      ガイドラインとは「自発的に従うのが望ましい」という性質の規範であり、むろん従わずとも罰則はないが、自発的に従う分には別に何ら自由権を侵害するものではない。 また、少なくともそうした規範が「是である」ことに関してはコンセンサスが成り立っているからこそ成文規範になっているわけで。
