    ECHR says ' was kept in pre-trial detention at the time of an ongoing debate among the Turkish public about the most significant amendment to the Constitution since 1923.' Unfortunately the Court itself decided after that amendment approved with an unfair referendum.

    * Demirtaş also argued his pre-trial detention did not comply with domestic laws, but the European Court threw this argument out. It said neither the interpretation nor application of Turkish law appeared arbitrary or unreasonable.

    Notably, the Court did not accept all of Demirtaş's complaints. (1) Demirtaş argued he had no access to the investigation file, preventing him from speedily challenging pre-trial detention. The Court agreed with Turkey that the 2016 coup had created extraordinary circumstances.

    Turkey must "take all necessary measures to put an end" to his pre-trial detention, the court ruled. Selahattin Demirtaş has been in pre-trial detention since his arrest on 4 November 2016. In the intervening period, he ran for president from his prison cell.

    OdaTV claims that the investigation of the former owner of Zaman newspaper as "FETÖ" has been dropped, though he admits having been a Gülenist. If this logic were repeated for those who didn't know the president personally the jails would empty.
