Holy shit I didn't know we had a thread on this guy. I did freelance work for him once back in the early 2000s when he was trying to get that stupid Graal Online (Previously titled Zelda Online) project off the ground, right after he just about got his ass torn off for sprite-ripping Link to the Past for all the graphic assets for that 'game' and he had to change the name and have everything redone to look like some MSPaint garbage to avoid a lawsuit. I wish I'd saved even a single document from back at the time, but the long-and-short of it is that Unixmad is a raging shit-bastard and he would very frequently rip people off and steal their work wholesale for use in any of his pet projects, and if you didn't have the foresight to get a contract for it or get paid up-front coming through the door, you weren't leaving with a dime. The significant majority of all the asset work and scripting and netcode and just general content for Graal Online and any of his follow-up projects were literally just stuff that angsty pre-teens coded or designed to try and impress him or just for their own personal use, and then he'd swipe it, slap a pricetag on it and push it out the door as his own, original work. I never in a million years expected that he was still going, or that I'd ever hear that goddamn name again.
That legalese in French is great, it’s fun to see a well-put together lawsuit for something as silly as this. A lot of wonderfully dishonest stuff in there, too. For example, they translate "can be milked for amusement and laughs" as "must be revealed to laugh at them and mock them" (and it’s a strong, imperative "must", like it’s your duty to do so or something). This might seem like a small detail but it gives an entirely different vibe of the site to the poor substitute judge who had to read this, from place to laugh at weird people to righteous crusade against them. It’s not just a language quirk, something that couldn’t be translated well either, there are perfectly good ways to translate the sentence without changing it’s tone. That many "mistakes", mistranslations that work so well for his case, in such an important part of the document ? It’s gotta be intentional. Guy’s got a good lawyer, clearly betting on our notoriously bad English skills.
Do you speak French and know how the law works there? I think this dude lied to the courts and I want to scramble him.
I'm French, don't know much about the laws, though. But he's definitely misrepresenting the site with stuff like this. Edit: I hadn't looked at his lawyer, but Stéphane actually got himself a pretty big name, specialised in new technologies. Guy is very involved in "right to be forgotten" activism, was asked to talk about this for the Senate and the Assembly. Also a lot on robot rights these days, not even kidding. https://www.alain-bensoussan.com/avocat/alain-bensoussan/ https://www.youtube.com/watch?v=rasEKH2B9jw (on the second largest channel, for the evening news) http://www.lepoint.fr/chroniqueurs-...ecifique-aux-robots-20-11-2017-2173686_56.php (interview on the creation of a judicial status for robots, on a well-respected site)
So a French pedo with a dead thread who apparently jacked people's work for shit-tier games decided that now was the best time to try and take KF down? If he was looking for a thread revival, a simple post would be much cheaper and easier.
It seems he tried and failed to revive it posting his credit card info, and then decided he could use that to say kiwis got his info.
Looking through the lawsuit a bit more seriously, now. Yeah, he definitely not just misrepresenting with iffy translation. -Section 38, he says that because the thread appeared in the first pages of results, that suggest you might have "considerably invested" to have your site be better referenced by Google. -Section 40, he says Joshua Moon and Lolcow LLC "can only be empty shells behind which the veritable editor of the site is hiding" -Section 43, he says you're using your anonymity to hide from consequences and that Stéphane couldn't identify you -Section 44 to 47, he says Stéphane is not suing you directly because he fears more mockery, because he fears the Streisand effect (good job on that one, Stéphane), and because it would bump the thread (good job again)
I don't know shit about how the law works in France, but I've translated what the guy said about the site (note that my vocabulary on anything law-related is sorely lacking, so I did the best I could): Spoiler: Legalese 3. Harmful Content 3.1 The publications 6. The website www.kiwifarms.net is a discussion forum, in English, where users from all over the world gather to indulge in doxxing and trolling. 7. This website allow its users to create, under the veil of anonymity, threads to show the other users: - links to press articles, pictures, videos or other types of contents published on other platforms - simple messages or questions to start discussions 8. Those threads are sorted by categories. The most popular category being "Lolcows", these lolcows being defined by the website as persons or groups whose eccentricity or stupidity must be revealed in order to have fun and mock them. 9. Users can post in every thread. 10. Several users have posted in a thread named "Stéphane "Unixmad" Portha", which was created on August 10th, 2015 by a user whose pseudonym is @CIA. 3.2 The Kiwi Farms website 12. Active since 2007, this website has become known in the entire world for the violence of its users' posts and the numerous legal proceedings started by victims to get the content harmful to their dignity deleted. 13. Trying his hardest to be provocative, the site admin even thought it a good idea to dedicate an entire section of the forum, named "Take that off the god damn Internet", to the requests and legal proceedings allegedly addressed to him. (14. and 15. are just the site's hosting and contact info) 16. Joshua Moon has his own web page, which details his career and, without any evidence, his alleged criminal activities such as death threats, rape threats, xenophobia and child pornography. (17. is Null's policy on removing content) 18. Mr Stéphane Portha tried and failed to contact the site admin to obtain the removal of the content related to him, even though the admin's policy on removing content made it clear the only response would be a categorical refusal. 19. Mister Stéphane Portha was thus forced to directly contact Google to enforce his right to oblivion and obtain the removal of the two pages from the search engine. 20. Google rejected without any inquiry the request of Mr Stéphane Portha, since while the content is indeed about his private life, "the URL in question is about interrogations that are of particular interest to the public regarding your professional life. For example, they may be of interest to the people considering using your services, or those that are already using them. The information regarding your employment history or recent workplaces may also interest the people considering using your services, or those that are already using them. Thus those documents being listed in the results of typing your name into the search engine is justified by the interest of the public in accessing them." 21. On the contrary, the content in question is related solely to private matters and has no link to the professional activity of Mr Portha or Eurocenter Games. 22. Mister Portha then immediately brought the dispute to the CNIL, whom to this day hasn't followed through.
I'd be curious to check the history of the account that posted it and only that (from what I gathered) and then check the IP. Just out of curiosity, of course.
I get that the pedophilia jokes/accusations could possibly be viewed as libel (if they don’t have substantial proof to back them up) and would therefore be illegal. But calling someone an asshole or a twat is perfectly legal. What, are people trying to ban name-calling now?
Didn't you decide to delete all visitors' IPs every 24 hours for security reasons after Vordrak managed to bring down the forum and wanted to trace back all the users?
This paragraph gave me a chuckle. Edit Considering what others have said about his politics this seems like a calculated decision to make a statement. I don't think he is actually interested in winning of getting money so much as vilifying the internet for his own motives. Also, considering that he's a conman & a potential sexual predator it's not surprising he wants the "right to be forgotten" so his potential victims would be none the wiser.
I had to pull out an old archive of the site to dig through it. This is what I get now just trying to use the site.
