      弁護士自治はなぜ大切か。弁護士は大衆の権力も含め、あらゆる権力から独立していなければならないからだ。そうでなければ、少数者の人権は守れない。戦前の人権派弁護士布施辰治は共産党員の弁護をする過程で裁判官による懲戒裁判にかけられ資格を失った。その反省から現在の弁護士自治制度がある。pic.twitter.com/WfX8KAH6bS

      大量懲戒請求事件の問題は、「数の力」で弁護士会に圧力をかけ、弁護士の意見表明を封殺しようとした点にある。とりわけ問題となる「朝鮮学校への補助金支給問題」はまさに少数者の人権に関わる分野であり、多数派に抗してでも、弁護士が発言すべき分野ではないのか。そこを攻撃したのが本件である。

      このような「数の力」による言論封殺は、社会のあらゆる分野で進行していることを指摘したい。例えば大学である。慰安婦問題などで発言する教授がいると、早速大学に大衆から圧力がかかり、発言が封殺される。弁護士自治以上に大学の自治が危ない。

      大学自治への攻撃と弁護士自治への攻撃は、反知性主義が生み出した狂気という点で見事な相似形をなす。元朝日新聞記者植村隆さんの勤務先に届いた脅迫状の束は、私の所属弁護士会に届いた懲戒請求書の束と同質のものである。もしかしたら、同一人物によるものかもしれない。

          根拠のない懲戒請求はいかなる場合にも許されないが、本件大量懲戒請求事案は通常のものと本質を異にする。繰り返すが、「馬鹿は相手にしない」等とヘラヘラ笑っている愚かな弁護士は、ニーメラーの警句を思い出すべきだ。貴方方が立ち上がる頃には、最早国内に味方は残っていないだろう。
