Garlands nomination expired at the end of the last Congress. The Senate refused to confirm him, as is their constitutional right to do.

And according to Schumer now you need 60 votes, well Garland never had a prayer in either this or the last Senate to get close to that.

To quote Obama: "Elections have consequences." When the GOP took the Senate in 2014 any Obama nominee was DOA wether they had a vote or not.
