This ruling is purely a political decision and has no foundation in the law. The critical issue beyond Presidential power is that an immigrant who has not entered the country has no constitutional rights at all. There are other 9th Circuit cases that say this specifically. In order to get around this issue that is fatal to the lawsuit, the opinion refuses to accept that Trump modified the order to exclude lawful permanent residence who do have constitutional rights. They basically ignore what Trump has ordered to get to an opinion that supports their political view point.

Around 80% of their decisions heard by the Supreme Court are completely overturned. In some years they have almost double the cases overturned than the total amount of cases SCOTUS accepts from any other circuit. Yes the 9th circuit is unable to make correct judicial decisions in more than 3/4ths of cases their bosses rule on. They are a failure of a court.

It is a well known liberal activist court and even the damn SCOTUSblog site says so.

      All 3 should rule for Trump. No excuse, not even feels, could overrule the law. Sad day if even 1 of them sides with Judges being able to block Presidential power that is clearly spelled out. If they can rule that way, they can do anything. They could remove all power from the Executive Branch.

      It's airtight. Ruling against the "ban" is pretty much treason. At best irresponsible and dangerous. Review is not allowed since the person doing the review cannot have access to the information needed to make the decision. Judges should be impeached if they rule against it.

      The impeachment of federal judges is a "muddy" process and I think it's only happened about 15 times in the history of the US(Don't quote me on that but I think it's close). Considering how many federal judges we've had over that period, It's kind of a non thing, because the ones that have been removed, were either accused/convicted of crimes or some sort of sexual misconduct.
