Thanks for reading advice needed, Go to bottom for short version. So here's the situation, a while ago my brother got his phone stolen by this African American kid. He was the only one that had the ability to take it. He even called my aunt from the phone and said he was at my house playing on my brothers phone.

Later on, there was a conflict between the boy and his other friend and my brother and his friend. They kept cussing out my brother through the fence. After continuously asking him to leave, he tried to climb the fence. While he's doing this I come outside. I took his phone and made him leave. Stupid play but I know this way I could get my brothers phone back.

Later on the African Americans friend tells his family to come to my parents restaurant and they say I punched the kid and stole his phone. Isn't that slander or something?

We come to the African Americas house to talk to his parents. They aren't there but we still gave the phone back to the unattended 8-9 year old girl there.

Conclusion: He steals my brothers phone, trespasses our house, I take his phone, he saids I punched the kid which I didn't, I returned the phone.

Also I am in Denver Colorado

Help me. I want to know if they can get lawsuits involved. I have no idea what can or will happen. Thanks so much. My parents are super angry at the situation as they don't believe I'm educated enough about law.

Try to not point out that it was an african american kid that stole the phone so often in court. It makes you sound racist.

If they sue you show up to Court, but in short if the kid told his parents that you punched him and they just repeated that believing it to be true that won't be defamation, not to mention that you have no damages from it. However, if you physically took the phone from the kid then you have now committed assault in addition to the theft.

But the phone was on the floor when I took it. Also is it still theft if returned within an hour?

Then you can avoid assault, but yes of course that is still theft.

I could of put him as kid a or b but it was more time consuming to my situation. We were all different races I though of putting him out so we all know. His friend was Mexican and we are Asian.

If someone stole your phone or your brother's phone, contact the police. Self-help solutions like taking the perpetrator's phone are only going to get you in trouble.

If the police investigate this incident involving your actions, you do not have to tell them anything about what you did and you should not.
