It's pretty common knowledge that freedom of speech and expression in other parts of the world is much different from what it is in the US. For example, the "ban" on kinky porn in the UK, the ban of the burka in France, the ban on "hate speech" in Germany... I don't know how "Western" you'd consider Russia but they've banned homosexuality and "homo propaganda." It's a big world out there, with many different kinds of people.

I've been learning lately that a lot of western countries don't have free speech. Canada doesn't either. The US is one of the few (possibly only?) countries that has true free speech where you can say whatever offensive/rude/mean/racist things you want and won't be punished by the government. Just don't threaten/insight violence and you're free to say whatever you want.

The UK has no absolute right to free speech. While swearing in public isn't illegal, 5(1) and (6) of the Public Order Act 1986 and breach of the peace in Scotland give police sweeping powers to arrest people swearing or being offensive in public.

A person is guilty of an offence if he:

  • uses threatening (or abusive) words or behaviour, or disorderly behaviour, or
  • displays any writing, sign or other visible representation which is threatening (or abusive),

within the hearing or sight of a person likely to be caused harassment, alarm or distress thereby.

.

This offence has the following statutory defences:

  • The defendant had no reason to believe that there was any person within hearing or sight who was likely to be alarmed or distressed by his action.
  • The defendant was in a dwelling and had no reason to believe that his behaviour would be seen or heard by any person outside any dwelling.
  • The conduct was reasonable.

PS - In practice most of the time if you get arrested, you'll get a ticket, and be released the following morning. They don't prosecute or send you to jail for Harassment, alarm or distress. Only approx 1K/year prosecutions are even brought (since the others are presumably dealt with through on the spot fines or the individual is released without charge).

For a little while longer, anyway, a UK citizen can challenge a government decision under the assertion that one of their ECHR rights has been infringed (In this case maybe Art.10 freedom of expression). While it's not UK law (EU law incorporated by HRA), it might offer the possibility of recourse.

Although I suppose the statute you mentioned could serve to rebut the freedom under the 2nd arm of Art.10.

I haven't heard anyone I know justify it like that. It's more that this isn't actually much of an issue. In any remotely civilized country in Europe you can say whatever you want and nobody will care, regardless of what the laws technically are. Therefore it's not an active issue that is a part of any political discussion. And changing such a fundamental law would rock the boat way too much for any politician to get near it at this point. Why would they? There would have to be some massive incident for this to become a hot subject.

Even in the US you can't do that (paint an obscenity on the side of your house) if you entered an HOA covenant when you bought it. If you live on your own land sans HOA, then sure, but most people have to abide by HOA rules. That said, the police aren't going to come arrest you if you violate HOA, instead you'll just get a fine.
