Wow tons of great interest. This is awesome let's keep it going and I will be on this hard tomorrow getting in touch with DC counsel. Be patient though bc this takes a few weeks to get together. First of all you need a few things to happen before you can file for malicious prosecution. They are as follows: the ending of a criminal proceeding, termination in the defendants favor, and lack of probable cause. You can ask for injunction if you think your malicious prosecution was part of an agencies policy but, again, for malicious prosecution to apply in terms of 1983 it needs to be in a criminal context.

An emoluments clause case isn't a criminal proceeding, it's a civil suit. So you already can't file.

But, anyway, we are talking about intervening. What legal right would be at stake for anyone on this sub if President Trump were taken to civil court for an emoluments clause violation (see: Civ. Rules of Federal Procedure 24)? Liking the guy isn't enough, you need an actually legal stake. You would be intervening as a defendant. If Trump lost (and I honestly I don't think he will) would you be subject to any adverse effects? Not from a legal standpoint. That's without even getting into the other three prongs of intervenor.

If anyone wants to write an IRAC and prove me wrong I'd love to see if it. I work on 1983 cases and this analysis looks terrible.

Just looked up the legal definition of emolument and I'm no lawyer but it seems to me that they would have to prove Trump is paid some sort of salary or was otherwise compensated for some sort of specific labor or task by a foreign government (Russia). Surely the profits from his own private properties and holdings do not count as a salary or other form of compensation from the Russian government.

The judge should throw this case in the trash right in front of them.

Since he didn't divest his business holdings, when he tells foreign governments to use his hotels, he is breaking the implement clause. That's what people are saying.
