Andrea Constand was the director of operation for the Temple women’s basketball team. She developed a friendship with Bill Crosby, a prominent and active Temple alumnus, in 2002. She attended dinner parties and private dinners at Mr. Crosby’s home. In January 2004, Crosby gave pills to Constand. She became semi-conscious and was unable to move. Crosby touched Constand and manipulated her to touch him.
Constand continued to having contact with Crosby until at least August 2004. In January 2005, a criminal investigation was opened regarding misdemeanor violations of the law. Please note the statute of limitations for a misdemeanor is two years. The investigation was closed within a month for the lack of evidence supporting the charges.
Constand filed a civil suit within a month. The suit was settled in November of 2006. The parties were subject to a confidentiality agreement. Constand violated this confidentiality agreement in various ways most importantly by releasing Crosby’s disposition for the civil case. Crosby is seeking the return of the settlement. The disposition includes admission by Crosby of felony behavior. This is critical as the statute of limitation for a felony is 12 years which would run out in January of 2016.
Bruce Castor was the prosecutor during the original investigation wrote an e-mail to his successor, Risa Fermin, that he had a verbal agreement with Crosby his disposition would not be used in a criminal trial.
Bruce Castor decided to seek the prosecutor’s office that he vacated in 2008 running against the incumbent Democrat Kevin Steele. Charging Crosby became the primary focus of the election with Steele promising pressing charges upon election. Steele filed criminal charges shortly after a successful election.
Crosby has been charged with three counts of aggravated indecent assault.
