This is actually quite an important issue for debates with statists. It's not even worth engaging in the "equality" issue.

Statist: "The state makes people equal."

Wrong response: "I don't think it does because...."

Correct response: "I don't give a fuck. Making people equal isn't a virtuous end in the first place. People aren't equal, and trying to make them equal necessarily involves unnecessary harm/expense to some that have done nothing wrong to deserve it."

Equality is best considered a principle of justice (by which I mean the proper aplication of morality/legality), not of morality/legality themselves. Take any specific example of an equality being advocated for and what you will find is that there is another representation of equality made impossible by its implementation. Giving women the vote represented equality but taking the vote away from men would have too, forcibly re-distributing incomes to make everyone financially equal refuses to take as equal the choices of people and their implications juxtaposed against reality.

Equality is not fit as a principle to differentiate between different equalities ergo it is completely insufficient to claim legality/morality should be/be considered a certain way because of equality.

It's an important tool in the application of any moral/legal precedents but that is it.
