Father was diagnosed with Alzheimer's Disease 3 years ago at 59, after having a successful business and teaching for over 25 years. He was forced to retire, and was living on social security disability and his veteran disability money. His wife stopping making the house payment without telling anyone, found a boyfriend and is now moving out.
My sister and I found out the house was in foreclosure already, and I immediately contacted a lawyer and wanted to purchase the house myself, so I could just move in, and take care of my father. He loves the house, and it will just break his heart to have to leave. The house was put up for sheriff auction, and the only way we could stop the sale was to push the bankruptcy filing for my step mother and father to before the sale could happen.
So now the property is out of the stay that was imposed by the bankruptcy and I started the approval process for the loan the same day.
My current situation is, the loan process is about the leave the title office (where it was delayed due to people on vacation) and go to "final approval". The bank that is handling my loan, is the same bank that is selling the house at auction. The auction is happening in a few weeks, and they will not stop the sale until they have final approval on the loan. They say that laws forbid them to do so according to the foreclosure dept. of the bank.
I have paid my down payment of $8,400, I have paid for and taken a 9 hour online course for purchasing a house, they appraisal of the home has already happened as well, and the title work is currently happening.
Is there a possibility that I might lose my father's house to auction, and have to tell him he will have to move?
