@BobStein_FT@marcportermagee that's where the Convention of States comes in. - その他の返信を表示

Can we get a legal ruling somehow from SCOTUS on single issue CoS?

@morganwarstler@BobStein_FT@marcportermagee nope. No advisory opinions.

And it doesn't have to be proposed by Congress. It just takes 2/3rds of states.pic.twitter.com/UFmVx1mJhx

@marcportermagee 2/3 hurdle in Senate and House seem pretty ironclad though. - その他の返信を表示

@ChrisTessone You can propose an amendment with 2/3 of the states - その他の返信を表示

@marcportermagee I see. I'd forgotten that.

@marcportermagee Rs don't control 2/3rds of the House or Senate (and have no realistic hope of doing so.) - その他の返信を表示

@marcportermagee There's a lot of things to be scared of, but this is not one of them. -
@marcportermagee We might see some symbolic attempts, but the country is too divided for any serious amendments for the foreseeable future. - その他の返信を表示

@ZetaZetan@marcportermagee You don't necessarily need Congress at all to either propose or ratify a constitutional amendment. -
@brianeha@marcportermagee A constitutional convention would bypass Congress, but would also bypass the STATES. It has no rules whatsoever. - その他の返信を表示

@brianeha@marcportermagee Once they call it, they have no further control over it. That's why it has never happened. - その他の返信を表示
-
@brianeha@marcportermagee It could just as easily produce a wave of liberal amendments (and change the ratification rules to let them in.) - その他の返信を表示
-
@ZetaZetan@marcportermagee It couldn't "produce a wave of liberal amendments" because you need 3/4ths of state legislatures to approve them

-
@marcportermagee@hilzoy That's not entirely accurate. They have partial control of five more. -
@AuldDragon Split legislatures would be much less reliable as a block. Falling below full control of 25% should be seen as a red line.

.
@marcportermagee Republicans only control both legislative chambers in 33 states, which is there relevant metric. http://www.rollcall.com/news/politics/republicans-expand-domination-of-state-legislatures …
