環境省動物愛護管理室は「飼い主にはうるさくなくても、イヌの鳴き声は近隣の迷惑になる。
飼い主は、無駄ぼえしないようにしつけたり防音の工夫をした犬小屋を使うことが求められる」との事。

動物の保護及び管理に関する法律では、動物の所有者又は占有者は、その動物を適正にに飼養し、又は保管することにより、人に迷惑を及ぼすことのないように努めなければならないと定めています。
さらに、この法律に基づき、犬及び猫の飼養及び保管に関する基準が定められています。
一般原則として、犬又は猫の本能、習性、生理を理解し、家族同様の愛情をもって保護すること、人の生命、身体、財産に対する侵害を防止し、生活環境を害することのないよう責任をもって飼育に努めることなどを定めています。
危害防止については、放し飼い防止のほか、飼育目的に応じて適正な方法でしつけを行い、特に飼主の制止に従うよう訓練に努めること、と定めています。

軽犯罪法では、犬の世話をしないで放置し、吠え立てるままにして、そのため近隣に迷惑をかけているような場合は、公務員の制止をきかず、人声、楽器、ラジオなどの音を異常に大きく出し、近隣に迷惑を及ぼし、という禁止条項にあてはまることも考えられます。
こういう場合は警察官に制止してくれるよう頼むことも、問題解決の一方法です。
