It’s unwise to argue law with a prepared lawyer even if you ARE a lawyer, unless you are also a prepared lawyer. However, it does not work in reverse. You may think you’re prepared, but if you’re not a lawyer don’t argue law with one, you will not do well.

Oh, I totally meant it in a good way. I do a space news segment for a podcast and the host got to talk briefly to Buzz Aldrin. He tried to get Buzz to say "Keep looking up space fans" and Buzz replied saying it's not up and down, it inward and outward. I love dunks like that.

Part of the problem in these arguments, I have found, is that "obscenity" is a term of art and doesn’t mean the same thing to a lawyer that it does to a normal person, but like “obvious” it’s also a word commonly used by laypeople so they don’t realize that.

If you’re reading this, you have to understand this: if whatever it is is “obscene,” AS DEFINED IN LAW, you are done. It is not protected speech and you can go to prison for making it or having it, period, argument over.

And if you think you know what obscenity is, unless you are a lawyer or a VERY well read layperson, you are probably wrong. And this is the kind of wrong that gets your furry butt thrown in a hole so deep they have to pack in daylight by mule train.

That probably also applies to most lawyers, if we're honest. We might be able to remember "appeals to the prurient interest" and "contemporary community standards", but there's a lot of difference between being able to recite those elements & reliably apply them.
