The United Nations are planning to change its definition of “child pornography” to include work that do not involve actual children. At first glance, that sounds like a good idea, but let me show you why it is not.
I have not come to comment on these articles in this blog yet, but the articles Pornography and Sex Crimes in Czech Republic and Pornography, Rape and Sex Crimes in Japan show that the presence of pornography in a particular territory reduces the rates of sexual crimes in that territory. In particular, the presence of child pornography in these territories seems to have reduced the rates of child sexual abuse. Of course there is child pornography that is done by taking advantage of children or even hurting them, but if such pornography does not involve actual children, the benefit is kept and no child is injured in the process. Maybe that explains why the rates of child sexual abuse in Japan are lower than the same rates in the United States and the United Kingdom, which are two nations among the five with the most cases of child sexual abuse in the world! How can it be? Simple: Japan, Czech Republic and a few other places allow pedophiles, for example, to have alternatives for sexual gratification. If there is no alternative, what are they going to do? Sex! But sex with adults or children? Are you seeing my point? Knowing this, there are scientists who are studying the possibility of “prescribing” virtual reality child pornography for pedophiles under treatment or for those who recognize the desire and do not want to break the laws. Thus, to prohibit pornography without real models prevents the continuation of a therapeutic research.
Moreover, since such pornography does not use real models and since it may be beneficial in the long run, prohibiting it is an unnecessary intervention to freedom of expression and artistic freedom. I thought the United Nations were the supreme guardians of human rights, among which is freedom of expression. The only reason for making such a limitation on freedom of speech is the presumption, based only on “icky factor”, that this material increases the rate of child sexual abuse, which no study has been able to confirm. Show me one study that proves that lolicon or shotacon increases the rate of child sexual abuse, only one, and I may even reconsider. But I want a peer-reviewed scientific paper done with non-clinical/non-forensic samples.
What can you do.
The new definition of the United Nations is included between items 61 and 64 of the Optional Protocol to the Convention on the Rights of the Child . This document is being created and the authors are accepting suggestions (in English and Spanish) from any interested party . You do not need a Ph. D. to submit your comments. The comment should specifically cite paragraphs 61 to 64, pages 13 and 14, and should be sent in Microsoft Word format (five pages or less) to the email that will receive the comments ( crc@ohchr.org ). Go there and make me proud.

Commentary on the issue above. That same guy was one the first people to suggest that Japan should stop producing lolicon/shotacon manga. It’s seems like you are worth suspicion when you are too invested in this cause.
Could sex robots and virtual reality treat pedophilia? If you ban porn with fictional children, you forcefully end research on this type of therapy. The idea is to help pedophiles to cope with unchanging feelings, by giving them a substitute for real kids, so they could feel satiated and less inclined to offend.

For the same reason they think that banning cartoons is a good thing: they don’t keep up with the times. If you are scared of giving them a DOC/DOCX file, just remember that you can alter the metadata that those documents send. For example, write the file on Libreoffice, rather than Microsoft Word, and save as DOC or DOCX. It will be saved without things like real name and address that you might have given to Windows during installation of the system or Word. I personally use Libreoffice because it gives me more control over the metadata that I’m sending. If you want to be sure, open the options in Libreoffice and look for the personal data fields, making sure to leave them blank.

“rates of child sexual abuse in Japan are lower than the same rates in the United States and the United Kingdom” … or simply, intergenerational sex acts are not systematically reported in Japan, or if reported they do not necessarily lead to a trial if the affair seems consensual. More sentencing does not mean more crime.

I certainly hope not. On the optimistic side, even though I said it’s less common here than before, it’s still very much a normal sight here. Also, Japan was very reluctant to do away with real CP, and it took a great deal of pressure to cause them to finally cave. On the pessimistic side, they eventually did, and this proposal comes at a very bad time because Japan has a history of submitting to foreign pressure around Olympics time.
Does this proposed ban apply to literary fictional works as well?

Laws reflecting the UN proposal already are in existence in Australia and (most of) the US. This is aimed squarely at Japan, and one can only hope that they will not submit to this type of pressure.

Several manga artists, including hotshots, are sending their comments to the UN. I have sent mine too, even though I’m not an artist. MAPs managed to make some desired changes in DSM in 2011 and managed to keep undesired changes from happening in 2018, if I’m not mistaken. And the ICD, written by the WHO, tended to the changes. Maybe we have a chance of changing the proposal with these comments. We can’t have a mindset of “this isn’t going to work”, because, what if it had chances of working? I wouldn’t forgive myself for not trying. And they are trying.

A lot of people in Japan don’t write well in English, but thankfully some of them are asking for help with the language and receiving such help. I would like to help too, but I have already sent two messages to them, from different e-mails. If I send more messages through those, they will think I’m making replies up.
