        デモには警備の警察官も大勢いるし、これまでに我が国ではヘイトデモは残念ながら数多くありましたが、実際にデモで「◯◯人殺せ」と名指しされていた「◯◯人」に対する殺人事件等に繋がった事例はあるのでしょうか？「明白かつ現在の危険」を根拠にするのはかなり無理があると思います。

        例えば、本邦であった、建物に向かって「殺してやるから出てこいよ」などと呼び掛けるようなデモの場合は、被害者の特定性でいけるので、わざわざ明白かつ現在の危険基準を用いる必要もないという処理になりますでしょうか？

        ヘイトスピーチやヘイトデモで害される利益を生命や身体の安全だと考えればそうなりますが、ヘイト行為で害されるのはむしろ個人の人格的利益（自己のアイデンティティを否定されない利益等）ではないのですか？そう考えると、名誉毀損や侮辱と同様に明白かつ現在の危険があるともいえそうですが…
