And, for the record, since someone sent me the comment chains: I have two rules in my criminal defense cases: 1) No heroin dealers; and 2) No child abuse cases (of any type) Those are the two areas where my principles matter more than getting paid.

It was to me, too. But there were folks jumping in saying "It's child porn and against the law!" and "It's not child porn and perfectly legal!" So I said to myself "Well...maybe this would be a good time to explain both sides of that argument are right and wrong."

Explaining both sides goes against the General Polarization that discourse has become. There doesn't seem to be a place for reasoned argument anymore. It's rather sad.
I'm happy you took the time to outline the legalities of it and explain better to people why it's such a gray area and commend you for putting you time into explaining a tough subject. It's not easy to talk about in any job facet, especially when it's about legality.
Out of curiosity is lack of convictions also because of worry about one decision being made a landmark case or is that not a factor when it comes down to it?
Frankly? It's because obscenity cases are hard to win and generally disfavored in law.

I definitely agree with you, @KhazWolf, but this is also a very specific caveat in the article I'm writing. You would be shocked to discover the variance of "intent" when it comes to consuming this kind of media, rather than roleplaying.
The long and short is that this is one of few kinks that by its mere public presence has the potential to perpetuate abuse. Namely, this kind of content in particular can be used to groom children. I can tell you from the research I've been doing that it's happened in the fandom.
Consensual roleplay between two adults can frankly be left up to debate of whether or not it could be perpetuating abusive dynamics-- it can, but it also has the potential for victims of this abuse to heal-- that same argument is extremely difficult for this kink specifically.
I am diligently getting this damn story from mind to paper so hopefully I'll be able to explain this in more than just 280-character chunks at a time.

For the record, I'm in a similar camp to yours, and your post gave me some much needed reassurance.
Everyone's always looking for validation in their own beliefs. I'm more interested in how the law actually applies to this particular content & if there's some sort of time perimeter involved. You used to be into it, but lost interest some years back and you forgot to delete.
I think it was bound to happen with such a posting, given that it is a highly debated topic.
