This means it's <i>voluntary</i>. There's a difference between voluntary treatment that you know will be uncomfortable temporarily for long-term gain (WP: <i>"ECT is most often used as a treatment for severe major depression which has not responded to other treatment"</i>), and what would classify as cruel and unusual punishment in a legal sense.

... Slight clarification: "severe major depression" is, while linguistically redundant, not technically -- 'major depression' is a specific diagnosis. "Severe major depression" would be within the range of possible suicide, so that'd rather classify as a long-term gain if one could avoid that.
