but the court could also go full bants and rule all over the show i.e majority thinks its justiciable but not unlawful. Minority think its justiciable and unlawful and one who thinks it's neither!
Could this happen, and divide the country? 5 say it's not justiciable, 6 say it is. So those 5 are forced to give their opinion on lawfulness. Those 5 and one more say it's unlawful, while the 5 still maintain it's none of their business.
