Here me out here and I am still working on this. But yesterday 196 members of Congress joined as Plaintiffs in one lawsuit against POTUS. Link is here http://theusconstitution.org/sites/default/files/Congress_Emoluments_Complaint_FINAL.pdf.

This is absolute bullshit claim based on Article I, Section 9 of Constitution specifically the word Emoluments. For my purpose whatever these Democrats are suing over is irrelevant.

Here's the good shit. See normally members of Congress are immune to legal action under the debate and speech clause of the Constitution. Now this immunity shield is some pretty strong Death Star stuff BUT members lose this Death Star immunity if they do things that are beyond the normal legislative shit they do. Like file a lawsuit against the President. That is why when I heard about this I was kind of like "fucking A whaaaat." Yea so in filing suit against the President these 196 Democrats have taken their imperial Tie Fighters into another solar system away from the home planet and so THEY ARE EXPOSED.

Now since all 196 are named Plaintiffs this means that any person who has a claim against them which could be argued as arising from the same underlying facts and circumstances as they allegations -(this is very broad by the way) can move the Court to intervene in this Emoluments litigation as a "THIRD-PARTY PLAINTIFF"

And if there were enough of us "third-party Plaintiffs" we could intervene as a "class" in a class action Third-Party Plaintiff and wait - it gets better seek a judgment against everyone of 196 members of Congress PERSONALLY. Whats more is that since they won't have immunity they have to pay for their own lawyers 😍😍

Yea so -whew- I can't believe they were this stupid.

So I am still doing some research but so far what I have stated above holds true.

The question is - on what grounds are we going to sue these bastards.

Wow tons of great interest. This is awesome let's keep it going and I will be on this hard tomorrow getting in touch with DC counsel. Be patient though bc this takes a few weeks to get together. Agreed all the way down. Slow and low is the motto. We don't fire away until all defenses are ready and we have them dialed in on radar. I am going to get some foot work done tomorrow and see what I get from some counsel in DC. Ya never know. I am not I.         So much wrong with this.

        First of all you need a few things to happen before you can file for malicious prosecution. They are as follows: the ending of a criminal proceeding, termination in the defendants favor, and lack of probable cause. You can ask for injunction if you think your malicious prosecution was part of an agencies policy but, again, for malicious prosecution to apply in terms of 1983 it needs to be in a criminal context.

        An emoluments clause case isn't a criminal proceeding, it's a civil suit. So you already can't file.

        But, anyway, we are talking about intervening. What legal right would be at stake for anyone on this sub if President Trump were taken to civil court for an emoluments clause violation (see: Civ. Rules of Federal Procedure 24)? Liking the guy isn't enough, you need an actually legal stake. You would be intervening as a defendant. If Trump lost (and I honestly I don't think he will) would you be subject to any adverse effects? Not from a legal standpoint. That's without even getting into the other three prongs of intervenor.

        If anyone wants to write an IRAC and prove me wrong I'd love to see if it. I work on 1983 cases and this analysis looks terrible.

        Make sure you check ANY lawyers twitter feed first before you hire them. I follow a few on Twitter and they are anti-Trump and litigating the hell out of him. It makes me furious when I see their tweets.         I can understand the taxation is theft crowd that wants a vastly reduced military in addition to vastly reduced government spending in every other aspect as well. I believe we need a large military right now, but pure libertarians stick to their values and I respect that.                                       Just looked up the legal definition of emolument and I'm no lawyer but it seems to me that they would have to prove Trump is paid some sort of salary or was otherwise compensated for some sort of specific labor or task by a foreign government (Russia). Surely the profits from his own private properties and holdings do not count as a salary or other form of compensation from the Russian government.

                                      The judge should throw this case in the trash right in front of them.
