I recently heard back from the U.S. Patent & Trademark Office regarding the process to get Trump labeled as a disparaging trademark, given the vileness that word as become synonymous with.
Long story short, their recommendation is to lawyer up in order to be informed on the procedural, tactical, and financial considerations involved. This is beyond my personal reach, as I am in no financial position to do this properly. I would hate to make a half-assed attempt, only for it to fail as a result. Better that when the attempt is made, it is done properly.
I will share the advice that was shared with me - - if any of you are inspired to do this the way it needs to be done, then godspeed to you.
For marks that are registered or applications that have already progressed beyond the opposition period, cancellation proceedings may be instituted. If you believe that a registered trademark should be cancelled, you can file a petition to cancel the registration with the Trademark Trial and Appeal Board (TTAB). The TTAB is a specialized administrative court within the USPTO. It handles, among other things, proceedings brought by parties seeking to prevent the registration of another party’s trademark or seeking to cancel the registration of a trademark. If you have other questions about filing a petition to cancel, you should contact the TTAB Customer Service Center at 571-272-8500 or toll-free at 1-800-786-9199, and you can refer to information online at http://www.uspto.gov/trademarks/process/appeal/index.jsp .
Other remedies
Finally, other remedies may be sought through litigation in federal court. For further information about these remedies, please consult a trademark litigation attorney.
General Information
For more information on USPTO policy and procedure, including the statutory basis for Trademark Act section 2(a) prohibition against disparaging marks, you may access the TMEP homepage here: http://tess2.uspto.gov/tmdb/tmep/. Also, if you have any general questions regarding the federal registration process, you may visit the USPTO Trademarks website at http://www.uspto.gov/trademarks/index.jsp.
Because there are procedural, tactical, and financial considerations involved regarding your concerns, you may wish to hire an attorney specializing in trademark or intellectual property law for a legal opinion. For attorney referral information, you may consult the American Bar Association’s Consumers’ Guide to Legal Help at http://www.abanet.org/legalservices/findlegalhelp/home.cfm or a local telephone directory. The USPTO cannot aid in the selection of an attorney. 37 C.F.R. §2.11.
