Forum Guidelines

Animal Control is for the furry fandom, its members, subcultures, and communities.

  • Hide your powerlevel. Avoid revealing intimate, embarrassing details about yourself in public boards. These threads are not your personal blog and we are not an asylum.
  • Spoiler adult content. Anything you wouldn't want your boss to see on your monitor should be hidden. Don't embed NSFW content in your post directly.
  • Don't white knight. Don't turn threads into an intervention. If you want to help, contact them privately.
  • Avoid politics. Eccentric political views is a frequent component of a person's humor value. Try to avoid debate.
  • No trolling plans. We are not an autistic Illuminati. If you embarrass yourself or the forum trying to troll, we will ridicule you.
  • Archive everything. Use screenshots and archive.is to preserve content forever. Upload directly to posts where applicable.
  • Don't lament about the fandom. People have been critical of the furry fandom since the 90s. The debate is old enough to vote. If you don't want to post here, then don't.

  1. IMVU is, or was, based in California according to some posts in that chain. So it may have been filed there?

  2. It may also have been filed in his home state. I don't know how law works.

  3. It can be filed literally anywhere. If that's the appropriate legal venue or not is a secondary concern. @AnOminous

    kiwifarms.net
  4. It doesn't appear to be in Mountain View, California and I don't know Neer's current location. I did find a 1993 family court case involving him as a minor in a case involving Robert Piche, who I assume is his dad.

Apparently, this dude is named Scott Malcomson and was formerly a Burned Fur, a group of spergy furs who were obsessed with purging porn from the fandom and trying to make it less degenerate, if that could possibly work. WikiFur article.

I'm not sure exactly where it's filed but it doesn't seem to be in Santa Clara or San Mateo counties. I don't know if it actually is filed, really. There's also nothing in federal court naming IMVU or Sean Piche directly.

I assume he'll go into more detail later. There's nothing useful on the Twitter thread yet either. Perhaps anyone who knows this guy should just ask him where he filed it, I mean, not that anyone here would. . .

  5. The fact we have no unified court search system is just mind numbing.

  6. It's too complicated and too completely run by 80 year olds and shit. Also the states couldn't be forced to participate. The federal system is at least reasonably unified, considering its complexity.

If this was literally filed and this thing was sent today, it might just not be indexed yet. If we can't figure it out by Monday I'll trawl the likely courts again.

So far, I've checked San Mateo, Los Angeles and Santa Clara Counties in California. And Maricopa County in Arizona. The one that has me stumped is he could have sued Piche directly, but that guy lives in something called Manassas Park, VA which isn't even in a county. It's an independent city. I think Prince William Circuit Court serves it.

Anyway I don't even know if that address is current. I'll give it a shot later, though who wants to can try. It might post after midnight. Some of these are courts are slow.

He mentions a case he previously filed against Topps over some copyright issue.
    https://www.courtlistener.com/opinion/617902/scott-malcomson-v-topps-inc/

He didn't prevail in court. He said he got what he wanted but I have no frame of reference to know what he wanted and whether that claim is accurate.

  7. Archived and added the Deviantart link to the OP. Archive links in the future, neglecting to do so lets the lolcows purge things if they get word we have found something interesting.

  8. A lot of the old-school furries was hardcore right-wing gun nuts and milspergs, for some reason I haven't found out yet. The proto-bronies with a hard-on for horses tended to be a specific sorts of weird, also.

Since Malcomson lives in Phoenix, there is probably some connection to Jim Groat and the Tucson Mafia. (Why don't you take a seat over there...)

    Also, please enjoy:

  9. He wrote self-insert alternate history fanfiction based on a game of Hearts of Iron 3? Archived it here, even though I just told someone an hour ago to archive their own links.

  11. Probably has something to do with that old Albedo comic that is said to have spawned the fandom. A military space opera. Heard the guy who made it worked as a military illustrator.

  12. Steve Gallacci. It was published by Fantagraphics. It was actually very professionally drawn, probably for that reason. They also published a compilation called Critters with art by various creators, including mainstream stuff like Freddy Milton's Gnuff. Milton was more or less a mainstream Danish artist who had also worked on Disney properties like Donald Duck, in a largely Barks-influenced style. I believe they even let him draw the Mouse.

This was a time where the creepy fandom barely existed, before the first insanely creepy spergs like Dennis Falk became publicly known.

I don't know what happened to Gallacci, but this guy has apparently become what he is now.

Also, if you check the docket for that Malcomson v. Topps case, it goes all the way to the 9th Circuit, where he files a petition for an en banc rehearing and then a cert petition with the Supreme Court. It was denied, but that shows definite industry. If this guy says he's going to sue, I'd believe him. Whoever he's sued other than IMVU and Sean Piche could be tied up in litigation with him for years. He is not just going to go away without being satisfied.

  13. The "creepy" fandom is said to be largely the creation of Mike Hirtes' nemesis Mark Merlino. His orginal idea was to create a more "gay-friendly" attitude within the fandom, but then went on to advertise furry cons in various fetish and other "alternative" groups. That was early-to-mid 1980's stuff.

  14. Gamergate and ponies?
How has this individual avoided the farms this long?

But anyway, I honestly hope he goes far with this lolsuit. Cows attacking cows can only result in great things.

  15. It's all bizarre. He claims all he wanted was to be recognized as an official contributor to Battletech canon. The original case said he failed to demonstrate anything that could make him considered such. But in the 9th Circuit's writing, it said: "The appeals court said that Scott Malcomson had failed to present sufficient factual evidence at trial to demonstrate that his relatively minor contributions to the Battletech mythology qualified him as a joint owner of the gaming franchise."

He's using those words in every forum he posts on to say "See? The court said I'm a contributor, therefore everything I wrote for them that was published (on a fansite not officially run by any of the companies) is now officially Mechwarrior canon!"

Malcolmson went on several forums to post his opinions on the cases. Seems anyone remotely talking about Mechwarrior, he would make an appearance, copy + pasting his side of the story.

The first message appearing on forums.
    Post 9th Circuit.

It looked like there was an edit war on the Sarna.net Battletech wiki, so someone decided rather than just have the back-and-forth insertion and deletion of Malcomson's contribution, they just created a page on the lawsuit itself, from Malcomson's perspective.

  16. Oh wow. I saw the dude's name and I thought Scott Malkinson from South Park. Then seeing what he actually looks like...

Curl up hair, make him larger, and ta-fucking-daa.

So now I have to wonder if Malcomson has diabetes too.

  17. There's a surprising number of furries in the military, especially in the early days, and they've spread a love of guns and freedom to others. For the most part they're pretty decent individuals with strong values, families, and backbones... although I wish they wouldn't refer to their children as "cubs."
However the modern generation of furs tends to include more Social Justice Warriors, so you also end up with a fandom that's a little bit too inclusive and tolerant.

  18. To be honest the whole thing about furfags is just taking some dude with interests and sprinkling some autism on top.

It's not like "Oh most furries are this" it's more like the furfags who hide it well have actual interests beyond poodle poodling.
