So about a month ago I stole a $400 giftcard from a friend's mom. I bought a number of items with the card, one of which was a ps4. When police came to my house, they had a warrant to take the card, and the ps4.

So today, after Court, I paid the $400 and everything is more or less back to normal, aside from the ps4. How would I go about getting that back? And if it cannot be returned, why did I have to pay for it twice?

NOTE: DID NOT PAY A FINE PAYMENT WAS PURELY IN THE FORM OF RESTITUTION

You didn't. You stole a giftcard so when you bought it, you didn't. You paid 400 to reimburse for your theft. You only paid once.

Then why was the giftcard charged when I bought it? It's not like the ps4 was free. It has value. If nothing else, my fine should not have been for the full $400.

Oh I see your problem. You don't realize society cut you a break. Your fine should have been MORE than $400 to make sure you never do it again. Only paying the $400 may make you think its ok to steal as long as you are able to cover the cost of the theft.

So much this. One of my buddies stole an Xbox 360 a few years back with an estimated value of ~$100. After the fine and court costs, he paid ~$1500 in total. Just paying back the value of the item isn't much of a deterrent at all.

At no point did you transfer any of your money to buy the PS4. So it's not yours. You are exactly where you were before the theft.

That's not your money. You didn't pay for it. You used stolen money to pay for it.

No, you aren't. You stole $400 and you paid back $400.

As is, even if you are "deeper", that's what's called "punishment". It's supposed to teach you not to steal. So next time you think about taking someone else's money, you say "Well gee, I don't want to be punished, maybe I won't do that".

If you hadn't stolen anythung in the first place, you wouldn't be in this mess at all.

You don't get to just go around stealing stuf and then pay back what you stole, and keep items you got through your criminal behavior. You lose out on everything. Because punishments are not supposed to be nice or fun.

You're not paying them $600. By using stolen money to buy the ps4, you're not out any money on it. But they're out their $400 until you pay it back.

And you don't get to keep shit you bought with stolen money. It really doesn't matter who has the ps4, it's not yours, you don't get it, and you're not losing out on any extra money by not having it.

    The purchase was still made, regardless of where the funds came from. The ps4 still has a value, regardless of who's hands it lies in. I was charged for the ps4, and I was charged with a fine to pay them back. That's paying for it twice

    Restitution is still a punishment. They could have fined you. The court did not have to make you whole. Frankly, they should have made you worse off.
