9 hours of "unpaid, voluntary training" that acts as a second interview for a job? (PA) (self.legaladvice)

I interviewed for a job at a coffee place and did well at the first interview.

The owner contacted me wanting me to do 3 shifts of 3 hours each. However, these are to be unpaid.

I told her I was uncomfortable with this and that i thought that is illegal. She responded that this is volunteer training, this acts as the second interview, and is legal in every way.

Specifically, she's saying I am a volunteer for those 9 hours and that the shop then hires their staff from their volunteers. The shop has a community building, social justice angle to the whole thing if that makes the volunteer angle any more believable.

I told her I'm not working 9 unpaid hours for a barista position that pays under $10/hour. I'm just wondering if what she's doing is actually legal.

This is in Pennsylvania.

You should report them to the labor board even though you're not taking the job. This is all kinds of not ok.

There is no such thing as "volunteer training", at least not legally. . A limited skills test, like how well you know Excel, wouldn't have to be paid, but if you're performing job functions (even if just learning) that is still time worked and must be paid.

For the lawyers, could OP work the 9 hours and then file a wage complaint for minimum wage for that time if they aren't hired?

It would certainly be petty, but I have applied to companies that reimbursed mileage and food costs specifically for the payment in my most desperate of times. I could see someone needing it badly enough to do so.

Not to my knowledge. They're website doesn't say anything about that and neither did any of their info sheets they gave me.

I think they're thinking of that coffee shop someone was asking about a few days ago. All the employees are "volunteers" and they crowdfund rent money.

Coffee shops do not need 9 hours of voluntary, unpaid training. Its a freaking coffee shop.
