      しかし、元より（人道と人権の差異を捨象した雑な言い方をすれば）人権擁護団体である赤十字に条約-国内法体系への違背が疑われる際の人々の批判がより程度の強いものとなるのは必至だろう、ただそうした批判は、ガイドラインには拘束力があるのだから従えというのとは違う、といった話をしています。

      そのあたり、国内法規と日赤の関係というドメスティックな次元と、国際法／条約と国際赤十字運動の関係というインターナショナルな次元の両方まで視野に入れないと上手く解けないように思いますね。 日赤は日本国内法にしか縛られないというような議論は、そもそも赤十字運動の土台を掘り崩すのでは。

      まあしかしアレだ、国際条約（人権法）の影響力を完全に捨象した「日本政府が作ったガイドラインに民間団体たる日赤は拘束されない」というような故意に矮小化された論拠で持って擁護（？）されちゃう日赤もいい面の皮であろうな。今頃苦笑いしてるだろう。
