violation of the agreement set forth in Article 26, paragraph 1​ ​
  • (13) When the reasons specified in Article 27 are recognized​ ​
  • (14)​ Other reasons where CAMPFIRE determines that you are unqualified to be a member.

2項プロジェクトが成立した後に、会員が前項の各号に該当することが判明した場合、CAMPFIREは、(ⅰ)会員が支援者の場合は、当該支援を無効とし、払い込まれた支援金はCAMPFIREの定める手続きにより返金、(ⅱ)プロジェクトオーナーの場合は、プロジェクトの掲載を直ちに中止し、成立したプロジェクトを不成立とすることができます。

Section 3​ CAMPFIRE may temporarily suspend the use of the service of the member in the case of reasonable suspicion that falls under any of the items of paragraph 1.

Section 4CAMPFIRE shall not be responsible for any damage caused to members due to the actions taken by CAMPFIRE in accordance with this article.​ ​

Article 7 (Use of services without member registration)

Item 1​ You may use a part of the Service as a guest user without registering, only when CAMPFIRE approves it. Guest Users may use the Service only if they have read the Terms and conditions and the CAMPFIRE Privacy Policy carefully and agree to abide by them.

Section 2 CAMPFIRE may not approve the use of the Service by Guest Users if any of the reasons set forth in Article 2.2.2 are recognized. In this case, CAMPFIRE is under no obligation to disclose the reason for the disapproval.​ ​

Section 3 The email address registered in CAMPFIRE by the Guest User shall be treated in accordance with the ID and password in Article 3.​ ​

Section 4CAMPFIRE is able to immediately suspend the use of the Service by Guest Users in case the reasons stipulated in Article 6.1 are recognized. In this case, the treatment shall be in accordance with Article 6, paragraphs 2~4.

Chapter 2 Services provided by CAMPFIRE

Article 8 (Contents of the Service)

This service is a platform for members to become project owners and backers of posted projects, and for an unspecified number of other users to become backers and provide financial support for those projects. The Service includes the following services with different service providers and service contents. The details of each service are set forth in the By-laws as necessary.

Article 9 (contract parties)

Item 1​ If the project is successful, a support contract will be established between the project owner and the backer. CAMPFIRE, the provider of the platform, is not a party to the supported agreement.

Section 2 CAMPFIRE may take out insurance in the event that a project owner fails to deliver a return. CAMPFIRE's inclusion of insurance is a matter of customer service only, without any liability to CAMPFIRE for the performance of the return.

Chapter 3 Rules for Project Owners

Article 10 (Eligibility)

Item 1​ In order to solicit support from the backers as a project owner, you must meet the following requirements

  • (1) Be a CAMPFIRE member
  • (2)​ Must be at least 20 years old. (If you are a minor, individual consent from your legal representative is acceptable)
  • (3)​ You must have an address in Japan, a telephone number (including a mobile phone number), a bank account in your name, and an ID (driver's license, passport, health insurance card, etc.) or student ID issued by a public institution. However, if CAMPFIRE approves it individually, a user who does not have an address in Japan can become a project owner.

Section 2 If CAMPFIRE deems it necessary, the user who applied to the project owner must provide the above certification documents or information

Article 11 (Obligations of the project owner)

Item 1​ The project owner must comply with the Act on Specified Commercial Transactions, the Act against Unjustifiable Premiums and Misleading Representations, and other related laws and regulations when posting the project and providing returns. If you are a "seller" under the Act on Specified Commercial Transactions, you must post a description under the Act on Specified Commercial Transactions on a page that can be accessed by linking to the project page, such as the project page or the project owner's profile page.

Section 2If you set up a return that is applicable to the following, please include the permit number, the name of the person in charge of management, and the legally required information on a page that can be linked from the project page, or the project owner's profile page.

  • (1) Second-hand goods: curio dealer license
  • (2) Liquor: Mail-order liquor retail license
  • (3) Food: Business license based on the Food Sanitation Law
  • (4) Pharmaceuticals and medical devices: Permission under the Pharmaceuticals and Medical Devices Act
  • (5) Other cases where qualifications, etc. are required in laws and regulations

Section 3​ The project owner is required to carry out the posted project on his own initiative, and to ensure the return of the project when the project is successful. It is not possible to post a project whose execution is uncertain.

Section 4 Project owners must not impersonate others (including individuals and corporations) for any reason. The project owner must make a truthful statement of all facts, including the name of the person or organization, in the project application and posting.​ ​

Section 5 The project must specifically specify its purpose, activities, etc. In addition, it is prohibited to include any content that may contradict or mislead each other with respect to the duration of the project, the content of the return or the relationship with the amount of support. Images that do not relate to the content of the project are not allowed to be used.​ ​

Article 12 (Prohibitions)

We will not allow a project to be posted if the content of the project or return falls under any of the following​ ​

  • (1) The content of the project or return does not comply with laws and regulations, or is likely to do so.
    (Examples of these)
    • Violation of any intellectual property rights, including copyrights​ ​
    • Handling of food in a manner that is contrary to the obligations under the Food Sanitation Law and the Food Labeling Law
    • Treatment of alcoholic beverages in a manner that violates the duties under the Liquor Tax Act​ ​
    • Handling of cosmetics and medical products, etc. that are contrary to the regulations stipulated by the Act on the Assurance of Quality, Efficacy and Safety of Pharmaceuticals and Medical Devices, etc.
    • Handling of pharmaceuticals and medical devices, etc. that are contrary to the regulations stipulated in the Pharmaceutical and Medical Devices Law
    • Handling of animals in response to violations of regulations concerning the animal handling business​ ​
    • Provision and handling of tourism services in violation of the Travel Agency Law, Road Transport Law, and other regulations​ ​
    *The above is only an example. The existence of legal restrictions and their implementation must be carried out by the project owner, who is a party to the support contract, and CAMPFIRE is not responsible for them.
  • (2)​ If the products or services handled in the project or return violate, or are likely to violate the law.​
    (Examples of these)
    • Weapons, firearms
    • Stimulants, narcotics, psychotropic drugs, poisons, deleterious substances, etc.
    • Tobacco, nicotine-containing liquid
    • Explosives
    • Products banned by law for preserving seeds, such as ivory
    • Prostitution or acts against sexual morality
    • Gambling, buying and selling lottery and related activities
    *The above is only an example. The existence of legal restrictions and their implementation must be carried out by the project owner, who is a party to the support contract, and CAMPFIRE is not responsible for them.
  • (3) The Financial Instruments and Exchange Act applies or is likely to apply to the project or the content of the return. In addition, if it falls under or is likely to fall under the prepaid means of payment or virtual currency specified in the Funds Settlement Act.
  • (4)​ To provide any of the following products or services related to the project or return as determined by CAMPFIRE of encouraging criminal activity or on a moral basis
    • Airgun, stun gun, tear spray
    • High-priced products advocating good luck, evil charm, and health benefits
    • Infinite chain lectures, those that fall under or may fall under the MLM
    • Very expensive jewelry and other goods
    • Products that can be distributed through cash vouchers, gift certificates, coupons, etc.
    • Things that are recognized to be extremely enthusiastic
  • (5) If the content of the project or return is harmful or likely to be harmful to the rights of any other person, such as portrait rights, privacy rights, personal rights, etc.​ ​
  • (6) The content of the project or return contains content that constitutes or may constitute discriminatory expression on the basis of nationality, ethnicity, race, social status, gender, ideology, religion, medical history, education, age, etc.​ ​
  • (7) If the content of the project or return is deemed to be the provision or expression of goods or services that are inappropriate from the perspective of youth protection and development.
  • (8) When it is recognized as the purpose of an extremely specific individual​ ​
  • (9) If you intend to donate to a third party (except when CAMPFIRE approves it individually)​ ​
  • (10)​ When dealing with goods and services that are generally available on the market or goods that have a fixed price but for which you are not the manufacturer or seller
  • (11) If there is a significant difference between the list price of the product and the price of the return
  • (12) If it is intended for political or religious activities, or when it is recognized that there is a risk of such activities
  • (13) If a project or return is deemed incompatible with the service itself or with the philosophy of CAMPFIRE.
  • (14) In other cases where CAMPFIRE deems it inappropriate to post the project.

Article 13 (application and publication)

Item 1To solicit support as a project owner, you must fill out the input form and apply for it. In addition, if there is a separate request from CAMPFIRE, you have to submit the necessary information and documents separately.​ ​

Section 2 CAMPFIRE reserves the right to reject the posting of a project in the event that any of the following circumstances are identified​ ​

  • (1) When it cannot be confirmed that the person is qualified for the use of Article 10
  • (2) If the information you applied at the time of application contains information that is not true
  • (3) If the content of the project or return conflicts with the prohibitions set forth in the preceding article​ ​
  • (4) If it is found that there is a reason for suspension of membership as stipulated in Article 6.1
  • (5) In the event that CAMPFIRE deems the project to be inappropriate for posting

Section 3CAMPFIRE reserves the right to disapprove and suspend the posting of a project if any of the circumstances described in the previous section become apparent after the project has been posted.​ ​

Section 4If there is a reasonable doubt about the circumstances, described in each item of paragraph 2 after the project is posted, CAMPFIRE may temporarily suspend the posting of the project while it is necessary to confirm the facts. The project owner must cooperate with CAMPFIRE as necessary to verify the facts.

Section 5 CAMPFIRE is not obliged to disclose the reason when the application is disapproved or the posting is stopped due to the circumstances specified in paragraphs 2~4.

Section 6 CAMPFIRE shall not be responsible for any damage caused to members due to the actions taken by CAMPFIRE in accordance with this article.​ ​

Article 14 (Project type and establishment)

Item 1 Projects can be weather purchased-type-project or donation-based-project, depending on the content of the support contract.

  • (1) Purchase-type-project
    A purchase-type-project is a project in which the support contract between the project owner and the backer is a paid contract, including a purchase agreement. The project owner will provide the supporters with a return in exchange for a support contract.
  • (2) Donation projects
    A donation-based project is one in which the support contract between the project owner and the donor is a pro bono contract, including a donation, when the project is established. The project owner will provide supporters with a return gift as an appreciation for their support.

Section 2 There are two types of projects, the All-or-Nothing method and the All-In method, depending on the different conditions of establishment.​ ​

  • (1) All-or-Nothing method
    At the end of the application period, the project will be completed when the target amount of support for the project is reached, and the money raised will be paid to the project owner. If the amount of support does not reach the target amount within the application period, the project will be discontinued.
  • (2) All-in method
    The project will be completed when the support for the project reaches at least 1 yen during the application period, and the money collected will be paid to the project owner regardless of whether the target amount is reached or not.

Article 15 (Fees for project owner)

If the project is successful, the project owner shall be obligated to pay a certain percentage of the total support amount to CAMPFIRE as a commission and settlement fee. The percentage of fees and settlement fees for each service and the method and timing of payment shall be determined in the By-laws.

Article 16 (Provision of returns)

Item 1 The project owner must set up a return within the range of the amount of money supported by the backers in advance. For donation-type projects, set up a return that is appropriate to give credit for the act of giving.

Section 2​ If the project is successful, the project owner will provide a predetermined return to the backers.

Section 3 When a project is established, the project owner shall send returns, after clearly stating the time of dispatch. If delays occur due to various circumstances, the project owner shall contact the appropriate supporter as soon as possible, and CAMPFIRE shall have no responsibility for such delays.

Section 4If there is an inquiry about the return, the project owner shall respond to the inquiry on its own responsibility.

Section 5In the case of purchased-type-projects, returns cannot be changed or cancelled. If the project owner needs to change the contents of the return due to unavoidable circumstances, the project owner shall obtain the individual consent of the backers at his own risk, and shall change the return only to the extent that the consent has been obtained.

Section 6 If the project owner needs the supporter's personal information (address, telephone number, email address, etc.) in order to provide a return, the project owner shall obtain such information using the method specified by CAMPFIRE. In this case, the backer's personal information will only be available to the extent necessary to fulfill the return. In order for the project owner to use the supporter's personal information for purposes other than fulfilling the return, the project owner must obtain individual consent from the supporter at his own risk. In addition, the management of the acquired personal information is the responsibility of the project owner, and CAMPFIRE is not responsible for any damages caused by information leaks and other troubles.

Article 17 (Cancellation of project)

Item 1Once a project is posted on the service, it cannot be withdrawn without the consent of CAMPFIRE, nor be changed in terms of the call period, the target amount, or the content or amount of the return. However, if the project owner judges that the project cannot be continued for unavoidable reasons, and the project owner promptly notifies CAMPFIRE, and CAMPFIRE consents it, the project can be terminated. In this case, the project owner is required to pay a certain cancellation fee as stipulated by CAMPFIRE (the details are stipulated in the by-laws).

Section 2​ In the case of the preceding paragraph, the project owner shall explain the circumstances of the cancellation to the backers in the manner prescribed by CAMPFIRE, and shall take responsibility for each inquiry.

Article 18 (Problems related to the project)

Item 1​ Any troubles, requests for refunds, or other disputes between the parties that arise during the course of the project activities should be resolved between the project owner and the backers and CAMPFIRE will not be responsible for any such disputes.

Section 2 In order to ensure the soundness of this service, CAMPFIRE may check the facts with the parties and the users must cooperate with this.

Article 19 (Payment of support money)

Item 1 The Project Owner grants CAMPFIRE the authority to receive the support money paid by the supporter on behalf of the Project Owner, and when CAMPFIRE receives the support money paid by the supporter under the support contract on behalf of the Project Owner, the supporter's obligation to pay the support money has been fulfilled.​ ​

Section 2 If a project is successful, CAMPFIRE will pay the project owner the support money received on behalf of the project owner by the method prescribed by CAMPFIRE. In this case, CAMPFIRE will bear the transfer fee.​ ​

Section 3 CAMPFIRE shall deduct any fees and any other obligations that the project owner owes to CAMPFIRE when paying the support money to the project owner. The method of payment of the support money is set out in the bylaws according to the service contents.​ ​

Chapter 4 Rules for Backers

Article 20 (Eligibility)

Item 1In order to support the project as a backer, you must have an address in Japan (meaning you have a certificate of residence). If CAMPFIRE allows backers who only have an oversea address for each project or return, users who do not have an address in Japan can also become backers.

Section 2​ If CAMPFIRE deems it necessary, the user who becomes a backers must provide a copy of the resident's card or documents that CAMPFIRE requires.

Article 21 (Support for Project)

Item 1Users can apply for support for the project in the manner prescribed by CAMPFIRE. Upon completion of the application for support, a support contract will be concluded on the condition that the project is completed.​ ​

Section 2​ CAMPFIRE may reject an application for support if any of the reasons described in Article 6.1 are recognized.

Section 3When applying for support, the user must understand and agree to the terms and conditions for each eligible project, and the user who applies for support is deemed to have agreed to these terms and conditions.

Section 4​ CAMPFIRE will be able to display the support status of the backer in the project page when the support contract is concluded. However, we are not obliged to indicate the support status of the supporters.

Article 22 (cancellation of support)

Item 1Supporters may not cancel their support for a project for which they have declared their support. However, depending on the type of service, it can be cancelled only if it is specified in the by-laws.

Section 2 If CAMPFIRE finds that:

  • (1) If the payment using the CAMPFIRE method is not completed within 30 days of the end of the call period.
  • (2) If it is impossible or extremely difficult to fulfill the return to the backers.

Section 3CAMPFIRE will not be obliged to refund the support money for any reason, such as if the project is not able to proceed after the end of the call period, or if the return is delayed or not able to be fulfilled.​ ​

Article 23 (Acquisition of return)

Item 1 If the project is successful, the supporters of the project shall have the right to get the return determined by each project to the project owner, subject to the completion of the settlement procedure of the support money by the method prescribed by CAMPFIRE.​ ​

Section 2​ Backers may not change, cancel or request a refund for any selected return. However, if there is an individual agreement between the project owner and the backers, that agreement will take precedence.

Section 3​ The project owner is responsible for the performance of the return in accordance with the support contract, and CAMPFIRE is not liable for the performance of the return or for damages caused by the non-performance of the return.

Article 24 (In case of project failure or cancellation)

Item 1If the project is unsuccessful, if the project is unlisted in accordance with Article 13.3, if the project is cancelled in accordance with Article 17.1, or if the support is cancelled in accordance with Article 22.2.2, CAMPFIRE will refund the support money to the backers who have completed the settlement procedure of the support money by the method prescribed by CAMPFIRE. In this case, the backer must cooperate with CAMPFIRE's refund process.

Section 2 CAMPFIRE will bear the remittance fee in the case of the previous section.​ ​

Article 25 (Method of Support, Fee)

Item 1​Backers will pay the support money according to the method set by CAMPFIRE. CAMPFIRE will receive the support money on behalf of the project owner. The payment of the support money is completed when the backer pays the support money to CAMPFIRE.

Section 2​ When a backer pays the support money, a system usage fee will be charged to CAMPFIRE. (which is separately stipulated in the by-laws)

Chapter 5 Rules for All Users

Article 26 (exclusion of antisocial forces)

Item 1The user shall not fall under any of the following. A member of a gangster group, a person who was a gang member until less than 5 years ago, gangster related company, extortionist, terrorist, etc. (Anyone who involves in antisocial forces). The Company shall not fall under any of the following items, now or in the future, and shall use itself or a third party to make violent or unreasonable demands, beyond legal responsibility, threatening words and actions or using violence in relation to transactions, spreading rumors, damaging the credibility of CAMPFIRE by using false economy or force, or obstructing the business of CAMPFIRE, and other similar acts (hereinafter collectively referred to as "unreasonable demands, etc."). In addition to the above, please confirm that it will not do so.

Section 2 The "symbiote of a gang member" set forth in the preceding paragraph means one that falls under any of the following.

  • (1)​ A person who has a relationship in which a member of a gang member, etc. is deemed to control the management
  • (2) A person who has a relationship in which a member of a gang member, etc. is found to be substantially involved in the management
  • (3)​ A person who has a relationship that is recognized to be unfairly using gangster members, etc., such as for the purpose of gaining unfair advantage for oneself or a third party, or for the purpose of causing damage to a third party.
  • (4) A person who is deemed to be involved in providing funds, etc. or providing benefits to a member of a gang member, etc.
  • (5) A person who has a socially reprehensible relationship with a member of a gang member, etc.
  • (6)​ Any other person who takes advantage of the fund-raising activities of gang members, etc., or seeks to expand their own profits by using the power, information, or financial power of gang members, etc.

3項CAMPFIRE shall immediately stop providing this service to the user in case the user violates the agreement in section 1. In this case, CAMPFIRE, payment agents, affiliated card companies, and other third parties are not allowed to make any claim for compensation for any damage, etc., that may occur to the user.

Article 27 (Prohibited acts)

Item 1 When using the Service, the User shall not perform any of the following actions or any actions that may cause it.

  • (1) The act of using the Service for the purpose of misconduct
  • (2) Acts that violate the intellectual property, portrait right, publicity right or other rights of CAMPFIRE, other users or other third parties
  • (3) Acts that damage the reputation or credibility of CAMPFIRE, other users or other third parties, or an act that will infringe on privacy.
  • (4) Acts that lead to crimes such as fraud
  • (5) Sending or providing harmful programs such as computer viruses, or an act that recommends them.
  • (6) The act of falsifying or deleting information of CAMPFIRE, other users, or other third parties.​ ​
  • (7) Unauthorized use of the facilities of CAMPFIRE, other users, or other third parties, or any act that interferes with their operation.​ ​
  • (8)​ Acts that violate laws, these Terms and Conditions, the By-laws, or public order and morals​​.
  • (9) Interfering with the operation of this service
  • (10)​ Using the message function of this Service for any other purpose.
  • (11) Any other actions that CAMPFIRE deems inappropriate.​ ​

Section 2 In the event that CAMPFIRE suffers any damage due to the user's conduct in any of the preceding paragraphs, CAMPFIRE shall be able to claim compensation for damages against the user.​ ​

Article 28 (Handling of personal information)

Item 1 CAMPFIRE may use the personal information provided by users to the extent necessary to provide the Service and for the purposes set forth in the CAMPFIRE Privacy Policy, and users must agree to CAMPFIRE's handling of personal information provided by users in accordance with this Privacy Policy.

Section 2When a funding contract is concluded on the Service, the supporter agrees to provide the project owner with the supporter's name, address, amount of support, contents of the selected return, message to the project owner, and other information necessary for the performance of the return for the purpose of using the provision of the return.

Section 3The parties here to agree that CAMPFIRE may provide necessary information such as your name, address, project content, and funding content to the extent necessary to process a claim for such insurance.

Article 29 (Confidentiality)

Item 1In this Agreement, "Confidential Information" means all information about CAMPFIRE's technology, sales, business, business, finance, organization, and other matters that have been provided or disclosed by CAMPFIRE in writing, orally, or in recorded media, etc., or have been learned by the User in relation to the Terms and Conditions or the Service. However, Confidential Information shall be excluded if (1) it has already become or was already known to the public at the time it was provided or disclosed by CAMPFIRE, (2) it has become known to the public through publications or other means for reasons attributable to the user after it was provided or disclosed or learned from CAMPFIRE, (3) it was acquired legally without being obliged to maintain confidentiality from a third party authorized to provide or disclose it, (4) it was developed independently without any confidentiality, (5) it was confirmed in writing by CAMPFIRE that there is no need for confidentiality.

2項The user shall use the confidential information only for the purpose of use of this service and shall not provide, disclose or leak the confidential information of CAMPFIRE to third parties without prior written consent.​ ​

Section 3 Notwithstanding the provisions of the preceding paragraph, you may disclose confidential information to the extent that there is a legal basis for doing so, in accordance with the law, court or governmental order, demand or request. However, you must promptly notify CAMPFIRE of any such orders, or requests.​ ​

Section 4 If you want to reproduce a document containing confidential information or a magnetic recording medium, etc., the user shall obtain the prior written consent of CAMPFIRE, and the management of the reproduction shall be done strictly in accordance with paragraph 2.

Section 5 Whenever requested by CAMPFIRE, the user must return or destroy the confidential information and any written or other recording media containing the confidential information, and all copies thereof, without delay and in accordance with CAMPFIRE's instructions.

Article 30 (Contact / Notification)

The user agrees to send information about this service, announcements about system maintenance, and other communications or notifications from CAMPFIRE to the user by e-mail or other methods CAMPFIRE provides. Communications or notifications from CAMPFIRE to the user shall be deemed to have reached the user by sending them to the contact address that the user has applied to CAMPFIRE.

Article 31 (Change, Addition or Discontinuation of the Service)

Item 1CAMPFIRE may, at any time, change or add to the contents of the Service (hereinafter referred to as "Changes"). or may be abolished. If a change in the Service has a significant impact on users, the content of the change will be posted on the CAMPFIRE website. In addition, the discontinuation of the Service shall be notified to the User in advance by the method prescribed by CAMPFIRE.

Section 2​ CAMPFIRE shall not be responsible for any damage caused to users taken by CAMPFIRE based on this article.

Article 32 (Suspension of the Service)

CAMPFIRE may suspend or discontinue part or all of the Service without prior notice to users in any of the following cases, and shall not be liable for any damage caused to users due to such suspension or discontinuation.

  • (1) To perform maintenance or inspection of equipment or systems for the provision of the Service​ ​
  • (2) When the operation of the Service is difficult due to fire, power failure, earthquake, natural disaster, system failure, etc.​ ​
  • (3) In the event of any trouble, interruption or suspension of service, suspension of cooperation with the service, or specification change in the external SNS service​ ​
  • (4)​ Any cases if CAMPFIRE deems it unavoidable to stop or suspend the service.

Article 33 (Disclaimer)

Item 1 The Service provides a venue for the User to transact business as a project owner or supporter and does not guarantee to the User that the project will be executed on time.​ ​

Section 2In relation to this service, any trouble that arises between users, including between project owners and supporters, shall be handled and resolved by users at their own risk, and CAMPFIRE shall not be responsible for any such matters.

Section 3​ CAMPFIRE is not responsible for the failure of this service to work with external social networking services, however, we do not guarantee such cooperation. In the case that this service is connected with external SNS service, users shall comply with the terms and conditions of external SNS service at their own expense and responsibility.

Section 4 CAMPFIRE does not guarantee that users will not be damaged by computer viruses or other harmful programs when using this service.​ ​

Section 5CAMPFIRE does not warrant the operation of any equipment or software used by users to use this service.​ ​

Section 6 CAMPFIRE shall not bear any communication costs incurred by users when using the Service.​ ​

Clause 7CAMPFIRE shall not compensate for the user's lost profits, indirect damages, special damages, extended damages, attorney's fees, etc., except in the case of willfulness or gross negligence of CAMPFIRE, and even if CAMPFIRE is liable for any reason, CAMPFIRE shall not be liable to compensate for the user's damages beyond the amount of the total amount paid by the user to CAMPFIRE for this service.​ ​

Section 8The reference time of this service is the time managed by CAMPFIRE's server, system, and may not match or operate with the actual time or the time displayed by this service. Users shall use this service with the understanding in advance.

Section 9 CAMPFIRE will not be involved in the taxation at all, and users are responsible for confirming and dealing with the existence of taxation and the amount of taxation, etc. at their own risk.

Article 34 (Attribution of rights)

Item 1 All ownership and intellectual property rights related to the CAMPFIRE website and the Service belong to CAMPFIRE or those who have licensed to CAMPFIRE, and the license to use the Service based on the registration stipulated in these terms does not imply the license to use the intellectual property rights. The user shall not engage in any activity (including, but not limited to-disassembly, decompilation, and reverse engineering). However, the rights to the materials such as photographs provided by the Project Owner for the Project and the goods or services covered by the Project shall be reserved to the Project Owner.

Section 2​ The text, images, videos, and other data (including those stipulated in the proviso of the preceding paragraph) posted or otherwise transmitted by users on the CAMPFIRE website or this service will be freely used by CAMPFIRE without charge (including reproduction, copying, alteration, sub-licensing to third parties, and any other use).

Section 3​ You may reprint the URL and embed code of the project, the project title, the text and images of the project outline, and the profile of the project owner on the Internet and external social networking services as long as the content of the project does not infringe on the honor and other rights or interests of CAMPFIRE, the project owner, or any other third party. Any reprinting shall be subject to the approval of CAMPFIRE.

Article 35 (Changes to these Terms)

When CAMPFIRE changes these terms and conditions, CAMPFIRE shall notify users of such changes by the method prescribed by CAMPFIRE or announce them on the CAMPFIRE website. However, CAMPFIRE shall obtain the user's consent for any changes to the content of the site that are legally required by law.​ ​

Article 36 (Transfer of status, etc.)

Item 1You may not assign, transfer, mortgage, or otherwise dispose of your position under the Terms and Conditions or your rights or obligations to any third party without the prior written consent of CAMPFIRE.

Section 2In the event that CAMPFIRE transfers the business of the Service to another company, CAMPFIRE may transfer the status on the Terms and conditions, rights and obligations under the Terms and conditions, user's registration information and other information to the transferee of the business in conjunction with the transfer, and the user agrees in advance to such transfer in this section. The transfer of business as set forth in this paragraph shall include not only ordinary transfer of business, but also any case in which the business is transferred.

Article 37 (Partly invalid, etc.)

Item 1​ If any provision of this agreement is held to be invalid, in whole or in part, under any law or regulation, such provision shall be construed to conform as closely as possible to the original intent, and the remainder of the agreement and other provisions shall remain valid.

Section 2​ If any provision of this agreement is held invalid or revoked in relation to one user, this agreement shall remain in effect in relation to any other user.

Article 38 (Governing law and jurisdiction of agreement)

Item 1 These Terms and Conditions shall be governed by and construed in accordance with the laws of Japan.

Section 2​ The Tokyo District Court shall be the exclusive jurisdictional court of first instance for any disputes arising out of the Terms and Conditions.
